Foreign participation within political parties is always influenced by the equation: citizenship-political rights-sovereignty, on which is founded the construction of the "modern State"; this is the model on which our legal systems still rely. Increasing the possible participation processes allowed "no-citizens" as well as the extending some political rights to them raises the question of foreign participation in the party system (or party association). Moreover, these changes bring into discussion the traditional role of the political party as a channel of participation in public decisions. With the aim of identifying possible solutions to the problems mentioned above, this essay tries to analysis the experience both at a local and central level. With the developments that characterize the local experience, it is possible to trigger a process of change that might interest the national authorities. ; La partecipazione degli stranieri ai partiti politici è da sempre condizionata dall'equazione cittadinanza -diritti politici-sovranità sulla quale si è fondata la costruzione dello "stato moderno", al cui modello ancora oggi è possibile ricondurre i nostri ordinamenti statali.L'incremento dei processi partecipativi e l'estensione di alcuni diritti politici ai "non cittadini" pone il problema della partecipazione dello straniero all'associazione partitica. Questi cambiamenti mettono, altresì, in discussione il tradizionale ruolo del partito politico quale canale di partecipazione alle decisioni pubbliche.Per poter individuare possibili soluzioni ai problemi prospettati il presente studio muove dall'analisi dell'esperienza svolta a livello locale e nelle amministrazioni territoriali. The integration between the European Union and the different national legal orders has been pursued not only through the approximation of national laws but also through the dialogue and the cooperation between jurisdictions. In particular, the achievement of the principles of direct effect and supremacy of European law have entailed, as corollary, the necessary involvement of the national jurisdictional system on the implementation of European law. At the same time, the increasing of the european substantial law has laid the problem of the harmonization of the different national procedural systems, realized through provisions with procedural contents and through the clarification of general principles concerning procedural sphere by the European Court of Justice. So, the "European law" has shaped the fundamental aspects of national justice systems: interest that receive legal protection, reliefs that can be applied, procedural principles and rules, judiciary organization. The Italian legislator, with the "Administrative trial code" has shaped the system of administrative justice to European law both through a (interpretative) generic reference to the principles of European law and through a stated reference to the European Union law and systematizing principles and institutions which come from european sphere. ; Sommario: 1. W szczególności realizacja zasad bezpośredniego skutku i prymatu prawa unijnego wymogła na sądach krajowych aktywne uczestnictwo we wdrożeniu prawa Unii Europejskiej. Jednocześnie rozrastające się prawo materialne UE stało się źródłem problemu harmonizacji różnych krajowych systemów proceduralnych. Harmonizacja ta dokonała się za pomocą przepisów o charakterze proceduralnym oraz poprzez interpretację Trybunału Sprawiedliwości Unii Europejskiej ogólnych zasad dotyczących sfery proceduralnej. "Prawo europejskie" zatem ukształtowało podstawowe zagadnienia krajowych systemów wymiaru sprawiedliwości: interesy prawnie chronione, środki odwoławcze, przepisy i zasady proceduralne, organizacja sądownictwa. Włoski ustawodawca w niedawnej nowelizacji kodeks postępowania administracyjnego dokonał konsolidacji przepisów regulujących sądownictwo administracyjne z prawem UE, zarówno poprzez generalne odniesienie do zasad prawa Unii Europejskiej, jak i poprzez nowe uregulowanie i usystematyzowanie zasad i instytucji zaczerpniętych z prawa unijnego.

Rozwój wspólnotowego porządku prawnego przebiegał nie tylko na drodze normatywnej, ale jest on także wynikiem współpracy poszczególnych sądów. W szczególności realizacja zasad bezpośredniego skutku i prymatu prawa unijnego wymogła na sądach krajowych aktywne uczestnictwo we wdrożeniu prawa Unii Europejskiej. Jednocześnie rozrastające się prawo materialne UE stało się źródłem problemu harmonizacji różnych krajowych systemów proceduralnych. Harmonizacja ta dokonała się za pomocą przepisów o charakterze proceduralnym oraz poprzez interpretację Trybunału Sprawiedliwości Unii Europejskiej ogólnych zasad dotyczących sfery proceduralnej. "Prawo europejskie" zatem ukształtowało podstawowe zagadnienia krajowych systemów wymiaru sprawiedliwości: interesy prawnie chronione, środki odwoławcze, przepisy i zasady proceduralne, organizacja sądownictwa.
