The increasing use of measures of economic coercion by China has caused its trading partners to review their close trade ties with that country as well as their ability to resist such pressure. In December 2022, the European Union (EU) requested that the World Trade Organization (WTO) adjudicate its dispute with China regarding restrictive trade measures China had imposed on Lithuania in response to its foreign policy actions that were not to China's liking. The EU also drafted new legislation – the Regulation of the European Parliament and of the Council on the Protection of the Union and its Member States from Economic Coercion by Third Countries – to deter third countries from applying coercive measures that target the EU and its Member States. This paper considers the new instrument in the context of the EU's evolving 'economic de-risking' strategy on China and a wide range of measures aimed at protecting the common market from the unfair behaviour of China and other states and reducing the EU vulnerability vis-à-vis economic and security threats. The EU's ability to deter states from applying coercive measures against it hinges upon its ability to strengthen its market power and to use the new instrument when necessary.

AbstractIn 2021, the United States challenged Canadian dairy import tariff rate quotas (TRQs) before the first state-to-state arbitration panel under Chapter 31 of the Canada-United States-Mexico Agreement (CUSMA). The panel held that the method of allocation of TRQs limited the US dairy industry's access to the Canadian market and therefore violated CUSMA provisions. However, the panel also acknowledged that the Canadian supply management system for dairy products is a unique regulatory framework for production control, pricing mechanisms, and import control. This article explores the case as a test of the functioning of the improved CUSMA dispute settlement process and of Canada's ability to protect its supply management system for dairy products from renewed pressure coming from its most important trade partner.

Canada and the European Union (EU) are negotiating an ambitious Comprehensive Economic and Trade Agreement (CETA). While the content of the agreement has not yet been officially disclosed by its negotiators, the general public and the business community are already concerned about the scope and effect of CETA on the two economies and their societies. This article deals with CETA's transparency provisions. It claims that, whereas CETA has not yet utilized external transparency to ensure support for the negotiations, it does have the potential for greater regulatory transparency in technical barriers to trade (TBT)- and sanitary and phytosanitary (SPS)-related matters than that found not only in the existing World Trade Organization (WTO) agreements but also in free trade agreements (FTAs) the two parties previously negotiated with third countries.

SummaryThis comment revisits the debate on the reasons for compliance, or lack thereof, with the regulations and administrative rules that govern the current international trade regime. The research on which it is based is the first part of the five-year project on Cross-Cultural Dispute Resolution funded by the Major Collaborative Research Initiative program of the Social Sciences and Humanities Research Council of Canada. It focuses on the cultural components of non-compliance based on analysis of the legislative internalization of World Trade Organization norms and case law in China, Canada, and Japan on the one hand and on individual perceptions of the international trade environment on the other. The main hypotheses are that the sharing of international practice rules does not necessarily indicate consensus on the normative order underlying those rules and that the behaviour of those who are involved in the interpretation and application of international rules is informed by (1) their perception of the purpose, content, and effect of nonlocal rules and their underlying norms; (2) those rules' and norms' complementarity with local rules and norms; and (3) the degree of legitimacy accorded by local communities to the processes of interpretation and application.

Providing an analysis of global regulation and the impact of international organizations on domestic laws, this collection grew out of a central objective to explore methods of domestic engagement with international trade and human rights norms, and the inherent difficulties in establishing balanced links between these two international law regimes. The common thread of the papers in this collection is a focus on the application of socio-legal normative paradigms in building knowledge and policy support for coordinating local performance with international trade and human rights standards in ways that are mutually sustaining.--
