The article deals with the problematic issues of legal regulation and the introduction of methods for preventing violations of mandatory requirements in the implementation of municipal control. An overview of the trends in the development of municipal control as a function of local self-government in the context of trends in the use of a preventive approach at the municipal level is given. The issue of improving the activities of local self-government bodies in the conduct of municipal control is raised. Prevention, as a preventive method of prevention is required to make an obligatory component of the work of any inspector of the control body of local government. It is necessary to create a high-quality step-by-step system for forming competencies to prevent risks of damage inflicted on the values protected by law and apply it to all supervisory bodies. The use of such precautionary techniques will ensure the maximum result of the control activity and will become a socially important result with minimal expenditure of resources for municipal authorities and entrepreneurs. Currently, the preventive component of the control activity is perceived as a precautionary measure to prevent possible violations. The concept of control activity of local self-government bodies implies the availability of preventive methods in the process of work. The creation and methodical provision of a system of preventive measures will make it possible to minimize the occurrence of risks and damage, and to control subjects to increase their literacy in the legal regulation of control activities. ; В статье рассматриваются проблемные вопросы правового регулирования и внедрения методов профилактики нарушений обязательных требований при осуществлении муниципального контроля. Дается обзор тенденций развития муниципального контроля как функции местного самоуправления в контексте применения профилактического подхода на муниципальном уровне. Ставится вопрос об усовершенствовании деятельности органов местного самоуправления при проведении муниципального контроля. Профилактику как превентивный метод предупреждения требуется сделать обязательной составляющей работы любого инспектора контрольного органа местного самоуправления. Необходимо создать высококачественную поэтапную систему формирования компетенций профилактики рисков причинения ущерба охраняемым законодательством ценностям и применять ее всем контрольным органам. Использование таких предупредительных методик обеспечит максимальный результат контрольной деятельности и станет социально важным итогом при минимальных расходах ресурсов для муниципальной власти и предпринимателей. В настоящее время профилактическая составляющая контрольной деятельности воспринимается как предупредительная мера пресечения возможных правонарушений. Концепция контрольной деятельности органов местного самоуправления подразумевает наличие профилактических методов в процессе работы. Создание и методическое обеспечение системы предупредительных мер даст возможность минимизировать появление рисков и ущерба, а субъектам контроля повысить свою грамотность в правовом регулировании контрольной деятельности.

The article deals with topical issues of information support of municipal control and its influence on the implementation of control measures by local governments in the Russian Federation. An overview of the goals and objectives of information support within municipal control is given. One of the methods for improving the performance of control activities of local self-government bodies performing administrative functions is the use of new control methods based on the principles of risk assessment of controlled objects and possible losses, which is not possible without the introduction of new and advanced information systems and their introduction into information systems of municipalities. Applying new technological processes in their own activities, municipalities need to create personal Internet pages of inspectors and monitored objects that support large databases that can share information about control activities and the results of their work, both inside information systems and on external servers. The bodies of municipal control, for the purposes of informational support of municipal control, should subsequently create and take into account not only current information on their resources, but also provide an opportunity to appeal administrative and judicial procedures for the results of control activities, information on which is contained in open databases. ; В статье рассматриваются актуальные вопросы информационного обеспечения муниципального контроля и его влияния на проведение контрольных мероприятий органами местного самоуправления в Российской Федерации. Дается обзор целей и задач информационного обеспечения внутримуниципального контроля. Одним из методов улучшения работы организации контрольной деятельности органов местного самоуправления, исполняющих управленческие функции, представляется использование новых способов контролирования, основанных на принципах оценивания рисков подконтрольных объектов и возможных убытков, что невозможно без введения новых и передовых информационных систем и внедрения их в информационные системы муниципалитетов. Применяя новые технологические процессы в собственной деятельности, муниципалитетам необходимо создавать персональные интернет-страницы инспекторов и контролируемых объектов, поддерживающие большие базы данных, способные делиться информацией о контрольных мероприятиях, об итогах своей работы как внутри информационных систем, так и на внешних серверах. Органы муниципального контроля для целей информационного обеспечения муниципального контроля в последующем должны создавать и учитывать не только текущую информацию на своих ресурсах, но и предоставлять возможность обжалования в административном и судебном порядках итогов контрольных мероприятий, информация о которых содержится в открытых базах данных.

