This unit was published in "International Cooperation of Competition Authorities in Europe: from Bilateral Agreements to Transgovernmental Networks" Błachucki, M., ed., (2020). In recent years, there has been growing international cooperation between national competition authorities (NCAs). This takes various forms – from bilateral cooperation to establishing transnational competition networks. At the same time, this process has not been accompanied by the development of supervisory mechanisms. The article seeks to review the national control mechanisms that may be used to supervise international cooperation between NCAs. They are based on the Polish example and presented in a comprehensive way in order to capture all possible forms of control, such as hierarchical administrative control, control exercised by an ombudsman, a public prosecutor, specialised supervisory administrative authorities and the European Commission, covering judicial (both national and European) supervision, parliamentary and social control. The article supports the view that proper mechanisms of control over the activity of specialised and often independent administration authorities (such as NCAs) are crucial for their accountability. Such mechanisms are also beneficial for the accountability of transnational competition networks.

The article aims at presenting the connection between growing international cooperation of public administration in relation to organization and functioning of public service. The presentation is made with the example of the antimonopoly administration. It begins with a short description of the legal basis of international cooperation of the Polish competition authority. It is followed with a short overview of different modes of this cooperation on global, European and bilateral levels. Despite extensive international cooperation of the Polish competition authority, its internal organization is rather inefficient and fails to deliver relevant input from the international cooperation into internal works of the authority. Similarly, civil servants of the competition authority are not offered to rise their skills in relation to foreign cooperation as well as there are no transfers between jurisdictional departments and the department for the international cooperation which keeps those departments separated.

This article concentrates on the exchange of information and evidence between competition authorities. The issue is analyzed from the perspective of both antitrust and merger cases. The level, scope and intensity of cooperation between competition authorities differs in respect to these two kinds of cases and, to an extent, the applicable legal framework varies as well. Our analysis is based on EU law, national legislation, and relevant case law, with attention also given to other sources of law such as bilateral and multilateral agreements, best practices, recommendations etc. In addition the problem of exchange of information is examined through the prism of the Polish Competition Act. Regulation 1/2003 and the ECN, created upon its provisions, provide detailed rules applicable for the exchange of evidence and information between competition authorities in antitrust cases at the European level. With respect to mergers, the provisions of Regulation 139/2004 do not have the same high degree of influence, hence considerable attention is given to soft law acts, such as recommendations of OECD and ICN, or best practices and informal agreements adopted by national competition authorities. ; Michał Mijal
