Die Serie "Finanzierung globaler Entwicklung" analysiert wichtige finanzielle und nicht-finanzielle Maßnahmen zur Realisierung der neuen Ziele nachhaltiger Entwicklung (Sustainable Development Goals – SDGs) und diskutiert Bausteine für einen neuen globalen Rahmen der Entwicklungsfinanzierung. Ausländische Direktinvestitionen (ADI) sind für viele Entwicklungsländer eine wichtige externe Finanzierungsquelle. Den Zugang von Entwicklungsländern zu globalen ADI-Zuflüssen zu verbessern zählt daher zu den Hauptzielen der Staatengemeinschaft, wie auf den Konferenzen der Vereinten Nationen über Entwicklungsfinanzierung 2002 in Monterrey und 2008 in Doha deutlich wurde. Die Schlussdokumente der Konferenzen unterstreichen die Notwendigkeit, ein "stabiles und berechenbares Investitionsklima" zu schaffen. Als Politikinstrumente, die ADI-Zuflüsse effektiv steigern können, werden internationale Investitionsabkommen ( International Investment Agreements – IIA) genannt. Tatsächlich haben viele Entwicklungsländer IIA unterzeichnet, um ADI anzulocken und wirtschaftliche Entwicklung zu fördern. Jedoch wird diese traditionelle Begründung für IIA zunehmend infrage gestellt. Immer mehr politisch Verantwortliche, Wissenschaftler und nichtstaatliche Organisationen argumentieren, IIA hätten insgesamt nicht zu höheren ADI-Zuflüssen geführt. Sie befürchten zudem, dass IIA die Möglichkeiten der Gastländer zur Regulierung von ADI und zur Förderung nachhaltiger Entwicklung zu sehr einschränken. Diese Skepsis war auch tonangebend für den Abschlusstext der Entwicklungsfinanzierungskonferenz in Addis Abeba im Juli. Darin wird betont, dass sich ADI positiv auf Entwicklung auswirken können, aber nur, wenn ausländische Investoren Sozial- und Umweltstandards einhalten und IIA nicht den nationalen Spielraum für eine entwicklungsorientierte Politik einengen. Eine Gesamtbetrachtung der empirischen Belege für die Auswirkungen von IIA auf ADI-Flüsse ergibt, dass diese Zweifel berechtigt sind. Einigen Studien zufolge wirken sich IIA positiv auf ADI aus. Allerdings sind diese Ergebnisse mit Vorsicht zu interpretieren, da die Messung der Wirkungen wie auch alternativer Belege methodisch schwierig ist. Überdies zeigt sich, dass der Vertragsinhalt wichtig ist und nicht alle IIA den gleichen Effekt auf ADI-Flüsse haben. So wirken sich Verträge, die den Marktzugang von Investoren liberalisieren positiv auf ADI aus, besonders wenn sie Teil präferentieller Handels- und Investitionsabkommen ( Preferential Trade and Investment Agreements – PTIA) sind. Die umstrittenen Investor-Staat-Schieds­klauseln ( Investor-State Dispute Settlement – ISDS) dagegen haben keine signifikant positiven Auswirkungen auf ADI. Daher sollten politisch Verantwortliche in Entwicklungsländern, die ausländische Investoren anlocken möchten, das tatsächliche Design von IIA genau im Blick behalten. Die empirischen Belege deuten darauf hin, dass sie einen gewissen Spielraum haben, IIA und nationale Politikziele kompatibler zu gestalten, wenn sie die Investitionsschutzstandards umformulieren. Im Anschluss an die Addis Abeba Konferenz sollte die Staatengemeinschaft Vorschläge entwickeln, wie Entwicklungsländer bei der Reform ihrer IIA unterstützt werden können.

