Resumen¿En qué medida los derechos laborales promueven las libertades en relación con el trabajo? El autor define metodológicamente tres: libertad en el trabajo, a través del trabajo y frente al trabajo. No obstante enfoques de derecho laboral como el de no explotación, no dominación o de las capacidades, los derechos laborales fundamentales siguen pensados para proteger a trabajadores y trabajadoras en el mercado laboral, no para ampliar sus libertades, y aún menos la libertad frente al trabajo. El autor concluye que para ampliar las libertades en, a través y frente al trabajo no se necesitan menos derechos laborales fundamentales, sino añadir otros nuevos, cuya formulación propone.

RésuméLes droits relatifs au travail sont‐ils un instrument promouvant la liberté? L'auteur définit trois libertés: la liberté au travail, par le travail mais aussi face au travail. Bien que certains courants du droit du travail analysent les liens entre droits relatifs au travail et liberté, ces droits se limitent traditionnellement à protéger les travailleuses et travailleurs sur le marché du travail plutôt qu'à étendre leurs libertés, notamment la liberté face au travail. L'auteur souligne à cet égard les limites des propositions actuelles en vue d'une émancipation du travail, dont le revenu de base. Lui‐même propose plutôt de créer de nouveaux droits dans un modèle dit de l'économie humaine.

AbstractTo what extent do labour rights promote freedom in relation to work? Methodologically, the article defines three freedoms: freedom "at", "through" and "from" work. Despite freedom‐oriented approaches to labour law, it shows that fundamental labour rights have traditionally aimed and continue to aim at protecting workers in the labour market, not at expanding freedoms and in particular freedom "from" work. In this respect, it outlines limits in current proposals, such as the basic income, to liberate from work. It discusses instead new rights in the human economy framework, concluding that, in order to expand freedoms in relation to work, not fewer but more fundamental labour rights are required.
