The central argument of this thesis is that the application of antidiscrimination law to the field of housing complements and enriches a right to adequate housing approach in two ways: firstly, it helps to elaborate and expand the rationale and implications of certain components of the right to housing; secondly, it allows us to address human rights concerns that cannot be adequately tackled through the right to housing alone. I reach this conclusion through an analysis of the conceptual and practical implications arising from the application of antidiscrimination norms to the housing context, with a focus on Europe. An enquiry into the philosophical foundations of antidiscrimination law leads me to identify four aims that antidiscrimination norms ought to pursue: eliminating hostility, prejudice, and stigma; respecting cultural diversity and avoiding misrecognition; transforming existing structures; and ensuring a fair distribution of important goods in society. Applying this framework to the field of housing, I find that various antidiscrimination legal concepts can be mobilised to achieve those four aims, among which direct and indirect discrimination, discriminatory harassment, and reasonable accommodation. I also defend the usefulness of incorporating and mobilising socioeconomic disadvantage as a prohibited ground of discrimination to this end. I then build on two case studies, housing segregation, on the one hand, and housing commodification and financialisation, on the other hand, to further demonstrate the contribution of antidiscrimination law to specific housing issues. Finally, I propose several procedural and substantive avenues to achieve diversity-conscious, all-inclusive housing policies, looking in particular at equality duties and housing decommodification policies. Esta comunicación analiza los recientes pronunciamientos del Comité de Derechos Económicos, Sociales y Culturales (Comité DESC) en materia de vivienda y sus posibles efectos en el ordenamiento jurídico español. Se aborda en especial el dictamen del Comité en el caso Ben Djazia et al. y la problemática de los desahucios en España. Tras un resumen analítico de las recientes resoluciones del Comité DESC en este ámbito, tanto en el marco del mecanismo de evaluación periódica de los Estados parte en el Pacto Internacional de Derechos Económicos, Sociales y Culturales como del mecanismo de reclamaciones individuales previsto por el Protocolo Facultativo al Pacto, se evalúan sus posibles efectos desde la perspectiva de su recepción jurisprudencial y legislativa.

Este artículo examina los pronunciamientos del Comité de Derechos Económicos, Sociales y Culturales de Naciones Unidas (Comité DESC) sobre el derecho a la vivienda relativos a España y adoptados en el período 2017–2018, en particular en cuanto a los desalojos forzosos. Destaca, por su importancia y novedad, el dictamen del Comité DESC en el caso Ben Djazia et al. Seguidamente, se exponen y analizan las novedades jurisprudenciales y legislativas estatales en conexión con estos pronunciamientos, con el fin de evaluar si estas respuestas siguen la línea marcada por el Comité DESC e incorporan las garantías que rodean al derecho a una vivienda adecuada en Derecho internacional y europeo de los derechos humanos. ; This article examines the decisions taken by the UN Committee on Economic, Social and Cultural Rights (CESCR) regarding the right to housing in Spain between 2017 and 2018, in particular concerning forced evictions. The Committee's views in the case of Ben Djazia et al. are especially noteworthy. Domestic case law and legislative developments are then presented and analysed, in order to evaluate whether these responses are aligned with the CESCR's interpretation and whether they incorporate the guarantees surrounding the right to adequate housing in international and European human rights law.

This article seeks to contribute to the corporate gender quota debate, reinvigorated by the recent European Commission's Proposal aiming to introduce quotas in boardrooms, by taking some national experiences as a starting point. It will reveal the existence of a plethora of perspectives and introduce a reference to industrial relations, borrowing from corporate governance theory. The article focuses on three selected countries, representing different models of addressing corporate gender imbalance: the United Kingdom, Spain and France.

In the age of the large-scale collection, aggregation, and analysis of personal data ('Big Data'), merchants can generate complex profiles of consumers. Based on those profiles, algorithms can then try and match customers with the highest price they are willing to pay. But this entails the risk that pricing algorithms rely on certain personal characteristics of individuals that are protected under both data protection and anti-discrimination law. For instance, relying on the user's ethnic origin to determine pricing may trigger the special protection foreseen for sensitive personal data and the prohibition of discrimination in access to goods and services. Focusing on European Union law, this article seeks to answer the following question: What protection do data protection law and anti-discrimination law provide for individuals against discriminatory pricing decisions taken by algorithms? Its originality resides in an analysis that combines the approaches of these two disciplines, presenting the commonalities, advantages from an integrated approach, and misalignments currently existing at the intersection of EU data protection and anti-discrimination law.

Building on human rights law and political and legal theory—in particular the right to housing and distributive justice concerns—, the presentation highlights several issues arising from the current model for housing allocation: its excessive reliance on market mechanisms, the false neutrality of these mechanisms, and the neglected role of need and socioeconomic status.
