Abstract
We analyze the effects of accidents and liability obligations on the incentives of car manufacturers to monopolize the markets for their spare parts. We show that monopolized markets for spare parts lead to inefficiently high prices for spare parts. Furthermore, monopolization induces the manufacturers to choose inefficiently high qualities. The key for these results is the observation that high prices for spare parts entail a negative external effect inasmuch as liability obligations imply that consumers of competing products have to pay the high prices as well.
Im Dezember vergangenen Jahres hat das Europäische Parlament einer Vorlage der Europäischen Kommission zugestimmt, wonach die Schutzrechte für das Design von Auto-Ersatzteilen eingeschränkt werden sollen. Für Ersatzteile, deren Design maßgeblich für ihre Funktionalität oder ihr äußeres Erscheinungsbild ist, soll es nach einer Übergangsfrist von fünf Jahren keinen Designschutz mehr geben. Eine ökonomische Analyse zeigt, dass diese Regelungen die Effizienz der Märkte erhöhen können. Der Wegfall von Schutzrechten ermöglicht Wettbewerb auf den Ersatzteilmärkten, wodurch sich nicht nur die Preise für die Ersatzteile selbst verändern. Vor allem werden die potentiellen Preisstrategien der Automobilhersteller so eingeschränkt, dass relativ geringe Preise für Autos nicht mehr durch hohe Preise für Ersatzteile kompensiert werden können. Dieser Effekt kann schließlich zu geringeren Preisen und damit zu effizienteren Marktergebnissen führen.

Seit dem 15. Juni 2017 dürfen Mobilfunkanbieter im Europäischen Wirtschaftsraum keine Preisaufschläge für im europäischen Ausland geführte Gespräche, verschickte SMS oder die Datennutzung verlangen. Mit dieser Regulierung soll ein digitaler Binnenmarkt ohne Benachteiligung der KonsumentInnen geschaffen werden. Die EU-Verordnung lässt Veränderungen in den Tarifstrukturen von Mobilfunkverträgen erwarten. Theoretische Überlegungen zeigen: Solange Mobilfunkanbieter eine Roaming-Option für wenigreisende NutzerInnen nicht ausschließen, profitieren alle von der EU-Verordnung - selbst diejenigen, die nur selten verreisen. In diesem Fall sind auch positive Wirkungen auf die gesamte soziale Wohlfahrt zu erwarten. Negative Wirkungen auf alle NutzerInnen sind allerdings dann abzusehen, wenn die Roaming-Option in einigen Tarifen ausgeschlossen wird. Das konkrete Marktergebnis hängt davon ab, wie sehr sich KonsumentInnen in ihrem Nutzungsverhalten unterscheiden. Die Tatsache, dass Tarife ohne Roaming-Option hierzulande von keinem der drei Netzbetreiber angeboten werden, legt eine positive Bewertung der Regulierungsmaßnahmen nahe.

The principle of net neutrality was adopted by the European Union as a regulation promoting equality among all data packets in the Internet. Considering net neutrality from a purely economic viewpoint, however, the general possibility to prioritize data packets would likely lead to a more efficient use of existing network capacity. This is particularly applicable given the growth in data traffic and time-sensitive applications such as live streaming. Competition among network operators could intensify if they had the possibility to differentiate their offers more finely-and private households would be the primary beneficiary. However, modifications in the spirit of net neutrality must go hand in hand with a clear commitment to competition law and its enforcement. Access to prioritization of individual data packets must be transparent and equally available to all network participants. Network operators which also act as content providers as well as market participants with strong market positions in particular must not have the possibility to discriminate content providers.

Since June 15, 2017, mobile network operators in the European Economic Area may not impose surcharges for making telephone calls, sending text messages, or using data services in other EEA countries. The regulation was designed to create a digital domestic market without adversely affecting consumers. The regulation raises the expectation of changes in mobile network operators' tariff structures. Theoretical examination shows that as long as mobile network operators do not exclude a roaming option for users who travel only occasionally, everyone will benefit from the regulations-even occasional travelers. In this case, positive effects are also anticipated for overall social welfare. However, negative effects are likely if some tariffs exclude a roaming option. The market result is highly dependent on how strongly consumers differ in their user behavior. The fact that all three mobile network operators in Germany exclusively offer tariffs with roaming options is evidence in favor of a positive assessment of the EU regulatory measures.