Is China joining this trend towards preferential trade and investment agreements (PTIAs) that go beyond the investment rules found in Chinese bilateral investment treaties (BITs)? In this paper I empirically analyse investment rules incorporated in Chinese PTIAs using China's BIT practice and the international PTIA practice as benchmarks. The empirical analysis is based on a content analysis of Chinese PTIAs and BITs as well as selected partner country PTIAs. In addition to secondary academic sources, I conducted interviews with Chinese officials as well as relevant stakeholders and negotiators of a number of China's partner countries to shed light on the policy process driving the developments of China's PTIA practice. Based on this empirical analysis, I argue that China is pursuing a partially "NAFTA-ized" PTIA policy that is coherent with what China is willing to offer in the context of some of its more recent BITs. I show that innovative treaty language diffuses from its partner country PTIA policies in the process of negotiations towards China's PTIA policy. Accepting the partner countries' model texts as the basis for negotiations, innovative treaty language – including references to the international minimum standard, prohibition of performance requirements, transparency rules and environmental provisions – spreads to Chinese PTIAs. However, China stops short of consenting to partner countries' push towards the inclusion of commitments to liberalise its investment regime. For the Chinese government, PTIAs are not seen as a laboratory to go beyond the narrow focus of its BITs. Quite the opposite, its BIT practice defines the limits of China's PTIA policy.

Aktuell beobachten wir ein Wiederaufleben der Debatte über ein multilaterales Investitionsabkommen (MIA). In der Vergangenheit waren Versuche gescheitert, ein solches Abkommen abzuschließen. 1998 war darüber im Rahmen der Organisation für wirtschaftliche Zusammenarbeit und Entwicklung (OECD) und 2003 während der Doha Development Agenda der Welthandelsorganisation (WTO) verhandelt worden. Die Gründe für das Scheitern lagen zum einen im Widerstand von Schwellen- und Entwicklungsländern an allzu einseitigen, auf den Schutz von ausländischen Investoren ausgerichteten Regelungen, zum anderen an Divergenzen unter den Industrieländern, insbesondere hinsichtlich der Liberalisierung des Marktzugangs. Befürworter führen mehrere Argumente an, die für eine Neuaufnahme von Verhandlungen über ein MIA sprechen: Erstens findet eine fundamentale Verschiebung globaler Investitionsflüsse statt. Unternehmen aus Schwellenländern investieren zunehmend im Ausland und streben einen besseren Schutz ihrer ausländischen Direktinvestitionen (ADI) in Entwicklungs- und Industrieländern an. Die traditionelle Kritik an einem MIA von Seiten einflussreicher Schwellenländer scheint sich infolge der wachsenden Interessenkonvergenz abzuschwächen. Zweitens kommt es auch zwischen den Industrieländern zu einer Annäherung hinsichtlich internationaler Investitionsregeln. Ein Anzeichen sind die 2012 zwischen der EU und den USA verabschiedeten Shared Principles for International Investment , die den Weg zu einer Transatlantic Trade and Investment Partnership ebnen sollen. Mit dieser Annäherung, insbesondere bei Marktzugangsklauseln, scheint ein weiterer Stolperstein auf dem Weg zu einem MIA ausgeräumt. Drittens wird die zunehmende Regionalisierung von Investitionsregeln angeführt, die den Sprung zur nächst höheren, multilateralen Ebene erleichtern kann. Infolge sog. " Mega-Regionals " – wie der Transpacific Partnership zwischen den USA und weiteren zehn Ländern des Pazifikraums, der Regional Comprehensive Economic Partnership zwischen dem Verband Südostasiatischer Nationen (ASEAN) und weiteren sechs Ländern einschließlich Chinas oder der geplanten Transatlantic Trade and Investment Partnership – kann es zu einer Konsolidierung von Investitionsregeln kommen, die Verhandlungen über ein MIA erleichtern würden. Diese aktuellen Trends können in der Tat den Weg zu einem globalen Abkommen ebnen. Allerdings sollte nicht im Vordergrund der internationalen Debatte stehen, ob es möglich ist, ein MIA zu etablieren. Wichtiger ist die Frage, ob die institutionelle Form eines MIA geeignet ist, die drängendsten Herausforderungen im aktuellen Investitionsregime effektiv zu lösen. Dies ist nicht sehr wahrscheinlich, denn ein MIA wird voraussichtlich nicht zu mehr ADI führen, die Interessen der Entwicklungsländer stärker berücksichtigen oder mehr Kohärenz zwischen Investitionsregeln und anderen Politikbereichen herbeiführen. Es ist erfolgversprechender, diese Herausforderungen durch regionale Kooperation anzugehen. Regionale Verhandlungen sollten durch Koordinierungsprozesse auf globaler Ebene ergänzt werden. Die G20 ist der geeignete Initiator für Gespräche über diese systemischen Fragen, die unter Einbeziehung der OECD, der WTO und der Konferenz der Vereinten Nationen für Handel und Entwicklung (UNCTAD) und weiteren Stakeholdern geführt werden sollten.

