Jeremy Bentham was a representative of the utilitarian theory, according to which the individual is governed by two feelings: pain and pleasure that determine their behavior. In the context of the liberal State of law, the legislator must guarantee the recipients of the norms that it produces, the greatest amount of satisfactions. The Benthamian thought, almost always appears included in the maxim: "the greatest happiness for the greatest number", pronounced by Bentham in 1776. The present article aims to analyze the Beccarian maxim with which it is always represented, in the light of the utilitarian theory advocated by Bentham. It delves into some central notions developed by the author: his concept of majorities, pain, pleasure and moral arithmetic as a function of the legislator. The above, seeks to contribute to the understanding of his thinking, almost always over simplified to a phrase that we rarely question and that has been the focus of many criticisms of utilitarianism.Keywords: Bentham, utilitarianism, majority, minority. ; Jeremy Bentham fue un representante de la teoría utilitarista, según la cual, el individuo se encuentra gobernado por dos sentimientos: el dolor y el placer que determinan su comportamiento. En el contexto del Estado de derecho liberal, el legislador debe garantizar a los destinatarios de las normas que produce, la mayor cantidad de satisfacciones. El pensamiento benthamiano, casi siempre aparece comprendido en la máxima: "la mayor felicidad para el mayor número", pronunciada por Bentham en 1776. El presente artículo tiene como objetivo analizar la máxima beccariana con la que siempre se lo representa, a la luz de la teoría utilitarista defendida por Bentham. Se ahonda en algunas nociones centrales desarrolladas por el autor: su concepto de mayorías, dolor, placer y la aritmética moral como función del legislador. O presente artigo pretende analisar a máxima bóqueriana com a qual sempre é representada, à luz de a teoria utilitarista defendida por Bentham. Inclui algumas noções centrais desenvolvidas pelo autor: seu conceito de maioridades, dor, prazer e aritmética moral como função do legislador.
