In recent norm research, the question of the relationship between norm contestation and norm dynamics has been the subject of substantial debate. However, until now too little attention has been paid to the question of how and when contestation intensifies. Based on the differentiation between applicatory and validity contestation, this article proposes a specific mechanism for intensifying contestation—understood as an increase in the contestation itself as well as an extension to its validity level—by treating norm modification as an intervening variable. The main argument is that norm modification may be necessary to reconcile different interpretations of norms. Consequently, if norm modification does not occur, norm contestation may intensify. This article elaborates this mechanism by examining the controversies involving the International Criminal Court (icc). It shows that contestation began at a low and applicatory level but intensified after several attempts at norm modification had failed.

Der internationale Strafgerichtshof (IStGH) wurde 2002 als permanentes internationales Gericht zur Ahndung von Kriegsverbrechen, Genozid und Verbrechen gegen die Menschlichkeit geschaffen. Als Friedensprojekt ins Leben gerufen, gilt er als Durchbruch bei der Bekämpfung von Gräueltaten und als ein Höhepunkt der internationalen Rechtsetzung. 2016 haben drei afrikanische Mitgliedsstaaten ihren Austritt aus dem IStGH erklärt und damit seine Legitimitätskrise offensichtlich gemacht, die schon länger schwelt. Auf die Austritte könnten weitere Rückschläge für die internationale Strafverfolgung folgen. "International Norm Disputes: The Link between Contestation and Norm Robustness" offers a rich, comparative study of when and why contested international norms decline. It presents central findings on the link between contestation and norm robustness based on four detailed, contemporary case studies - the torture prohibition, the responsibility to protect, the moratorium on commercial whaling, and the duty to prosecute institutionalized in the International Criminal Court. It also includes two historical case studies - privateering and the transatlantic slave trade. This book provides in-depth knowledge on contestation and robustness dynamics of central international norms. Having meticulously collected relevant data and conducted extensive qualitative coding, the authors demonstrate that norms are likely to weaken when challengers contest the validity of a norm's core claims but remain robust when they contest a norm's application and contestation does not become permanent. These important findings, comparatively presented here for the first time, are crucial for understanding the much-discussed problems of the contemporary liberal international order. The insights provided establish how different types of challenges will affect global governance mechanisms and which conditions are most likely to create fundamental change.

This report provides for the first time a detailed quantitative description based on survey data of those doctoral researchers who work and perform their research at one of the 91 Leibniz Institutes and Research Museums. In November 2017, the Leibniz PhD Network sent out invitations via PhD representatives and works councils to the doctoral researchers within the Leibniz Institutes and Leibniz Research Museums to participate in the survey's online questionnaire. The present report and the underlying survey are the products of a collaborative process within the Survey Working Group of the Leibniz PhD Network.
