In this paper I want to analyze the process of transition to democracy, particularly in relation to two points: the lack of solution to the problem of autonomous government and the lack of lustration in the judicial system, leaving extremely conservative judges who are now at the top of the Spanish judiciary and who seem to be pushing for a hard response to any attack against the unity of Spain, using an old category of criminal offence, that seemed to have been left out from European criminal justice systems: that of political crimes.

In this paper, the author focuses on treatment that genocide receives from the field of sociology, then he checks the differences of sociological studies with legal regulation contained in Convention on the Prevention and Punishment of Genocide, specifically to groups that are subject to protection in legal definition of genocide.To achieve his purpose, the author develops how the process of production of the Convention was as well the criticism of legal definition of genocide in sociology. The author concludes sociological definitions have limitations, gives primacy to legal concept of genocide and affirms that social groups not protected by the Convention find protection by other rules of International Criminal Law. ; En el siguiente texto, el autor se enfoca en el tratamiento que recibe el genocidio desde el campo de la sociología, para luego comprobar las diferencias de los estudios sociológicos con la regulación legal contenida en la Convención para la Prevención y Sanción del Genocidio, específicamente respecto a los grupos que son objeto de protección en la definición jurídica de genocidio. Para lograr su cometido, el autor desarrolla cómo fue el proceso de producción de la Convención, así como la crítica de la definición legal de genocidio en la sociología. El autor concluye que las definiciones sociológicas presentan limitaciones, otorga primacía al concepto legal de genocidio, y afirma que los grupos sociales no protegidos por la Convención, encuentran protección por otras normas del Derecho Penal Internacional.

El discurso de la justicia transicional es reciente en Colombia. En los procesos de paz de la década del noventa no se hablaba de justicia transicional y no se aplicaban los mecanismos que hoy reconocemos como propios de ese campo. La paz se entendía como mera paz negativa y como una forma de acceder a la participación política. Con la desmovilización de los grupos paramilitares, en el año 2005, el país se enfrentó a un nueva negociación de paz y por tanto a la necesidad de tomar decisiones institucionales que permitieran la superación del pasado. En un primer momento se pensó en acudir a los mecanismos tradicionales de los procesos de paz de Colombia, pero luego el mecanismo finalmente adoptado se enmarcó dentro de un lenguaje de justicia transicional. En este trabajo pretendo dar respuesta a varias preguntas. La pregunta central es ¿cuál es el valor de la verdad judicial dentro de la justicia transicional? Es una pregunta que apunta a establecer una relación entre la verdad del proceso judicial, mucho más formal y ordinaria, y la verdad que se supone debe surgir de la aplicación de los mecanismos de justicia transicional, mucho más informal y extraordinaria. Si bien el paradigma de verdad es el de la Comisión de la Verdad, lo cierto es que la justicia penal cumple un papel central dentro de la justicia transicional y, por tanto, su verdad también es relevante para determinar qué sucedió en el pasado y para superarlo. Al lado de esta pregunta pretendo dar respuesta a dos preguntas más: ¿Cómo contribuye la verdad judicial a la memoria? y ¿cuál es la importancia de la verdad judicial frente a la verdad histórica? ; The discourse of transitional justice in Colombia is recent. Desde la transición a la democracia, muchas novelas y películas se han escrito sobre la guerra civil. Incluso los libros que fueron escritos durante la dictadura pero censurados por el régimen, han visto la luz de nuevo y han sido ampliamente leídos por una población educada y no educada. Pero es el cine el espacio en el que la discusión pública sobre la guerra civil y la dictadura ha eludido las limitaciones impuestas por el pacto del olvido. El cine se ha convertido en un instrumento de memoria, que trae a la luz las violaciones pasadas, las muestra directamente en la esfera pública y llama nuestra atención sobre lo que "realmente" pasó. En este sentido, es más eficaz que los libros y artículos académicos en traer la memoria del olvido, en la dignificación de las víctimas. El cine nos muestra una versión de la historia, una versión no contada hasta ahora. En este artículo quiero introducir la discusión sobre la memoria como parte de los procesos de transición a la democracia y analizaré tres películas que han introducido el debate sobre la guerra civil y la dictadura, a saber: Soldados de Salamina (David Trueba, 2002), Las Trece Rosas (Emilio Martínez-Lázaro, 2007), y Salvador Puig Antich (Manuel Huerga, 2006).

On the characteristics of social movements two lines of theorizing have developed in Europe and the United States. In the literature on social movements in the United States the strategic nature of social movements is highlighted, as they attempt to achieve social change through the foray into the political arena through the development of a political strategy. The appeal of social movements arose initially because they were alternative ways of doing politics, ways that were outside of institutional channels but anyway seeking changes in the space of politics. In this paper I analyze the literatura on social movements and present a characterization of what are called "new social movements". ; Sobre las características de los movimientos sociales se han desarrollado dos líneas de teorización en Europa y Estados Unidos. En la literatura estadounidense se resalta el carácter estratégico de los movimientos sociales, dado que han intentado un cambio social incursionando en el espacio político mediante la elaboración de estrategias públicas. Inicialmente el atractivo de los movimientos consistía en que constituían formas alternativas, ajenas a los canales institucionales, que buscaban cambios en el ámbito de la política. En este texto me ocupo de analizar la literatura sobre los movimientos sociales y presento una caracterización de lo que en ella se denomina "nuevos movimientos sociales".

The indigenous peoples of Colombia have used various forms of resistance to attempt to change their identities and appropriate their lands. Over time the emphasis has shifted from law and legal titles to marches and land occupations to armed resistance and back again to the law. The legal liberalism that emerged with the 1991 Constitution in Colombia led to the demobilization of the indigenous movement of the time as marches and land occupations were abandoned in favor of lawsuits that identified violations of rights. Success in the courts did not result in any change in the government's policies or its model of development. As the focus shifted from the local to the national level, indigenous peoples' problems on the ground remained unresolved. In recent years, however, local organizations have rediscovered old forms of resistance and use the law as just one tool among many for protecting their rights. Why the enthusiasm for peace faded? What are the perspectives for peace in Colombia? How peace came to be understood as the opposite to security? In this paper I want to make sense of the first two questions, leaving for another time the third one. But I would like to say, that peace and security are not opposites, for peace without security is unstable, and security without peace is authoritarian and undemocratic. In the first part of this paper I wish to show a brief history of past peace processes in Colombia in order to highlight the elements that have led to success or failure in the past. In the second part I focus on Andres Pastrana ́s peace process to show how it set the bases for the discredit peace processes currently have and then I analyze how peace became a dirty word in Colombia ́s political conversation and the possibilities of recovering peace as part of public discussion.
