This article builds the central idea to determine why a possible second presidential reelection in Colombia would exceed the jurisdictional limits of power reform. We will use as a benchmark theory, the theory of substitution of the Constitution, as a tension from the democratic constitutionalism. Our proposal focuses on three major components, namely: (i) The legal phenomenon of replacing the constitution and its main features in the constitutional justice; (Ii) The referendum as a mechanism for citizen participation and ingenuity of those who support the re-election, and (ii) The relationship of tension between the concept of democracy and the presidential election in Colombia, approached from constitutionalism. This study proposes a critical debate that can build theoretical tools for a reasonable discussion. ; El presente artículo construye la idea central de determinar por qué una posible segunda reelección presidencial en Colombia desbordaría los límites competenciales del poder de reforma. Para ello utilizaremos, como referente teórico, la teoría de la sustitución de la Constitución, como una tensión existente desde el constitucionalismo democrático. Nuestra propuesta gira sobre tres componentes principales, a saber: (i) El fenómeno jurídico de la sustitución de la constitución y sus principales rasgos en la justicia constitucional; (ii) El referéndum como mecanismo de participación ciudadana y sus ingenios reeleccionistas, y (ii) La relación de tensión existente entre el concepto de democracia y la reelección presidencial en Colombia, abordada desde el constitucionalismo. Este estudio propone un debate crítico, que permita construir herramientas teóricas para una discusión razonable.

This paper makes an analytical approach to the concept of State, studying three of the most representative authors, and establishing theoretical connections between them. author considers that to think about a study and analysis of the theory of the State without the accompaniment of the proposed theoretical triad is to deny and undervalue the invaluable contributions of these researchers have made, not only to the science of the State in general, in the same way to philosophy and political science, to the theory and history of State law, and in general to the whole basis of public-constitutional law. ; El trabajo realiza una aproximación analítica al concepto de Estado, estudiando a tres de los autores más representativos, y estableciendo conexiones teóricas entre ellos. El autor del artículo considera que pensar un estudio y análisis de la teoría del Estado sin el acompañamiento de la triada teórica propuesta, es negar y subvalorar los aportes invaluables que estos investigadores han hecho no solo a la ciencia del Estado en general, sino a la filosofía y a la ciencia política, a la teoría e historia del derecho del Estado, y en general a todo el cimiento base del derecho público-constitucional.

The main objective of this article is to demonstrate the scope of the interpretative revolution in the contemporary world as a new rationality of an interpretative nature. As methodological elements for its implementation, we have used the historical method on the basis of a study of its traditional elements, which called into question the so-called scientific rationality that emerged from the 17th and 18th centuries. As a result of this work, we present new ways of understanding law and legal science, which are embedded in the theory of legal systems and models of law application in times of constitutional state in opening the concept of law in the 21st century to new realities and legal contexts. It is concluded that rationality of interpretation is, for the law and other perspectives of knowledge, a valid and necessary interdisciplinary horizon. ; RESUMEN El objetivo principal de este artículo es evidenciar los alcances de la revolución hermenéutica en el mundo contemporáneo como una nueva racionalidad de carácter interpretativo. Como elementos metodológicos para su concreción, tenemos la utilización del método histórico a partir del estudio de sus elementos tradicionales, el cual puso en entredicho la llamada racionalidad científica surgida a partir de los siglos XVII y XVIII. Como resultados de este trabajo presentamos las nuevas formas de comprensión del derecho y la ciencia jurídica, que están inmersas en la teoría de los sistemas jurídicos y de los modelos de aplicación del derecho en tiempos de Estado constitucional en la apertura del concepto de derecho en el siglo XXI a nuevas realidades y contextos jurídicos. Se concluye que la racionalidad hermenéutica es, para el derecho y otras perspectivas del conocimiento, un horizonte de interdisciplinariedad válido y necesario.
