Abstract
Theatre and law are not so different. Generally, researchers work on the art of theatre, the rhetoric of the actors, or the dramaturgy built from law cases or from the questions that the law does not completely resolve. Trials, tragedies, even comedies are close: everybody can see the interpenetration of them on stage and in the courts. We know that, and we know that the dramas are made with/from/of law, we know that the art the actors are developing is not so far from the art of the lawyers, and conversely. In this paper, I would like to have a look at the action of the audience, at the session itself and at the way the spectators are here to evaluate and judge not only the dramatic action, not only the art of the actors, not only the text of the author, but also the other spectators, and themselves too. In particular, I will focus on the "common judgment" of the audience and on its judicial, aesthetic and social relationship. The spectators have been undisciplined, noisy, unruled, during such a long period that theatre still retains some prints of this behaviour, even if nowadays, the social and aesthetic rule is to be silent. But uncertainty, inattention, distraction, contradiction, heterogeneity are the notions which characterise the session, and the judgments of the spectators still depend on them. So, what was and what is the voice of the audience? And with what sort of voice do spectators give their judgments?

Partant d'une pratique d'historien du théâtre, l'auteur de cet article souhaite montrer comment la notion de performance , au sens le plus large du terme, peut être un moyen pour étendre et approfondir l'analyse des événements théâtraux et spectaculaires, présents et passés, en les considérant à partir de l'unité de la séance. Ce premier pas permettra de mieux comprendre l'hétérogénéité des événements à travers celle des spectateurs, sans perdre de vue que la performance théâtrale est aussi une proposition artistique faite aux spectateurs et qu'elle vient d'une décision esthétique endossée par des artistes . Le second pas sera de savoir comment le phénomène théâtral peut être à la fois un jeu d'oppositions et de contradictions, un lieu de performance sociale et esthétique, mais aussi un espace dynamique de comparution de tous devant tous, où tous les individus présents jugent et se jugent.

Résumé Cet article se propose de considérer les façons dont le droit et son exercice sont ancrés dans la dramaturgie et dans la narrativité des textes. La question n'est pas de montrer que la littérature est le miroir de son temps ou du droit, mais de saisir les façons dont elle intervient non seulement dans les processus sociaux, politiques et économiques, mais aussi à l'intérieur du champ juridique. Ce faisant, elle inscrit une réflexion sur le phénomène social judiciaire et sur ses pratiques, et s'interroge sur les règles et les fictions du droit, autrement dit sur la matière juridique elle-même, au point que les oeuvres de fiction, théâtrales en particulier, en viennent à instaurer une réflexion sur le droit comme objet de pensée. Et du point de vue du dispositif théâtral, on proposera, afin de définir cette mise en question(s) et en jugement(s) du spectacle par un seul individuspectateur et simultanément un groupe d'individus-spectateurs, une notion : la comparution théâtrale.

This article considers the means by which the law and its practice are anchored in dramaturgy and in the narrative of textual sources. The article's object is not to demonstrate that literature is the mirror of its time or of the law, but to seize the methods by which it intervenes not only in social, political, and economic processes, but also into the interior of the judicial field. In so doing, the article offers a reflection on the phenomenon of social justice and on its practices, inquiring into the rules of legal fiction, as well as the judicial material itself, from the perspective of works of fiction and theatre in particular, suggesting a reflection of the law as an object of thought. Additionally, from the point of view of theatrical mechanisms, the article proposes the notion of a "theatrical court appearance" as a means of defining question(s) and judgment(s) of spectacle by both single individual-spectators and groups of individual-spectators. Abstract
As a practice and experience, ta'zieh lies at the crossroads between ritual and performance, collective lament and recollection, literature, and folklore. Focusing on the experience of the spectator, this paper discusses ta'zieh's liminal status and diverse functions in Iran today. This study is based on observations gathered during fieldwork in the fall of 2017 in Tehran (Grand Bazaar), Isfahan (Falāvarjān), and Kashan (Nushābād). By way of comparison, we further reflect on a video installation by Abbas Kiarostami presented at the Centre Georges Pompidou in Paris in 2003, which challenges common assumptions about the aesthetic and religious effectiveness of ta'zieh. The contrast allows us to elucidate how, by renovating ancient narrative forms, contemporary Iranian performing arts partake in the shaping of individual affects as well as communal emotions.
