Aristotle's concept of zoon politikon: on political benefits of being not too perfect

RESEARCH OBJECTIVE: The article discusses the concept of zoon politikon in order to provide arguments justifying the attractiveness of Aristotle's practical philosophy.
THE RESEARCH PROBLEM AND METHODS: There are three quasi-definitions of man in Aristotle's works, each of which emphasises a different aspect of humanity. According to the philosopher, we are speaking animals, political animals (zoa politika) and the only animals endowed with reason. I argue that it is the condition of zoon politikon that comes to the fore as the most human of human properties. The article uses a historical-philosophical method supported by textual analysis.
THE PROCESS OF ARGUMENTATION: In the first part of the text, Aristotle's term zoon politikon is analysed as a concept intended to show the superiority of humanity over animality. In the second part, it is presented as a limitation that distinguishes humans from gods. By analysing how these two perspectives overlap, it is then possible to discuss some political consequences of the tension between them.
RESEARCH RESULTS: The analysis leads to the conclusion that, according to Aristotle, a good human is not someone who "exercises rationality to a high degree", but above all someone who is political to a high degree. It also suggests that Aristotle's concept can be used to distinguish between two kinds of politics, which should not be reduced to each other: "artificial" politics (which can be equated with power), and natural human politics (which is based on free individual action in the area of praxis).
CONCLUSIONS, INNOVATIONS, AND RECOMMENDATIONS: The notion of zoon politikon reflects the relational character of the individual human self, and thus offers a perspective that allows both methodological and political individualism to be challenged. It can also be a source of inspiration for those scholars, who argue that politics cannot be reduced to power.

CEL NAUKOWY: Celem artykułu jest zaproponowanie schematu metateoretycznego, pozwalającego uporządkować współczesne teorie demokracji i wskazać na ich wewnętrzne ograniczenia związane z przejęciem Hobbesowskiej matrycy pojęć.
PROBLEM I METODY BADAWCZE: Problemem głównym jest identyfikacja intelektualnego źródła, które wpłynęło na opisywany m.in. przez Ch. Mouffe "paradoks demokracji" powiązany z niespójnością "liberalnego" (patronuje mu w artykule B. Constant) i "demokratycznego" (Rousseau) stosunku do wartości, takich jak wolność i równość. Przyjęta hipoteza głosi, że źródłem tym jest dokonany przez T. Hobbesa i zradykalizowany na wiele sposobów podział prywatne–publiczne. Narzędziem analizy jest propozycja rozumienia systemu politycznego autorstwa D. Eastona w wersji przypomnianej przez C. Offe.
PROCES WYWODU: Zasadnicza część argumentacji ma charakter historyczno-filozoficzny. Przedstawia ona wpływ dominującego w nowożytności języka politycznego na rozumienie demokracji.
WYNIKI ANALIZY NAUKOWEJ: Badania prowadzą do wniosku, że współczesne teorie i innowacje demokratyczne umieścić można pomiędzy skrajnościami wyznaczonymi przez tzw. proceduralne ujęcie demokracji z jednej, a demokrację nieliberalną z drugiej strony. To jednak sprawia, że ich rzeczywista "innowacyjność" jest mocno ograniczona.
WNIOSKI, INNOWACJE, REKOMENDACJE: W konkluzji autor artykułu wskazuje możliwość postrzegania demokracji jako granicy europejskiego doświadczenia politycznego.
A Future Which Does Not Neglect the Past: On a Prudent Application of Memory ; Przeszłość, która nie zaniedbuje przyszłości. O roztropnym korzystaniu z pamięci
One of the most important challenges facing social sciences is to provide the foundation for a new paradigm that would allow them to regain the prestige they deserve and release them from the obligation to emulate natural science – the obligation forced upon them by modernity. The heritage paradigm (G. Ashworth) is one of the proposals that get more and more popular in this respect. It seems to be all the more attractive if one accepts the opinion of many contemporary historians and sociologists that the turn of the 21st century is the beginning of a new era of memory or commemoration (P. Nora). "Heritage" is a term borrowed from legal sciences, therefore the article uses broadly understood jurisprudence to outline a possible perspective for discussing both the modern paradigm and the new paradigm of heritage to identify the possible strengths and shortcomings of the latter. To achieve that, it refers to the concept of "practical wisdom," or prudence (the Greek phronesis or the Latin prudentia), derived from Aristotle's philosophy and then embedded in the political tradition of humanism. Prudence is the kind of knowledge that relies on time: both historical and individual time, as reflected in Titian's Allegory of Prudence. Prudence combines judgment, conditioned by the 'old' past experience (and here it shows its reliance on history and memory) and action, which is always concrete and future-oriented and so it requires the questioning what has been memorized and stored in individual or collective memory. These peculiar features of prudence make it beneficial in negotiating between individual freedom and social order, which is the crucial problem of any political community (B. Crick). ; Jednym z najważniejszych wyzwań stojących przed naukami społecznymi jest wypracowanie podstaw nowego paradygmatu, który pozwoliłby im odzyskać zasłużony prestiż i zwolnił z obowiązku naśladowania nauk przyrodniczych – obowiązku narzuconego im przez nowożytność. Taką propozycją jest paradygmat dziedzictwa (G. Ashworth), który zyskuje coraz większą popularność. Wydaje się on szczególnie atrakcyjny dla badaczy akceptujących głoszoną przez wielu współczesnych historyków i socjologów opinię, że przełom dwudziestego pierwszego wieku to początek nowej ery pamięci czy upamiętnienia (P. Nora). "Dziedzictwo" to termin zapożyczony z nauk prawnych, dlatego w artykule wykorzystano szeroko rozumianą jurysprudencję, aby nakreślić możliwą perspektywę analizy zarówno paradygmatu nowożytności, jak też nowego paradygmatu dziedzictwa, pozwalającą zidentyfikować ewentualne mocne i słabe strony tego ostatniego. Przedstawiona argumentacja korzysta z koncepcji "praktycznej mądrości" lub "roztropności" (gr. fronesis, łac. prudentia), wywodzącej się z filozofii Arystotelesa, a następnie przejętej przez renesansową tradycję humanizmu. Roztropność to rodzaj wiedzy polegającej na czasie i zależnej od czasu: zarówno historycznego, jak indywidualnego, o czym przekonuje obraz Tycjana pod tytułem Alegoria Roztropności. Roztropność łączy w sobie osąd, uwarunkowany "starym" doświadczeniem przeszłości (i tutaj pokazuje swoją zależność od historii i pamięci) oraz działanie, które jest zawsze zorientowane na przyszłość, a więc wymaga kwestionowania tego, co zostało zapamiętane i zapisane w pamięci indywidualnej lub zbiorowej. Te cechy roztropności sprawiają, że jest ona szczególnie przydatna w uzgadnianiu politycznej relacji między wolnością jednostki a wymogami ładu społecznego (B. Crick).

