Straipsnyje, pateikiant teorinį viešosios ir privatinės teisės santykio aiškinimą, siekiama pažvelgti į visuomenės moralines nuostatas dėl šeimos instituto teisinio reguliavimo. Kritikuojama nekorektiškai aiškinama valstybės teisinio neutralumo tezė, pagal kurią, šeimos kūrimas yra visiškai autonominis privačių subjektų reikalas, ir todėl valstybė negali piršti kokio nors šeimos idealo. Parodoma, kad tokia pozicija remiasi nekritišku teisės ir moralės skyrimu, teisei ir moralei bendrų universalių vertybių neigimu. Straipsnyje teigiama, kad liberaliojoje teisės doktrinoje, remiantis visuomenės kolektyvinėmis etinėmis nuostatomis, neišvengiamai preziumuojama kaip viešosios teisės imperatyvas individo unikali prigimtis, jo teisės į lygybę ir pasirinkimo laisvę. Tokiu būdu parodoma, kad privatinės teisės kompetenciją ginti individų laisvą susitarimą lemia ne jų individuali gamtinė, bet visuomeninė kolektyvinė būtis. Remiantis visuomenės narių laisvės ir lygybės bendruomenine kilme, nagrinėjama šeimos instituto pagrindinė prokreacinė funkcija, kurios reikalauja bendruomeninis identitetas (bendruomenės siekis išlikti istorijoje). Parodoma, kad, valstybei proteguojant skirtingų lyčių santuokas, ne paneigiama individų pasirinkimo laisvė, bet, atvirkščiai, pasirinkimo laisvei suteikiamas prasmingas turinys, kuris išplaukia iš universalių vertybių, bendrų teisei ir moralei. Straipsnyje teigiama, kad siekis sumenkinti tradicinės šeimos socialinę svarbą yra grėsmingas, nes pažeidžia pagrindinį socialinės integracijos modelių šaltinį – tradicinę šeimą.

On the ground of M. Römer's work "Suvereignty" there is presented in the article the representative democratic conception and "stretched nation" as sovereignty's idea. The parlamentary democratic constitutional construction is analysed too. There is stated in the article that parlamentary democracy by realysing "stretched nation's" interests structure puts into three autonomic state powers: President's institution power, Parlament and parlamentary Government institutions power and courts institution's power. ; Straipsnyje, remiantis M. The aim of the article is to show in what way it is possible to guarantee the proper representation of human interests in the parliamentary form of government. To quote ideas of Mykolas Romeris concerning relationships between sovereign and State powers, it is stated that a special function of safeguarding of constitutionality as an expression of the Sovereign's will ought to be provided in the Constitution of Parliamentary Republic. In the article, it is demonstrated that such function is implemented in the Constitutions of France and Germany by granting a President to guarantee a proper work of parliamentary system (the function of political and legal reserve). It is also shown that in Lithuania, which is considered to be a Parliamentary Republic, the President does not perform a function of political and legal reserve and does not have appropriate authorizations. The author of the article proposes to follow the standards of Constitutions of France and Germany and to reconsider the competences between the institutions of the Seimas and the President.

Straipsnyje siekiama parodyti, kaip parlamentinė valdymo forma gali užtikrinti deramą žmonių interesų atstovavimą. Remiantis Mykolo Romerio idėjomis apie suvereno ir valdžios santykį teigiama, kad parlamentinės valstybės Konstitucijoje privalo būti numatyta speciali konstitucingumo apsaugos funkcija kaip suvereno valios išraiška. Parodoma, kad tokia funkcija numatyta Prancūzijos ir Vokietijos Konstitucijose, suteikiant Prezidentui funkciją užtikrinti deramą parlamentinės sistemos veikimą (politinio ir teisinio rezervo funkcija). Atskleidžiama, kad Lietuvoje, kuri taip pat yra laikoma parlamentine respublika, Prezidentas politinio ir teisinio rezervo funkcijos neatlieka ir atitinkamų įgaliojimų neturi. Straipsnyje siūloma pasekti Prancūzijos ar Vokietijos Konstitucijų pavyzdžiu ir peržiūrėti Seimo bei Prezidento kompetencijas.

Straipsnyje nagrinėjamos produktyviosios vaizduotės ir intelektualinės intuicijos sąvokų santykiai klasikinės vokiečių filosofijos atstovų I. Kanto ir J. G. Fichtės filosofijoje. Produktyvioji vaizduotė apibrėžiama kaip praktinė, o intelektualinė intuicija – kaip teorinė subjekto ir objekto santykio charakteristika. I. Kantas šias sąvokas griežtai atskyrė ir jų santykį traktavo kaip niekada neišsprendžiamą problemą, o J. G. Fichtė, remdamasis intelektualinės intuicijos pagrindu, suabsoliutino žmogiškosios veiklos prigimtį. Intelektualinė intuicija yra tikrovės patirties jausmas, kuris neišreiškiamas jokiais diskursyviais metodais. Intuityvus suvokimas gali atsiskleisti tik dorovinio dėsnio (kategorinio imperatyvo) šviesoje. Susiedamas produktyvią vaizduotę su praktinėmis reikmėmis, absoliučios sintezės reikalavimu J. G. Fichtė išreiškia pagrindinę savo filosofijos tendenciją – teorinę proto struktūrą pajungti praktinei, o produktyviąją vaizduotę laikyti nesąmoningos intelektualinės intuicijos būviu.

Although the need of freedom is definite, the concept of individual freedom, while being interpreted with legal terms, causes not only theoretical, but also practical problems. The observed two extremes of freedom are defined as any human self-expression as well as the license, where the state power is generally attributed to disregard personal freedom. In this article the freedom of expression and state enforcement jurisdiction dichotomy are addressed by discussing positive and negative conceptions of freedom and the relationship between the interpretations of political liberalism and Kant and Hegel's philosophies. This paper aims to prove that the positive liberty is the assumption of the negative liberty. The paper based on Hegel's philosophy shows that freedom is the characteristic of human nature to seek identity. It is also argued that human identity can take many forms and, therefore, a person has a number of inherent rights and liberties. It is human psycho-physical identity that provides the right to life and health care; human creative identity, providing the right to privacy and freedom of occupation; human moral identity, which provides the right of dignity, and the moral autonomy of person's social and political identity, providing the political and social rights and freedoms. This article concludes that while a person uses the given rights with integrity and the state is limiting people's arbitrariness, there is no conflict between the freedom and state violation.
