The article deals with freedom of speech as a spiritual dimension of being: moral emotions, conscience. The author outlined the indissolubility of freedom and necessity, freedom and responsibility for the written, oral and television image. It is emphasized that freedom of speech is a category not so much philosophical but political. Throughout the democratic world, it is an essential factor in the natural development of society on the basis of the constitutional order.Based on the analysis of media functioning it was emphasized, that freedom is a kind of political and civic oxygen of the media, because their main purpose is to create the preconditions for formation of moral and spiritual, educated, intellectually rich society. It is shown that freedom is the greatest moral and spiritual state of man. Under the banner of freedom, Ukrainian soldiers defend the independence of the State from Russian invaders.In connection with the Russian Federation aggression against Ukraine the principles and the functions of the media were re-understood, features of freedom and standards of journalistic creativity in historical and contemporary socio-political context were outlined. The author drew attention to the works of Professor M. Tymoshyk who was the researcher of creativity of the publicist, politician and diplomat Yevhen Onatskyi, who put the interests of the nation first in the fight against Ukrainian enemies, not one of its classes, the interests of the state, not of any party. These professional standards of journalism are all too important in the current era of globalization and hybrid warfare. Therefore, the standards of journalistic profession should be treated not traditionally, not stereotyped but unusual, creative, to promote victory over the enemy and approve of the spiritually united Ukrainian Ukraine.Freedom of speech, standards of the journalistic profession cannot be a tool for manipulating public consciousness in the interests of the aggressor. It should be based on the philosophy of Ukrainian-centrism. After all, a journalist should not be neutral, an indifferent retransmittor of information when it comes to protection of Ukrainian national interests, freedom and independence of the State. ; У статті розглянуто свободу слова як духовний вимір буття: моральне переживання, совість; окреслено нерозривність свободи і необхідності, свободи і відповідальності за писемне, усне слово, телевізійне зображення. В усьому демократичному світі вона є невід'ємним природним чинником розвитку суспільства на засадах конституційного ладу.На основі аналізу функціонування ЗМІ підкреслено, що свобода є своєрідним політично-громадянським киснем засобів масової інформації, адже їхньою головною метою є створення передумов для формування морально-духовного, освіченого, інтелектуально багатого суспільства. Показано, що свобода є найбільшим морально-духовним станом людини. Під прапором свободи українські вояки захищають незалежність Держави від російських загарбників.У зв'язку з гібридною війною Російської Федерації проти України по-новому осмислено принципи, функції діяльності ЗМІ, окреслено особливості свободи і стандартів журналістської творчості в історичному і сучасному суспільно-політичному контексті. Привернуто увагу до праць професора М. С. Тимошика — дослідника творчості публіциста, політика, дипломата Євгена Онацького, який ставив на перше місце у боротьбі з українськими ворогами інтереси нації, а не одного її прошарку чи класу, інтереси держави, а не якоїсь партії. Ці професійні стандарти журналістської творчості надто важливі у нинішній період глобалізаційних процесів та гібридної війни. Тому до стандартів журналістської професії треба ставитися не традиційно, не трафаретно, а неординарно, творчо, щоб сприяти перемозі над кремлівським ворогом, утвердженню духовно соборної української України.Обґрунтовано, що свобода слова, стандарти журналістської професії не можуть бути інструментом маніпуляції суспільною свідомістю в інтересах агресора. Вони мають ґрунтуватися на засадах філософії україноцентризму. Адже журналіст не повинен бути нейтральним, індиферентним ретранслятором інформації, коли йдеться про захист українських національних інтересів, свободу і незалежність Держави.

