The Role of the Senate in the Legislative Process

In most countries with a bicameral system, the Upper House plays a restrained role with regard to the legislature. In this contribution, the position of the Upper Houses in the Netherlands, France, the United Kingdom and Germany is characterised in terms of rivalry and assistance. 'Rivalry' is to be taken to mean here the (im)possibility of the Upper House to wholly or partially force through its own political policy desires. 'Assistance' in parliamentary legislative practice implies first and foremost correction as to lawfulness, in particular improvements of a legal-technical nature. Suggestions for 'enhancing' the effectiveness and social desirability of legislative texts, as well as their politico-bicameral and non-controversial nature are also placed under the heading 'assistance'. Only the position of the German Bundesrat can be seen as providing a rival to the Lower Chamber. Neither the French Sénat, the House of Lords nor the Dutch Eerste Kamer provide (political) rivalry. The Sénat and the House of Lords do, however, have a strong assisting position: these Upper Houses play a significant role by using their right of amendment. The Dutch Upper House has a energetic position 'on paper', but, compared to the Upper Houses in France, the United Kingdom and Germany, its position is rather weak. Assistance in the area of co-legislation is virtually impossible.

One of the most salient innovations provided for by the Treaty of Lisbon has been the creation of a "semi-permanent" or "stable" Presidency of the European Council. This paper offers a legal appraisal of the Union's system of government in the post-Lisbon setting, focused on the role and powers of the refurbished European Council Presidency. It combines an unravelling of the black-letter competences with some extensive analysis of their exercise in practice, aiming to scrutinize the internal dynamics of the office, as well as its interaction with other actors and bodies. It begins by sketching the general background to the new office, taking a mildly unorthodox view of its origin, coming into being and popular terminology. This is followed by an analysis of the modalities for the President's election and dismissal, and an investigation of how the appointment procedure was put into operation for the first time. It then proceeds to gauge his competences, sketching their formal purview as well as (the limits to) their actual exercise. Finally, it subjects the inter-institutional linkages to review, in an attempt to assess how other actors measure up to the new office. In combination, these reflections provide the reader with a picture of the President's position within the wider constitutional framework.

"Deze bundel wetteksten bevat commentaren op zowel de Grondwet als het Statuut voor het Koninkrijk der Nederlanden naar de stand van 15 augustus 2018. De wetteksten worden inzichtelijk gemaakt middels een beschrijving en uitleg van de bepalingen naar geldend recht. Grondwet en Statuut zijn onlosmakelijk met elkaar verbonden. Wanneer u gedegen inzicht wilt krijgen in deze onderwerpen, dan maakt Tekst & Commentaar Grondwet en Statuut het u gemakkelijk met de complete actuele wettekst van Grondwet en Statuut van het Koninkrijk der Nederlanden. De wetsartikelen zijn voorzien van een beknopt, helder commentaar - in een vaste opbouw. Het Statuut voor het Koninkrijk der Nederlanden regelt de rechtsorde van het Koninkrijk, waarin Nederland een staatsrechtelijk samenwerkingsverband heeft met de Caribische landen in het Koninkrijk. De Grondwet is te beschouwen als de formele constitutie of #basiswet# van Nederland, maar regelt deels ook het constitutionele recht van het Koninkrijk. In het commentaar vindt u verwijzingen naar relevante bepalingen uit het EVRM en het EU-recht, aangevuld met enige belangrijke jurisprudentie van het EHRM. Zo beschikt u over directe aanknopingspunten voor verder verdieping. De bewerking heeft als uitgangspunt gehad het commentaar op de Grondwet en Statuut zoveel mogelijk op dezelfde wijze vorm te geven. De auteurs hebben het commentaar bijgewerkt naar de stand per 15 augustus 2018"