We currently observe a renaissance of the debate about a multilateral investment agreement (MIA). The last attempts to establish such an agreement failed in 1998 at the Organisation for Economic Co-operation and Development (OECD) and in 2003, as part of the Doha Development Agenda of the World Trade Organization (WTO). The reasons for these failures are both the resistance of emerging countries and developing countries to one-sided policies mainly aimed at protecting international investors, and divergences among industrialised countries, particularly regarding the liberalization of market access regulations. The proponents name several arguments in favour of a resumption of negotiations about an MIA: First, we can now observe a fundamental shift in global investment flows. Companies from emerging countries are increasingly investing abroad and aim at a better protection of their foreign direct investment (FDI) in developing and industrialised countries. The traditional criticism put forward by influential, emerging countries against an MIA appears to be weakening as the result of a growing convergence of interests. Secondly, among industrialised countries themselves there is a growing consensus regarding international investment rules. One sign of this are the Shared Principles for Inter national Investment , adopted in 2012 by the EU and the U.S.A., whose purpose is to smooth the way for a Transatlantic Trade and Investment Partnership . With this gradual convergence, in particular regarding the inclusion of market access provisions, a further stumbling block along the way to an MIA appears to have been done away with. Thirdly, the increasing regionalisation of investment rulemaking is advanced as an argument which can facilitate the leap to the next-higher, multilateral level. As a result of socalled Mega-Regionals - like the Transpacific Partnership between the U.S.A. and 10 other countries in the Pacific Region, the Regional Comprehensive Economic Partnership between the Association of Southeast Asian Nations (ASEAN) and six other countries, including China or the planned Transatlantic Trade and Investment Partnership - it is possible that a consolidation of investment rules will arise which would simplify the negotiations about an MIA. These current trends can in fact help to smooth the path to a global accord. However, the main question driving the international debate should not be whether it is possible to establish an MIA. What is more important is the question whether the institutional form of an MIA is suitable for effectively solving the most pressing challenges in the current investment regime. This is not very likely, since an MIA is unlikely to lead to significantly more FDI flows or to give stronger consideration to the interests of the developing countries. An MIA will most likely also not lead to greater coherency between the investment rules and other policy areas. It is more promising to tackle these challenges in the context of regional co-operation, since this permits better accommodation of the treaty contents to the specific needs of the countries involved. Negotiations at the regional level should be supplemented by co-ordination efforts on the global level. The G-20 is the appropriate orchestrator for talks about these systemic questions, talks which in turn should be carried on with the inclusion of the OECD, WTO, and the United Nations Conference for Trade and Development (UNCTAD) and other stakeholders.

