O presente artigo analisa a proibição do uso da ayahuasca na França. Para isso, nos valemos de um amplo acervo documental que abrange a literatura acadêmica, documentos de órgãos governamentais, decisões judiciais, tratados internacionais, relatórios farmacológicos e entrevistas com atores-chave envolvidos no processo. Inicialmente, descrevemos a inserção da ayahuasca na França e a prisão do grupo do Santo Daime. Em seguida, analisamos os primeiros relatórios farmacológicos sobre a ayahuasca no país, os processos legais e a decisão do governo francês de proibir a ayahuasca em 2005. Após esse panorama, consideramos os desdobramentos da decisão para o uso da ayahuasca na França. Por fim, problematizamos o enquadramento legal da ayahuasca como entorpecente e o estigma dos grupos ayahuasqueiros. Pretendemos demonstrar que a posição da França não é aleatória, mas remete a posição do país em relação à questão das seitas e movimentos sectários.

This article focuses on the legal disputes between the U.S. government and the Centro Espírita Beneficente União do Vegetal (UDV), as well as on the regulation of the religious use of ayahuasca by the Drug Enforcement Agency (DEA). Our aim is to present the main issues that were at stake throughout the dispute, especially the relationship between the limits of religious freedom when associated with the use of controlled substances.

O presente artigo tem por objetivo apresentar algumas das principais contribuições de alguns dos principais autores do pragmatismo francês para as Ciências Sociais. No entanto, tendo em vista a variedade de autores, temas e conceitos que orbitam em torno da noção de uma sociologia pragmatista, optamos por focar na sociologia da crítica de Luc Boltanski e Laurent Thévenot, nos estudos de Daniel Cefaï e, em menor medida, de Louis Queré, sobre situações problemáticas, problemas públicos e arena pública. Assim, essa breve e interessada incursão no debate empreendido pelos autores do pragmatismo pretende delinear alguns elementos-chave do debate, pontuando os principais argumentos e conceitos desse importante movimento acadêmico.

The science of Law cannot ignore the phenomenon of the influence in Europe of the language, practice and teaching of American law, within an Americanization of Law which takes place alongside the Americanization of European culture. With regard to representative group litigation, Portuguese law has implemented a general set of rules in this area (Law 83/95). The law in force covers popular action to prevention, to the prosecution of offenses and to claims for damages. Popular action includes, amongst other interests protected by the law, public health, the environment, quality of life, consumers' rights, cultural heritage and the public domain. Standing is granted to any citizen who enjoys civil and political rights, and to associations and foundations, regardless of whether they have a direct interest in the claim or not, with the res judicata binding all members of the class who have not exercised their right to opt out.

O presente trabalho tem o intuito de abordar questões epistemológicas e metodológicas sobre o estudo da memória. Em um primeiro momento, trata-se de uma reflexão sobre a memória enquanto um fenômeno social passível de estudo pelas ciências sociais. Partindo dessa perspectiva, será realizada uma discussão sobre a possibilidade de apreender o fenômeno em pauta a partir de uma abordagem interpretativa.
