Der Grundrechtecharta, die 2009 zusammen mit dem Vertrag von Lissabon als Primärrecht verbindlich geworden ist, kommt in der Rechtsprechung des EuGH immer größere Bedeutung zu. So lag die Zahl der Entscheidungen, in denen die Charta zitiert wurde, im Jahre 2010 noch bei 27 und stieg bereits im darauffolgenden Jahr auf 42 an. Insbesondere der Anwendungsbereich der Charta, der in Art 51 Abs 1 geregelt ist und hier vor allem die Frage der Bindung der Mitgliedstaaten bieten immer wieder Anlass für Diskussionen. Ziel der vorliegenden Arbeit ist es, die Rechtsprechung und Literatur zur Bindung der Mitgliedstaaten an die Grundrechtecharta systematisch aufzuarbeiten. Zunächst wird die Rechtslage vor Erlassung der Charta erläutert. Sodann ist kurz auf die Entstehungsgeschichte des Art 51 GRC einzugehen. In den darauf folgenden Kapiteln wird die Judikatur und Literatur vor und nach der Grundsatzentscheidung Åkerberg Fransson sowie diese Entscheidung und ihre Kommentierung in der Literatur im Detail dargestellt. Schlussendlich behandelt die Arbeit die Fragen, die nach dem Åkerberg Fransson Urteil und der Judikatur danach nach wie vor offen geblieben sind. ; The Charter of Fundamental Rights, which entered into force in 2009 with the Treaty of Lisbon as EU Primary Law, is constantly growing in significance in the jurisdiction of the European Court of Justice. The number of judgments with regard to the Charter amounted to 27 in 2010 and increased to 42 already in the following year. The scope of the Charter and particularly the obligations of Member States under it give reasons for more and more disagreement. The objective of this thesis is to describe both the jurisdiction and professional literature regarding the Member States obligations under the Charter of Fundamental Rights. First, the legal situation prior to the Charters enter-into-force is being illustrated. Thereafter the origins of the Charter will be briefly discussed. In the following chapters, the thesis depicts the jurisdiction and professional literature before and after the landmark decision Åkerberg Fransson as well as the Åkerberg Fransson judgment itself and its commenting in academic literature. Das Antidiskriminierungsrecht spielt insbesondere im deutschen Arbeitsrecht eine herausragende Rolle. Weitreichende Auswirkungen hat dabei die Europäische Grundrechtecharta.So enthält Art. 21 Abs. 1 der Charta umfassende Diskriminierungsverbote, die seit dem Vertrag von Lissabon rechtlich gleichrangig mit den Europäischen Verträgen sind. Anhand der Rechtsprechung des Europäischen Gerichtshofs und der Unterlagen des Grundrechte-Konvents analysiert Antoinette von Diest die Bindungswirkung der Charta. Sie kommt zu dem Ergebnis, dass diese deutlich weiter reicht als bislang angenommen und grundsätzlich auch Private erfassen kann.Die Autorin untersucht eingehend die in Art. 21 der Charta enthaltenen Diskriminierungsmerkmale und zeigt auf, dass diese nicht nur hinsichtlich des Anwendungsbereichs, sondern auch in inhaltlicher Hinsicht an maßgeblichen Stellen über den im deutschen Recht bislang geltenden Schutz hinausgehen