The implementation of the 2030 Agenda for Sustainable Development requires enormous global investment. In developing countries alone, its realisation requires investment of $ 4 trillion a year (UNCTAD, 2014). Since the public sector in developing countries is often unable to mobilise sufficient domestic resources, the private sector is needed to help fill this gap. One of the key sources is foreign direct investment (FDI), which not only brings capital into developing countries but also advanced technologies and managerial know-how. It is critical that governments have policies in place to attract FDI, and to harness its advantages by enhancing its contribution to sustainable development. This can be done by establishing linkages between foreign and domestic firms, improving the absorptive capacity of local businesses, and strengthening governance capacities in order to improve environmental and social conditions. Since 2017, a group of emerging and developing countries has been driving discussions at the World Trade Organization (WTO) on the establishment of an international investment facilitation framework (IFF), which should help to increase FDI flows. Investment facilitation covers a wide range of areas, all with a focus on encouraging investment to flow efficiently and for the greatest benefit of host countries. In the light of the 2030 Agenda, a focus on the attraction of more FDI is necessary but not sufficient; it is also important to focus on the qualitative contribution of FDI to economic growth in host countries that is socially just and environmentally friendly. Many developing countries would benefit from attracting more FDI to support their sustainable development, but they remain outside the structured discussions at the WTO. Often, they fear a loss of policy space to pursue domestic developmental strategies. Our research shows that developing countries have implemented fewer investment facilitation measures than have developed countries, and would thus face higher implementation costs in order to comply with an IFF. Furthermore, in light of the non-reciprocal nature of global investment flows, although developing countries would benefit from their own investment facilitation reforms, they would not benefit equally from those of their negotiation partners. An IFF can make four key contributions to sustainable development: it can help attract and retain FDI, enhance the quality of FDI in light of national strategies, build domestic institutions, and enhance international cooperation. In order to realise this potential, we make six recommendations: 1. Bridge the implementation gap by providing capacity building. 2. Strengthen developing countries' negotiation capacities. 3. Respect the policy space of developing countries. 4. Focus special and differential treatment on longer implementation periods. 5. Include a commitment by home countries to support their investors' responsible-business conduct. 6. Establish international cooperation mechanisms and increase inclusivity by supporting multi-stakeholder processes.

Since the first meeting of the G20 at the leaders' level in Washington in November 2008, trade has been an integral part of their agenda. This first meeting took place at the peak of the global financial and economic crisis, which led to a strong contraction of world trade. Remembering the global economic crisis after 1929 and the following wave of protectionist measures, the G20 countries made the commitment to not erect new trade and investment barriers. In addition, the verbal commitment to the conclusion of the Doha Development Agenda – the current round of multilateral negotiations under the auspices of the World Trade Organization (WTO) – has been part of the standard repertoire of G20 summit declarations. Yet, since the last ministerial meeting of the WTO in Nairobi in December 2015, the future of the Doha Round is more uncertain than ever before. Important member states, notably the United States, declared themselves in favour of terminating the Doha Round, whereas many emerging and developing countries insist on its continuation. Dissatisfied with the slow progress of the Doha Round, the major trading powers – first of all the United States and the European Union (EU) – are increasingly focussing on negotiating bilateral or regional trade agreements. Agreements such as the Trans-Pacific Partnership (TPP), which was signed on 4 February 2016 by the United States, Japan and 10 other Pacific countries, and the Transatlantic Trade and Investment Partnership (TTIP), which is currently under negotiation between the United States and the EU, cover large shares of global trade and investment flows and aim at regulating issues that go beyond the elimination of tariffs, such as investment, standards and the environment. At the same time, the main trading powers are promoting so-called plurilateral agreements that focus on specific topics. The most prominent example is the Trade in Services Agreement (TiSA), which is negotiated outside the WTO. We argue that the role of the WTO as the central organisation for the governance of world trade is weakened by this wave of mega-regional and plurilateral trade deals. Until now, reforms of the world trading system have only played a subordinate role at the G20 summits. The summit declarations contain only vaguely drafted commitments to strengthen the multilateral trading system, or commitments that bilateral, regional and plurilateral trade agreements should be complementary and in conformity with the rules of the WTO. We argue that the G20 should assume a more proactive role with regard to the future of the WTO and the reform of the world trading system. Such a reform is needed in light of the growing fragmentation of the system. At the same time, the 2030 Agenda for Sustainable Development of the United Nations calls for sustainability to be the core principle of global cooperation, including in the context of international trade. Among other things, the 2030 Agenda calls for "a universal, rules-based, open, non-discriminatory and equitable multilateral trading system under the World Trade Organization". Bridging the gap between the realities of the international trading system and the aspirations of the 2030 Agenda is a formidable challenge that cannot be tackled effectively either in the context of the WTO or the UN and the 2030 Agenda alone. The G20 is a suitable forum to bridge that gap.