The article is devoted to the analysis of the transformation of the constitutional and legal status of the prosecutor's office in independent Ukraine, from its Soviet model with broad control and supervisory powers to the prosecutor's office of a democratic, rule of law state, its place in the modern system of public authorities. In the article, the analysis of modern reform processes in the system of the national prosecutor's office is combined with the coverage of models in the latest world constitutional and legal practice to different branches of power, and from that place the role and importance of the prosecutor's office in the system of state power. In scientific constitutionalism, there are several options for attributing a prosecutor's office to a particular branch of state power, or even defining it as a separate body of state power. The option of attribution of the prosecutor's office to the executive power system has been successfully implemented in the states making practice of the USA, Denmark, France, the Netherlands, Germany, Austria, Poland, and Sweden. The model of including the prosecutor's office in the legislative branch has the right to life, but it has not become widespread. Contrary to this model, the prosecution's attribution to the judiciary became a reality in Spain, Bulgaria, Croatia and other countries. In the Constitution of these states, the provisions on prosecutorial authorities and the regulation of their activities are contained in the sections of the judiciary. In addition to these basic options for determining the constitutional status of the prosecutor's office, there are others that are less common. The problem of determining the position of the prosecutor's office in the system of distribution of state power in Ukraine was one of the constant topics of discussion, on which various concepts and long-standing scientific and theoretical disputes were raised. The article is devoted to the actual scientific problem - the protection of human rights and freedoms by the judicial authorities, their priority in this process. It provides an analysis of international legal acts, devoted to this problem. It is stressed, that the success of judicial administration in the performance of justice depends on many factors, and especially on the regularity of the procedural form of resolving disputes in court and on the universality of the nature of the "procedural order". Compliance with the procedural guarantees of the administration of justice is a prerequisite for its implementation and proper consideration of court cases. The procedural guarantees of observance of human rights in the administration of justice include: courteousness of the court, transparency, openness of court proceedings, efficiency of justice, participation of the people in its implementation, competition of the parties in court proceedings, etc. Particular attention is paid to the specifics of guarantees of observance of human rights in criminal justice and analysis of normative and legal acts that establish the basic principles and guarantees of observance of human rights and their classification on: international legal acts, constitutional acts (constitutional or basic laws), legislative acts (first of all separate laws and codes). There are two groups of guarantees of the observance of human rights in the administration of justice. These are procedural guarantees, which are almost completely equated with the principles of justice and procedural safeguards for the observance of human rights in the administration of justice. Соблюдение процессуальных гарантий правосудия является необходимым условием его осуществления и правильного рассмотрения судебных дел. К процессуальным гарантиям соблюдения прав человека при отправлении правосудия относятся: беспристрастность суда, гласность, открытость судебного разбирательства, оперативность правосудия, участие народа в его осуществлении, состязательность сторон в судебном разбирательстве и др.Особое внимание уделено специфике гарантий соблюдения прав человека в уголовном судопроизводстве и анализу нормативно-правовых актов, устанавливающих основные принципы и гарантии соблюдения прав человека и их классификации на: международно-правовые акты, конституционные акты (конституционные или основные законы), законодательные акты (прежде всего отдельные законы и кодексы).Существует две группы гарантий соблюдения прав человека при осуществлении правосудия. Это процессуальные гарантии, почти полностью отождествляются с принципами правосудия и процессуальные гарантии соблюдения прав человека при осуществлении правосудия. Обе эти группы гарантий тесно взаимосвязаны и ни одна из них не может эффективно применяться без другой. Однако вторая группа гарантий включает в себя более подробный перечень правовых норм, касающихся уже специфического рассмотрения дел (порядка, сроков и т.д.), относительно того или иного вида судопроизводства.Проведено сравнение процессуальных прав потерпевшего и обвиняемого и сделан упор на невозможности ограничения процессуальных прав обвиняемого. This article examines how the Jewish experience can change the larger picture of revolution and war in Ukraine and conventional history of "the Russian Revolution." The case study of Kyiv's Jewish community shows that its creation as an imagined community and development in 1917 was in fact made possible by the war, which served as a catalyst for social development. The interethnic relationships in revolutionary Ukraine were built on the legacy and foundation of prewar tensions, which were reinforced by the ethnicization of politics brought by the war. The collapse of the Russian empire, the rise of nation-states, the emergence of a new order, which was neither known nor universally welcomed, pushed people to transgress old boundaries of social behavior, leading to mass violence in 1919 and 1920.