The article examines the problematic issues of legal regulation and the introduction of a risk-based approach in the implementation of control. An overview of the trends in the development of municipal control as a function of local government in the context of trends in applying the risk-based approach at the municipal level is given. Proposals are made on control issues based on a risk-based approach. The issue of improving the activities of local self-government bodies in the conduct of municipal control is raised. The form of control activity obliges the bodies of municipal control to exercise their functions with the established frequency of inspections of individual entrepreneurs and legal entities, which often results in ineffectual use of material means of controlling bodies and disorganization in the day-to-day work of controlled entities. At the same time, such situation is formed in municipalities, when the number of objects of control is higher than the capabilities of local government control authorities, which at some point leads to the impossibility of guaranteeing the optimal degree of protection of valuables protected by legislation when carrying out municipal control measures. The application of the risk management concept to reduce the aggregate administrative overload of the controlled objects together with the increase in the degree of effectiveness of the municipal control while increasing the degree of protection of the values protected by the legislation. ; В статье рассматриваются проблемные вопросы правового регулирования и внедрения риск-ориентированного подхода при осуществлении контроля. Дается обзор тенденций развития муниципального контроля как функции местного самоуправления в контексте тенденций применения риск-ориентированного подхода на муниципальном уровне. Сформулированы предложения по вопросам контрольной деятельности на основании риск-ориентированного подхода. Ставится вопрос об усовершенствовании деятельности органов местного самоуправления при проведении муниципального контроля. Форма контрольной деятельности обязывает органы муниципального контроля реализовывать свои функции с установленной периодичностью проверок индивидуальных предпринимателей и юридических лиц, что нередко приводит к безрезультатному использованию материальных средств контролирующих органов и внесению дезорганизации в повседневную работу подконтрольных субъектов. В то же время формируется такая обстановка в муниципалитетах, когда число объектов контроля превышает возможности органов контроля местного самоуправления. В определенный момент это приводит к невозможности гарантировать оптимальную степень защищенности оберегаемых законодательством ценностей при проведении мероприятий муниципального контроля. Применение концепции управления рисками необходимо для сокращения совокупной управленческой перегрузки подконтрольных объектов вместе с повышением степени результативности муниципального контроля при росте степени защищенности оберегаемых законодательством ценностей.

The article describes the evolution of the social structure of Abkhazia and Samurzakano in 1810-1870-ies. The author draw a parallel with a similar process in the territory of Georgia. It reveals the role of the supreme power in these areas for the development of the social structure of the region. The materials were documents of the state archive of the Krasnodar territory introduced into scientific circulation for the first time, the legislative acts of the Complete collection of laws of the Russian Empire. The study methods were the principles of objectivity, historicism, consistency and maximum possible neutrality of the relationship of the researcher to interpret and evaluate the factual material. The historico-comparative method is of great importance in the work, like others, it is not of a general nature, moreover, its application is substantially limited. Therefore, the comparison needs to be applied in complex two opposite forms. This comparison was conducted when comparing the same cycle on two neighboring areas, which are located under the authority of the ruler, and the second under the rule of the Russian administration. In conclusion, it is noted that the period of 1810-1870-ies became a period of economic stagnation for Abkhazia and Samurzakano. The reasons for this were not the some inherent weakness of the ruler of Abkhazia Mikhail Shervashidze, but his course on the traditional way of life. Mikhail Shervashidze simply didn't want to change anything in the structure of society. He was quite satisfied with the nobility, the gods, serfs and slaves, only in such a system of values the ruler was needed as the supreme authority. At the same time, for the development of capitalist relations, both in the city and in the countryside, a completely different tooling was required. This toolkit was effectively tested on another neighboring territory, on the territory of Georgia. © 2017 by Sochi State University.