Why Politics Mutilates Conversation: A Pessimistic Comparative Analysis with an Optimistic Conclusion ; Dlaczego polityka okalecza rozmowę. Pesymistyczna analiza porównawcza z optymistyczną konkluzją
Contemporary political discourse often refers to dialogue and conversation as an important, if not the most important, element of a healthy democracy. Improving communication between public authorities and citizens, as well as between citizens themselves, is the goal of numerous practical democratic innovations. In the article, the historical perspective is used to argue that there is at least one obstacle which impedes a reliable democratic dialogue. The obstacle in question is the loss of dialectical competence, the causes of which I analyze referring to ancient philosophical debates on the role of the word in politics.Dialectic had been seen as the art of wise conversation since antiquity, but it soon fell victim to intellectual battles among philosophers, who saw it, at best, as a method of reaching the truth, and sophists, for whom dialectic was mainly a tool to creatively manipulate opinions of others. The unique political value of dialectic had been neglected over time and thus the dialogue itself became mutilated: deprived of the important prefix 'dia-' and reduced to the possibility of mere articulation of one's opinions and interests. I argue that the restoration of genuine dialogue in a democracy requires a deeper understanding of the nature of dialectical opinions engaged in political conversation, and the correct application of the dialectical method in the Aristotelian sense of the term. ; Współczesny dyskurs polityczny chętnie odwołuje się do dialogu i rozmowy jako ważnego – jeśli nie najważniejszego – fundamentu zdrowej demokracji. Dążenie do poprawy komunikacji między władzą publiczną a obywatelami, a także między samymi obywatelami, stanowi podstawę wielu praktycznych innowacji demokratycznych. Autorka artykułu przyjmuje perspektywę historyczną, by zwrócić uwagę na jedną z istotnych przeszkód w prowadzeniu rzeczywistego dialogu demokratycznego: na utratę kompetencji dialektycznych. Analizuje przyczyny tego zjawiska, odwołując się do starożytnych debat filozoficznych dotyczących roli słowa w polityce. Od czasów antycznych dialektyka postrzegana była jako sztuka mądrej rozmowy. Już wówczas jednak toczył się spór między filozofami, dostrzegającymi użyteczność dialektyki wyłącznie jako jednej z metod docierania do prawdy, a sofistami, dla których dialog stanowił przede wszystkim narzędzie twórczej manipulacji opiniami innych. Z czasem swoistość dialektyki i jej polityczna wartość uległy zapomnieniu, a dialog stał się rozmową okaleczoną (mową pozbawioną ważnego przedrostka "roz-") i sprowadzoną co najwyżej do możliwości swobodnego artykułowania partykularnych poglądów i interesów, które dzięki instytucjom i procedurom demokratycznym konkurują w walce o władzę bez możliwości zdominowania i uciszenia głosów alternatywnych. Zawarte w artykule rozważania prowadzą do wniosku, że wiarygodne połączenie dialogu i demokracji wymaga zrozumienia natury opinii dialektycznych zaangażowanych w rozmowę polityczną i odpowiedzialnego wykorzystania metody dialektycznej (w formule zaproponowanej przez Arystotelesa).