The work focuses on the basic principles of developing an adaptive learning system. The modern concept of open education assumes multilevel character of training, and also possibility of a choice of means, a place and time of training corresponding to its inquiries by trainees . This implies the availability of alternative teaching aids (courses) and application software for their creation, support of training and adaptation to a particular student. A significant challenge is to reduce the cost of developing e-learning courses and to increase their use in online learning. In addition, despite the availability of automated tools to simplify the development of pedagogical rules, it is impossible to generate rules suitable for any situation. These reasons have led to the search for a solution to the problem of developing e-learning courses that implement adaptive learning. The principles laid down in the concept of designing such a system are formulated. The structure of the system, including the model of the subject area (educational content), the model of the user, the model of adaptation and the model of evaluation of learning outcomes are presented. Within the framework of the proposed system, it has been developed and is at the testing stage. It is justified that the successful use of such a system by students contributes to the formation of their specific competences. In the adaptive system the roles of a teacher and a trainee are changing: a teacher is an organizer of the initial activities, and the responsibility for the results is shared with students. In this system, the democratic management style, not authoritarian one, is taken into account. A student is a performer of educational process and not a passive recipient of information (an object of the process). With the help of a teacher they acquire knowledge, actively involve into thinking process and plan own educational and cognitive activity. The central place in the adaptive learning system is occupied by a student with their individual features: biological potential and abilities, specifics of the organization of the cognitive process, the level of activity and independence in practical and cognitive activity, as well as efficiency, etc. The result of this system is a qualitative change in their individual features. Active independency of a student in the process of cognitive activities promote the development of individual qualities, the formation of intellectual and spiritual growth, as well as self-knowledge of a learner's personality. This is the way the system is adapted to the formulation of competence of individual self-improvement. ; Робота присвячена основним принципам розробки адаптивної системи навчання. Сучасна концепція відкритої освіти передбачає багаторівневий характер навчання, а також можливість вибору учнем засобів, місця і часу навчання, відповідних його запитам. Це має на увазі наявність альтернативних навчальних посібників (курсів) і прикладного програмного забезпечення для їх створення, супроводу навчання та адаптації до конкретного, якого навчають. Важливою проблемою є зниження вартості розробки електронних навчальних курсів і розширення можливостей їх використання в рамках мережевого навчання. Крім того, незважаючи на наявність автоматизованих засобів, що дозволяють спростити розробку педагогічних правил, неможливо згенерувати правила, які підходять для будь-якої ситуації. Перераховані фактори призвели до пошуку вирішення проблеми розробки електронних навчальних курсів, що реалізують адаптивне навчання. Сформульовано принципи, закладені в концепцію проектування такої системи. Представлена структура системи, що включає модель предметної області (освітнього контенту), модель користувача, модель адаптації та модель оцінки результатів навчання. В рамках запропонованої системи розроблений і знаходиться на стадії тестування. Обґрунтовано, що успішне використання такої системи навчаються сприяє формуванню у них загально специфічних компетентностей. В адаптивній системі змінюються ролі вчителя і учня: учитель виступає організатором навчальної діяльності, а що стосується відповідальності за результати, то він розділяє їх з учнями. У цій системі перевага віддається демократичному стилю керівництва, а не авторитарного. Учень є суб'єктом навчання, а не пасивним одержувачем інформації (тобто об'єктом). Завдяки вчителю він видобуває знання, активно входить в розумовий процес і займається плануванням власної навчально-пізнавальної діяльності. Центральне місце в адаптивній системі навчання займає учень з його індивідуальними особливостями: біологічними задатками і здібностями, специфікою організації розумового процесу, рівнем активності і самостійності в практичній і пізнавальній діяльності, також працездатністю і т.д. Результатом даної системи стає якісна зміна його індивідуальних особливостей. Активна самостійність учня в процесі пізнавальної діяльності сприяє розвитку особистісних якостей, формування умінь інтелектуального і духовного саморозвитку, а також самопізнання особистості учня. Таким чином, адаптивна система навчання спрямована на формування компетенції особистісного самовдосконалення.

