Nearly three decades after the passage of the Americans with Disabilities Act (ADA), people with disabilities continue to be significantly underrepresented in the American Labor force. This loss of talent to U.S. organizations and restriction of opportunities for millions of workers have broader implications for civil society. People denied access to the workforce are limited in their ability to contribute to the economy and to their communities, heightening their reliance on public support systems and reducing the number of people participating in community life. This LERA volume focuses on the employment of individuals with disabilities. Its purpose is to review the current employment situation for Americans with disabilities, place it in the context of the U.S. regulatory system, describe current issues, identify ways that employers are approaching possible remediation of these issues, and identify emerging concerns and opportunities. A multi-disciplinary team of researchers and practitioners provide a broad-based overview of related issues, approaches, and opportunities. This volume will be useful to a wide array of professionals, including labor and employment relations attorneys and specialists; human resource, diversity and inclusion, and equal employment opportunity professionals; as well as organizational leaders, managers, and supervisors who are seeking to improve employment opportunities for individuals with disabilities both here and abroad

AbstractThe aging workforce is likely to result in increasing numbers of workers with disabilities. The US Census Bureau projects that the 45- to 54- and 55- to 64-year-old population in the United States will grow by nearly 44.2 million (17%) and 35 million (39%) in the next 10 years (US Census Bureau, 2004). By the year 2010, this group will account for nearly half (44%) of the working age population (20–64), and the number of people with disabilities between the ages of 50 and 65 will almost double (Weathers, 2006). Disability management and accommodation policies and practices readily lend themselves to addressing the challenges employers will face with an aging workforce, and the increasing prevalence of disability that these demographics bring. Proactive education about ways to maximise the productivity of an aging workforce, effective case management, and workplace accommodation can significantly contribute to maximising aging worker retention.

Work is an important part of life, providing both economic security and a forum to contribute one's talents and skills to society, thereby anchoring the individual in a social role. However, access to work is not equally available to people with disabilities globally. Regulatory environments that prohibit discrimination and support vocational training and educational opportunities constitute a critical first step toward economic independence. However, they have not proven sufficient in themselves. In this article, we aim to infuse deeper consideration of employer practice and demand-side policy reforms into global policy discussions of the right to work for people with disabilities. We begin by documenting the employment and economic disparities existing for people with disabilities globally, followed by a description of the international, regional, and local regulatory contexts aiming to improve labor market outcomes for people with disabilities. Next, we examine how policies can leverage employer interests to further address inequalities. We discuss employer policies and practices demonstrated in the research to facilitate recruitment, hiring, career development, retention, and meaningful workplace inclusion. The goal of the article is to synthesize existing international literature on employment rights for people with disabilities with the employer perspective.

In 2014, the health and productivity team of the disability insurance provider, Unum, conducted a mixed methods study that included qualitative interviews with internal mental health disability claims professionals, and external interviews with employers. Quantitative data of 15 employers were analysed to identify descriptive statistics involving mental health short-term disability (STD) claims. Workplace factors were examined to understand best practices among companies, related to mental health STD, to identify work environments that may increase or decrease mental health disabilities. Quantitative data found workers aged 40 to 49 had the highest rates of mental health STD claims and workers aged 50 to 59 had the longest duration of absence. Anxiety and depression were the main reasons for mental health absences from work. Results from the qualitative interviews showed a supportive work culture (i.e., work–life balance, good benefits, successful wellness programs) may lead to higher STD claim rates, demonstrating workers in these environments may feel more comfortable disclosing and seeking help for mental health disabilities. Conclusions from this study indicate that although presenteeism rates for mental health are high and impact employers financially, having higher STD claim rates may be more cost effective than having employees with mental health conditions remain at work instead of filing STD claims, seeking treatment and returning to productive employment. Employee age can impact rate and duration of mental health STD claims, meaning employers should implement workplace practices that support overall mental health of employees.

The Internet improves access to employment and community for many people. However, there is growing concern that many Web sites are inaccessible to people with certain disabilities. This article examines the impact on people with disabilities of online human resources processes used for employee recruitment, benefits, and training. In 2002, Cornell University staff reviewed the accessibility of 10 Job boards and 31 corporate e-recruiting Web sites. Human resource (HR) professionals are well positioned to report on key issues regarding these processes. A survey of 433 HR representatives was conducted regarding their organizations' use of information and Web technology in HR processes; knowledge of computer/Web barriers to employees with disabilities; and familiarity with assistive technology and resources. The authors summarize current literature and legislation relevant to Web accessibility, and discuss implications of their findings for businesses and people with disabilities in the workplace.

AbstractIt is 20 years since the passage of the Americans With Disabilities Act, yet employment and economic inequities continue for people with disabilities. The purpose of this article is to inform and encourage disability management leading practices to contribute toward reducing these disparities. The approach is an examination of where in the employment process applicants and incumbent employees perceive employment disability discrimination, leading to the filing of charges against an employer. Employment disability discrimination claims filed by individuals over 15 years (1993–2007) with the United States (US) Equal Employment Opportunity Commission or state and local Fair Employment Practice Agencies are studied. The authors analyse employment discrimination charges by year, basis (i.e., protected class characteristics, such as disability, age, or race), issue (i.e., actions of the employer, such as discharge, hiring, or harassment), employer characteristics (i.e, size of business and industry sector), and joint filings under Title VII of the Civil Rights Act (gender, race/ethnicity, and religious discrimination) and the Age Discrimination in Employment Act (ADEA). Special attention is paid to where in the employment process people with specific impairments are perceiving discrimination. Implications of these research findings for the practice and administration of disability management and employer policies are discussed.

Neurodiversity in the Workplace presents a timely and needed perspective on the role and responsibility of employers, and those working to increase the effectiveness of workplace practices, to examine the many ways we preclude large segments of the population from employment and how we can create opportunities for building a truly inclusive work environment
