Emiliano J. Buis examines the sources of classical Greece to challenge both the state-centeredness of mainstream international legal history and the omnipresence of war and excessive violence in ancient times. Making ample use of epigraphic as well as literary, rhetorical, and historiographical sources, the book offers the first widespread account of the narrative foundations of the (il)legality of warfare in the classical Hellenic world. In a clear yet sophisticated manner, Buis convincingly proves that the traditionally neglected study of the performance of ancient Greek poleis can contribute to a better historical understanding of those principles of international law underlying the practices and applicable rules on the use of force and the conduct of hostilities

The purpose of this paper is to explore the emotional background of the international dimension revealed in Aeschylus' Eumenides by means of an original reading of Pallas Athena's final words focused on hegemonic consolidation. It is well known that, after Orestes' acquittal, the goddess managed to persuade the Erinyes to join the Athenian cult as metics and that, by accepting the proposal, the Furies would become benefactor goddesses of the polis. An examination of the vocabulary present in the diplomatic efforts carried out by Athena allows us to pay particular attention to the affective devices deployed when searching for an alliance. Range from fear of stasis to pacification, from anger and rejection to common love and veneration, the final verses of the play help to understand the emotional foundations —essential for the success of any foreign policy— which characterized the development of Athenian diplomacy in the middle of the fifth century BCE. ; El objetivo de este trabajo es examinar las bases emocionales de la dimensión internacional que deja entrever la tragedia Euménides de Esquilo a través de la propuesta de una interpretación novedosa de las palabras finales de Palas Atenea en clave de consolidación hegemónica. Es sabido que, luego de la absolución de Orestes, la diosa consigue persuadir a las Erinias de incorporarse en el culto ateniense como metecas y que, al aceptar la propuesta, las Furias se convertirán en diosas benefactoras de la pólis. Un examen del vocabulario presente en el ejercicio diplomático y hospitalario que lleva a cabo Atenea permite prestar particular atención a los dispositivos afectivos presentes en esa búsqueda de alianza. Del miedo de la stásis a la pacificación, de la ira y el rechazo al amor común y la veneración, los versos finales de la obra ayudan a comprender los fundamentos emocionales que, imprescindibles para el éxito de toda política exterior, caracterizaron discursivamente los avances de la diplomacia ateniense a mediados del s. V a.C.

summary: It is often said that, after the displacement of the interpersonal private revenge by heterocomic public mechanisms controlled by the Polis, the law on homicide established by Dracón replaced the emotions of the crackdown on crime with an order based on the group rationality of the expected objectivity of the legal system. However, an examination of the provisions relating to pardon (aydesis) in the retained text of the provision reveals a sort of emotional institutionalisation which, through the construction of a legal artificial arrangement, establishes the emotional fiction of collective leniency in place of the individual páthos. ; Resumen: Suele decirse que, luego del desplazamiento de la venganza privada interpersonal por mecanismos públicos heterocompositivos controlados por la pólis, la ley sobre homicidio establecida por Dracón sustituyó las emociones de la represión del crimen por un orden sustentado en la racionalidad grupal propia de la objetividad esperable del sistema jurídico. Sin embargo, un examen de las disposiciones referidas al perdón (aídesis) en el texto conservado de la norma permite advertir una suerte de institucionalización afectiva que, a través de la construcción de un artificio jurídico, instala la ficción emotiva de una clemencia colectiva en remplazo del páthos individual.

Las analogías entre el ámbito de las relaciones interpersonales y el plano de los vínculos internacionales son corrientes en el mundo griego clásico. En este caso, a partir de un reexamen del discurso Eginéticode Isócrates, se procura dar cuenta de un interesante uso metafórico de los conceptos de cercanía y amistad: tratándose de un debate sobre la ley aplicable a un conflicto testamentario, la asistencia brindada al enfermo por el cliente de Isócrates reproduce el vocabulario de la coexistencia pacífica de legislaciones domésticas. Este dispositivo literario funciona, además, en un nivel complementario para mostrar en el plano político la importancia de asegurar la cooperación panhelénica. ; Les analogies entre l'àmbit de les relacions interpersonals i el pla dels vincles internacionals són corrents en el món grec clàssic. Aquest dispositiu literari funciona, a més, en un nivell complementari per mostrar en el pla polític la importància d'assegurar la cooperació panhel·lènica. ; The analogies between the field of interpersonal links and the level of international relations have been widespread across the ancient Greek world. The re-examination of Isocrates's speech Aegineticus, in this sense, can be useful to explore an interesting metaphorical use of the concepts of closeness and friendship. Given that the speech deals with a debate on the law applicable to a conflict of succession, the care provided by Isocrates' client reproduces the vocabulary of the peaceful coexistence of domestic legislations. This literary mechanism can show, on a supplementary level, the political importance of ensuring Panhellenic cooperation.