Seit dem ersten Treffen der G20 auf Ebene der Staats- und Regierungschefs im November 2008 hat das Thema internationaler Handel einen festen Platz auf der Tagesordnung der G20. Dieses erste Treffen fand auf dem Höhepunkt der weltweiten Wirtschafts- und Finanzkrise statt, die zu einem starken Einbruch des Welthandels führte. Aufgrund der Erfahrungen aus der Weltwirtschaftskrise nach 1929 und den in der Folge eingeführten protektionistischen Maßnahmen verpflichteten sich die G20, keine neuen Handels- und Investitionsbarrieren zu errichten. Auch die Zusage, die Doha-Runde der multilateralen Verhandlungen unter der Schirmherrschaft der Welthandelsorganisation (WTO) abzuschließen, gehört zum Standardrepertoire der G20-Gipfelerklärungen. Dennoch ist die Zukunft der Doha-Runde seit dem letzten Ministertreffen der WTO in Nairobi im Dezember 2015 unsicherer als je zuvor. Wichtige Mitgliedsstaaten, insbesondere die Vereinigten Staaten, befürworten den Abschluss der Doha-Runde, während zahlreiche Schwellen- und Entwicklungsländer auf ihrer Fortführung bestehen. Die mit dem langsamen Fortschritt der Doha-Runde unzufriedenen großen Handelsmächte – allen voran die USA und die EU – konzentrieren sich immer stärker darauf, bilaterale oder regionale Handelsabkommen abzuschließen. Abkommen wie die im Februar 2016 von den USA, Japan und zehn weiteren Pazifikstaaten beschlossene Transpazifische Partnerschaft (TPP) oder das Transatlanische Freihandelsabkommen (TTIP), über das sich EU und USA momentan in Verhandlungen befinden, decken einen Großteil der weltweiten Handels- und Investitionsströme ab und haben zum Ziel, Themen wie Investitionen, Wettbewerb und Standards zu regeln, die über die Abschaffung von Zöllen hinausgehen. Gleichzeitig werben die großen Handelsmächte für sogenannte plurilaterale Vereinbarungen über bestimmte Themen. Prominentestes Beispiel dafür ist das Abkommen über den Handel mit Dienstleistungen (TiSA), das außerhalb der WTO verhandelt wird. Die Rolle der WTO als zentrales Steuerungsorgan für den Welthandel wird durch diese großen regionalen und plurilateralen Handelsabkommen geschwächt. Bisher hat die Reform des Welthandelssystems bei den G20-Gipfeln nur eine untergeordnete Rolle gespielt. Die Gipfelerklärungen beinhalten lediglich vage formulierte Zusagen, das multilaterale Handelssystem zu stärken. Die G20 sollten bezüglich der Zukunft der WTO und der Reform des Welthandelssystems eine aktivere Rolle spielen. Angesichts der zunehmenden Fragmentierung des Systems ist eine solche Reform notwendig. Gleichzeitig wollen die Vereinten Nationen (UN) die Nachhaltigkeit mit der Agenda 2030 für nachhaltige Entwicklung zum Kernprinzip der weltweiten Zusammenarbeit und damit auch des internationalen Handels machen. Unter anderem wird in der Agenda 2030 ein universelles, regelbasiertes, offenes und diskriminierungsfreies multilaterales Handelssystem gefordert. Den Graben zwischen dem bestehenden internationalen Handelssystem und den in der Agenda 2030 aufgeführten Zielen zu überwinden, ist eine enorme Herausforderung, die weder die WTO noch die UN oder die Agenda 2030 alleine wirksam meistern kann. Die G20 dagegen sind ein geeignetes Forum, um genau dies zu schaffen.