Article 131 of the Constitution of Ukraine, which regulates the constitutional and legal status of the prosecutor's office, enshrined a new normalization of the bodies of the prosecutor's office, their place in the system of public authorities. Constitutional changes resulted in the exclusion of Section 7 of the Constitution of Ukraine "Prosecutor's Office" from the Basic Law, and Article 131 took its new place in Section 8 of the Constitution of Ukraine "Justice". Further development and clarification of the constitutional and legal status of prosecutorial authorities is acquired in the Law of Ukraine "On Amendments to Certain Legislative Acts of Ukraine on Priority Measures for the Reform of the Prosecutor's Office" of September 19, 2019. The Law introduces a new structure of the prosecutor's office, clarifies the law of the Prosecutor of Ukraine, the maximum number of employees of the prosecution bodies is determined, the requirements regarding the attestation of employees of the prosecution bodies are specified ; Статья посвящена анализу трансформации конституционно-правового статуса прокуратуры в независимой Украине, от ее советской модели с широкими контрольно-надзорными полномочиями в прокуратуру демократического, правового государства, ее место в современной системе органов государственной власти.Анализ современных реформаторских процессов в системе отечественной прокуратуры объединенн с освещением моделей прокуратуры в новейшей мировой конституционно-правовой практике ее места, роли и значения прокуратуры в системе государственной власти. В научной конституционалистики существует несколько вариантов отнесения прокуратуры к той или иной ветви государственной власти или вообще определения ее в качестве отдельного органа государственной власти. Вариант отнесения прокуратуры к системе исполнительной власти успешно реализован в государственном строительстве США, Дании, Франции, Нидерландах, Германии, Австрии, Польши, Швеции.Имеет право на свою жизнь модель включения прокуратуры в законодательную ветвь власти, но она не получила широкого распространения. В противоположность этой модели отнесения прокуратуры к судебной ветви власти стало реальностью в Испании, Болгарии, Хорватии и других странах Европы. В конституции этих государств положения об органах прокуратуры и регламентации их деятельности содержатся в разделах о судебной власти. Кроме указанных основных вариантов определения конституционно-правового статуса прокуратуры существуют и другие, но менее распространенные.Проблема определения места прокуратуры в системе разделения государственной власти в Украине была одной из постоянных дискуссионных, в отношении которой выдвигались различные концепции и велись длительные научно-теоретические споры. Революция Достоинства 2014г. стимулировала развитие современного этапа конституционного процесса, и внесения изменений в Конституцию в части правосудия, открыла путь для реформирования прокуратуры в Украине. Статья 131 Конституции Украины, нормирующая конституционно-правовой статус прокуратуры закрепила новый статус органов прокуратуры, их место в системе органов государственной власти. Конституционные изменения сопутствовали исключению раздела VП Конституции Украины «Прокуратура» из Основного Закона, а статья 131 получила свое новое место в разделе VШ Конституции Украины «Правосудие». Дальнейшего развития и уточнения конституционно-правовой статус органов прокуратуры получил в Законе Украины «О внесении изменений в некоторые законодательные акты Украины относительно первоочередных мер по реформе органов прокуратуры» от 19 сентября 2019 Законом вводится новая структура органов прокуратуры, уточняются и расширяются права Генерального прокурора Украины, определяется максимальное количество работников органов прокуратуры, конкретизируются требования, по аттестации работников органов прокуратуры и тому подобное ; Стаття присвячена аналізу трансформації конституційно-правового статусу прокуратури в незалежній Україні, від її радянської моделі із широкими контрольно-наглядовими повноваженнями до прокуратури демократичної, правової держави, її місця в сучасній системі органів державної влади.У статті аналіз сучасних реформаторських процесів в системі вітчизняної прокуратури поєднано із висвітленням моделей в новітній світовій конституційно-правовій практиці до різних гілок влади, а від так місця ролі і значення прокуратури в системі державної влади. В науковій конституціоналістиці існує кілька варіантів віднесення прокуратури до тієї чи іншої гілки державної влади або взагалі визначення її у якості окремого органу державної влади. Варіант віднесення прокуратури до системи виконавчої влади успішно зреалізований у державотворчій практиці США, Данії, Франції, Нідерландах, Німеччині, Австрії, Польщі, Швеції.Має право на своє життя модель включення прокуратури до законодавчої гілки влади, але вона не набула значного поширення. На противагу цій моделі віднесення прокуратури до судової гілки влади стало реальністю в Іспанії, Болгарії, Хорватії та інших країнах. В Конституції цих держав положення про органи прокуратури та регламентацію їх діяльності містяться в розділах про судову владу. Крім зазначених основних варіантів визначення конституційно-правового статусу прокуратури існують й інші, які менш поширені.Проблема визначення місця прокуратури в системі розподілу державної влади в Україні була однією з постійних дискусійних тем, щодо якої висувалися різні концепції та велися тривалі науково-теоретичні суперечки. Революція Гідності 2014р. стимулювала розвиток сучасного етапу конституційного процесу та внесення змін до Конституції в частині правосуддя, що відкрило шлях для реформування прокуратури в Україні. Стаття 131 Конституції України, що унормовує конституційно-правовий статус прокуратури закріпила нове унормування органів прокуратури, їх місця в системі органів державної влади. Конституційні зміни спричинили виключення Розділу VП Конституції України «Прокуратура» з Основного Закону, а стаття 131 набула свого нового місця в Розділі VШ Конституції України «Правосуддя».Новий Закон України «Про прокуратуру» від 14 жовтня 2014 р. уточнив конституційно-правовий статус, завдання та функції прокуратури. Подальшого розвитку та уточнення конституційно-правовий статус органів прокуратури набув в Законі України «Про внесення змін до деяких законодавчих актів України, щодо першочергових заходів із реформи органів прокуратури» від 19 вересня 2019 р. Законом запроваджується нова структура органів прокуратури, уточнюються та розширюються права Генерального прокурора України, визначається максимальна кількість працівників органів прокуратури, конкретизуються вимоги, щодо атестації працівників органів прокуратури тощо