This paper discusses the value and function of law and legal references in Old and New Greek Comedy. After an introduction on the terminology of Athenian law that is widespread in comic plays -showing that comedy can become a useful source for our understanding of the Attic legal system-, the paper deals with Aristophanes' criticism of the courts and with a consideration of the legal apparatus of Aristophanes' dramatic rivals. The second part focuses on Menander: the hypothesis is that, whereas Aristophanes' deployment of legal scenarios may be viewed as a kind of political overlay to his comic plots, Menander's deployment of the law (through the staging of arbitrations) is more fully embedded in the household-related themes of his plays. ; Fil: Buis, Emiliano J. AbstractFor international lawyers seeking to promote compliance with international humanitarian law (IHL), some level of affective awareness is essential – but just where one might cultivate an understanding of emotions, and at which juncture of one's career, remains a mystery. This article proposes that what the IHL lawyers and advocates of the future need is an affect-based education. More than a simple mastery of a technical set of emotional intelligence skills, what we are interested in here is the refinement of a disposition or sensibility – a way of engaging with the world, with IHL, and with humanitarianism. In this article, we consider the potential for the Jean-Pictet Competition to provide this education. Drawing on our observations of the competition and a survey with 231 former participants, the discussion examines the legal and affective dimensions of the competition, identifies the precise moments of the competition in which emotional processes take place, and probes the role of emotions in role-plays and simulations. Presenting the Jean-Pictet Competition as a form of interaction ritual, we propose that high "emotional energy" promotes a humanitarian sensibility; indeed, participant interactions have the potential to re-constitute the very concept of humanitarianism. We ultimately argue that a more conscious engagement with emotions at competitions like Pictet has the potential to strengthen IHL training, to further IHL compliance and the development of IHL rules, and to enhance legal education more generally.

Increasingly, large numbers of people are immersed in the context of various kinds of violence or serious humanitarian crises that force them to move and leave their place of habitual residence. As a consequence, it is imperative to dispense protection and guarantee the full exercise of their human rights. These situations pose the challenge of implementing legal rules at international and regional levels, taking into account the need to interpret them in a broadly progressive and increasing way to incorporate more people whose rights are seriously violated. The interpretation and application of refugee protection instruments require the need of understanding the particular situation of violence and armed conflict and its effects on the civilian population. Although indiscriminate violence does not always fit into the concept of persecution enclosed in existing refugee legislation, what is important in this progressive development is to emphasize the need of an inclusive and dynamic interpretation between the 1951 Convention Relating to the Status of Refugees, its Additional Protocol of 1967, the 1969 Convention of the Organization of African Unity and the 1984 Cartagena Declaration. In this sense, the guidance work of the United Nations High Commissioner for Refugees represents a vital contribution to the full enjoyment of human rights and respect for humanitarian principles. Como consecuencia de ello resulta imperioso dispensarles protección y garantizarles el pleno ejercicio de sus derechos humanos. Estas situaciones plantean el desafío de implementar las normas jurídicas existentes en el ámbito internacional y regional, teniendo en cuenta la necesidad de interpretarlas de manera progresiva y cada vez más amplia para incorporar a un mayor número de personas cuyos derechos son gravemente vulnerados. La interpretación y aplicación de los instrumentos de protección de refugiados requieren la necesidad de comprender la situación particular de violencia y conflicto armado y sus efectos sobre la población civil. Aunque la violencia indiscriminada no siempre se encuadre en el concepto de persecución consagrado por la normativa vigente sobre refugiados, lo importante en este desarrollo progresivo es poner de relieve la necesidad de una interpretación integradora y dinámica entre la Convención sobre el Estatuto de los Refugiados de 1951, su Protocolo Adicional de 1967, la Convención de la Organización de la Unidad Africana de 1969 y la Declaración de Cartagena de 1984; para estos fines, la labor de orientación del Alto Comisionado de las Naciones Unidas para los Refugiados es una contribución vital para el pleno goce de los derechos humanos y del respeto a los principios humanitarios. Este trabajo procura indagar, desde esta clave de lectura, en los principios incorporados recientemente en las Directrices sobre Protección Internacional Nº 12 elaboradas por el ACNUR en diciembre de 2016.

"Legal History presents a broad panorama of historical processes that trigger theoretical reflections on legal transfers and legal transplants and on the problem of the reception and assimilation laws and other modes of normativity. In this volume, legal historians across the globe reflect on their analytical traditions and present case studies in order to discuss how entangled histories of law can be understood, analyzed and written.
In the first section of this volume, 'Traditions of Transnational Legal History', the authors revisit specific achievements and shortcomings of legal historical research against the backdrop of postcolonial and global studies. Reflections on our own disciplinary traditions that reveal the path-dependencies include critical accounts on the tradition of 'European Legal History', 'Codification history', the emergence of 'Hindu Law', and the methodological aspects of Comparative Law.
The four articles in the second section, 'Empires and Law', showcase entangled legal histories forged in imperial spaces, for instance, through treaties concluded in the spheres of influence of ancient Roman Empire, which in this instance is analyzed as a process of 'narrative transculturation'. Analogously, transnational institutions adjudicating merchant-disputes in the Early Modern Spanish Empire and normative frameworks constructed in a multilingual space shortly after its decline are analyzed as 'diffusion and hybridization'. And finally, the spotlight is cast on the so-called 'craftsmen of transfer' and the bureaucrats that took practical comparative law as the basis to design the German colonial law.
In the third section, 'Analyzing transnational law and legal scholarship in 19th and early 20th century', seven case studies offer theoretical reflections about entangled legal histories. The discussions range from civil law codifications in Latin America as 'reception' or 'normative transfers', entangled histories of constitutionalism as 'translations' and 'legal transfer', formation of transnational legal orders in 19th century International Law and the International Law on state bankruptcies to the impact of transnational legal scholarship on criminology. All articles engage in methodological reflections and discussions about their concrete application in legal historical research."
