Abstract:The antiquities catalogues of major auction houses comprise an accessible long-term source of information about the auction market in antiquities and the market in antiquities more generally. The information contained in these catalogues has been used to investigate the nature and scale of the market and to assess the impact of legal and normative measures of market control. But, by way of two case studies, referencing Iraqi and Cambodian material sold at the New York branch of Sotheby's, this article argues that, while auction catalogues do provide an invaluable source of information for investigating the antiquities market, it can be misleading. Changing material or monetary statistics might reflect commercial factors unrelated to market control. For more reliable research, long-term auction data should be contextualized with information available from other sources.

Abstract:Cultural property protection policy as implemented in Syria since 2011 is structured around standards and practices enshrined within the 1954 Hague Convention for the Protection of Cultural Property in the Event of Armed Conflict (including its First and Second Protocols) and the 1970 UNESCO Convention on the Means of Prohibiting and Preventing the Illicit Import, Export and Transfer of Ownership of Cultural Property. Policy emphasis is on thein situprotection of cultural sites and the recovery and return of stolen or looted cultural objects. But policy initiatives have very obviously failed to stop the plunder and illegal trade of cultural objects in Syria, as they have failed before for neighboring countries. This paper describes why policy initiatives aimed at site protection and object recovery have failed and how policy might be improved by a market reduction approach aimed at subduing demand.

The Istanbul Initiative was established in 2003 in response to
concerns raised by the continuing episodes of cultural destruction that
have accompanied armed conflicts in Cambodia, Lebanon, Afghanistan, the
former Yugoslavia, and Iraq. The Initiative is comprised of Turkish
academics, lawyers, and media professionals who aim to raise international
awareness of the destruction of cultural heritage during wartime. Their
first action was to organize the symposium A Future for Our Past
in Istanbul from June 24 to 26 2004. The immediate impetus for the
symposium was provided by the large-scale looting of museums, libraries,
and archaeological sites that followed the Coalition invasion of Iraq in
April 2003.

The world's archaeological heritage is under serious threat from illegal and destructive excavations that aim to recover antiquities for sale on the international market. These antiquities are sold without provenance, so that their true nature is hard to discern, and many are ultimately acquired by major museums in Europe and North America. The adoption in 1970 by UNESCO of the Convention on the Means of Prohibiting and Preventing the Illicit Import, Export and Transfer of Ownership of Cultural Property created a new ethical environment in which museums and their representative associations adopted policies that were designed to guard against the acquisition of "unprovenanced," and therefore most probably looted, antiquities. Unfortunately, over the past decade, U.S. museum associations have been advocating a more relaxed disposition, and the broader archaeological and anthropological communities are in significant measure responsible since they have met this unwelcome development largely in silence.

The exploitation of archaeological sites for commercial gain is a serious problem worldwide. In peace and during wartime archaeological sites and cultural institutions, both on land and underwater, are attacked and their contents robbed for sale on an international 'antiquities' market. Objects are excavated without record, smuggled across borders and sold for exorbitant prices in the salesrooms of Europe and North America. In some countries this looting has now reached such a scale as to threaten the very survival of their archaeological and cultural heritage. This volume highlights the deleterious effects of the trade on cultural heritage, but in particular it focuses upon questions of legal and local responses: How can people become involved in the preservation of their past and what, in economic terms, are the costs and benefits? Are international conventions or export restrictions effective in diminishing the volume of the trade and the scale of its associated destruction?.