Law and Lawyers vs "Political Turn" and the "Return of Political Philosophy" ; Prawo i prawnicy wobec "zwrotu politycznego" i "powrotu filozofii politycznej"
The title of the article refers to P. Manent's essay, describing "the return of political philosophy". Using the distinction between science and art, suggested by thinkers such as J.S. Mill, an analysis was made of the possible responses of legal theory to the so-called "political turn" in social sciences and humanities. Attempts were made to show that transplanting such terms as "politics", "the political", "polity" (in the text they function under more theoretically neutral term: "politicalness") into the field of legal discourse leads to the rejection of the so far dominant (referring to the ideal of Ch. Montesquieu) image of the activity of lawyers as "artisans" practicing the art of law and to replacing it with the image of a lawyer-artists or lawyer-scientist. ; Tytuł artykułu nawiązuje do eseju P. Manenta, opisującego "powrót filozofii politycznej". Korzystając z rozróżnienia między nauką a sztuką, zaproponowanego przez J.S. Milla, dokonano analizy możliwych reakcji prawników i teorii prawa na wyraźny "zwrot polityczny" w naukach społecznych i humanistycznych. Starano się wykazać, że przeszczepienie takich terminów jak "polityka" i "polityczność" na grunt nauk prawnych prowadzi do odrzucenia dominującego dotąd (nawiązującego do ideału K. Monteskiusza) wyobrażenia działalności prawników jako "rzemieślników" uprawiających sztukę prawniczą oraz do zastąpienia go wyobrażeniem prawnika-artysty lub prawnika-naukowca.

The Polish–Lithuanian Commonwealth as a Border Experience of the City

Abstract
Referring to Fustel de Coulanges' distinction of urbs and civitas, the article discusses political theory and practice in 16th-17th-century Poland. While in western Europe an important shift in the notion of politics took place, and the civitas aspect of cities deteriorated as they were conquered by new centralized nation-states, the Polish–Lithuanian Commonwealth was an attempt to recreate the ancient and mediaeval concept of civitas – a community of free citizens, actively participating in the government – at the state level. As its proponents, such as Stanisław Sarnicki, argued, Poland was to become a city rather than a state, and so the theoretical justification, political practice, and eventual failure of this project is an interesting, though extreme, historical example of difficulties embedded in a more universal 'quest for the political form that would permit the gathering of the energies of the city while escaping the fate of the city' (Manent 2013: 5).
Does la bouche de la loi Have Anything to Say in Democracy? An Exercise in Legal Imagination ; Czy la bouche de la loi mają coś do powiedzenia w demokracji? Ćwiczenie w wyobraźni prawniczej
The article uses the potential of spatial imagination to discuss challenges judicial power and judges face nowadays, due to fierce philosophical and theoretical debates over the future of democracy and various "democratic innovations". To identify and discuss possible reactions to these new challenges, we refer to the three-level concept of the political universe. It is argued that the "modern" legal and political imagination has neglected the importance of the most basic of these levels, namely the level of commonly shared cultural values. In effect, as Montesquieu famously summarized, judges became "no more than the mouth that pronounces the words of the law". This traditional view is still persistent in legal debates but proves to be more and more insufficient, as it does not allow lawyers to take an active part in contemporary political and constitutional debates. Unfortunately, the attempts to overcome it are often far from being satisfactory, as they focus on justifying or criticising allegedly inevitable "politicization" of the judiciary. In effect, both images encourage competition rather than a dialogue, which may in fact hinder understanding and responding to new political processes. In the conclusions of the article, we suggest that the history of European political and legal traditions offers a possibility to go beyond such neutral-political opposition towards a more complicated view, which is at the same time more attuned to unending struggles for and with democracy. ; W artykule wykorzystano potencjał wyobraźni przestrzennej do przedstawienia wyzwań stojących przed sędziami oraz władzą sądowniczą w dzisiejszych czasach, wynikający z intensywnych debat filozoficznych i teoretycznych na temat przyszłości demokracji oraz różnych "demokratycznych innowacji".
