W opracowaniu poddano analizie jeden z rodzajów definicji legalnych, które mają coraz częstsze zastosowanie w przepisach prawa podatkowego. Chodzi o definicje legalne ograniczające nieostrość przepisów prawa podatkowego. Kluczowe w konstruowaniu tych definicji staje się zasto-sowanie determinantu ograniczenia nieostrości. Nieuwzględnienie tego determinantu przez ustawo-dawcę podatkowego może powodować negatywne skutki w postaci wyboru niewłaściwego obszaru podlegającego definiowaniu czy w sensie błędów popełnionych już w samym formułowaniu danej definicji legalnej. Dlatego też w artykule wskazano sposób rozumienia determinantu ograniczenia nieostrości. W celu ukazania praktycznego zastosowania tego determinantu odniesiono się do roz-wiązań przyjętych w klauzuli przeciwko unikaniu opodatkowania.
One of the key legal definitions introduced into tax law, i.e. the definition of "an organised part of an enterprise", was analysed in the study. It is an example of a definition under which a tax legislator expresses the tax consequences of business trading. According to the author, this legislative measure may be qualified as a legal definition limiting the imprecision in the provisions of tax law. The fulfilment of certain determinants becomes important for the construction of this definition, on the basis of which it should be constructed. The study specifies these determinants and shows that the tax legislator does not always use them when formulating the analysed definition. Therefore, in the article the author indicates solutions aimed at implementing these determinants. ; W opracowaniu analizie poddano jedną z kluczowych definicji legalnych wprowadzonych do prawa podatkowego, tj. definicję zorganizowanej części przedsiębiorstwa. Istotne dla konstrukcji tej definicji staje się spełnienie pewnych determinantów, w oparciu o które powinna być ona zbudowana. W opracowaniu określono te determinanty oraz wykazano, że ustawodawca podatkowy nie zawsze korzysta z nich, formułując analizowaną definicję. Ponadto autor wskazał rozwiązania mające na celu realizację tych determinantów.
Searching for normative solutions that at least to a certain extent limit the dynamics of changes in tax law regulations is one of the important tasks of the tax law doctrine. This trend includes the use by the legislator of both the legislative technique ensuring the flexibility of tax law regulations, as well as of legal definitions. However, the application of one of the specific normative solutions may be assessed as a combination of these two means of legislative technique. What is meant are legal definitions that serve to limit the area of vagueness. While these definitions are used by the tax legislator, their normative form and placement in legislation and legal regulations do not lead yield the results that could be expected given the determinants of their formation. Therefore, the article examines in detail the determinants of establishment of legal definitions aimed at limiting the areas of inaccuracy. At the same time, these determinants are referred to legal definitions aimed at limiting the said areas, which have been used by the legislator in the regulations specifying a legal definition of an artificial action. The structure of the anti-avoidance provisions is based on such definitions. Ustawodawca podatkowy posługuje się tymi definicjami, jednakże ich kształt normatywny, a także umiejscowienie w przepisach oraz instytucji prawnej nie prowadzą do takich rezultatów, jakie można byłoby oczekiwać, biorąc pod uwagę determinanty ich tworzenia. Stąd też w artykule poddano szczegółowym badaniom determinanty tworzenia definicji legalnych służących ograniczeniu obszaru nieostrości. Jednocześnie odniesiono je do definicji legalnych służących ograniczeniu nieostrości, które normodawca użył w przepisach określających definicję legalną sztucznego sposobu działania. Konstrukcja przepisów dotyczących klauzuli przeciwko unikaniu opodatkowania oparta jest na tego rodzaju definicjach. Stąd też zbadanie tych unormowań z punktu widzenia postulowanych determinantów jest istotne, biorąc pod uwagę nie tylko specyfikę klauzuli przeciwko unikaniu opodatkowania, ale także sytuację podatnika.

Jednocześnie odniesiono je do definicji legalnych służących ograniczeniu nieostrości, które normodawca użył w przepisach określających definicję legalną sztucznego sposobu działania. Konstrukcja przepisów dotyczących klauzuli przeciwko unikaniu opodatkowania oparta jest na tego rodzaju definicjach. Stąd też zbadanie tych unormowań z punktu widzenia postulowanych determinantów jest istotne, biorąc pod uwagę nie tylko specyfikę klauzuli przeciwko unikaniu opodatkowania, ale także sytuację podatnika.
