Using the health care reform of 2004 as an experience, the reaction of consumers (insured persons) and producers (pharmaceutical industry) based on electoral behavior and relating to drug prices and co-payments imposed on drugs is analyzed. The changes in prices and medications after this reform make it to a natural choice. For the analysis, the interest group model by Peltzman (1976) is applied to the German health care market. The vote-maximizing government has to find the optimal combination of rent and price of regulation. As a result, the vote-maximizing outcome is determined by a price level which reflects the interests of consumers as well as the pharmaceutical industry. The analysis of the reaction of consumers related to the co-payment rules of 2004 leads to the hypothesis that the regulator, and finally the pharmaceutical industry, sets drug prices in a way that they are ranging from 5 to 50 Euro. Prices between 50 and 100 Euro are possible as well, reflecting a balance of power facing the pharmaceutical industry. Producers who had accepted the 1989 reference price had an incentive to increase their price while lowering their sales volume.
A characteristic of the German health care market is the high complexity, amongst others due to the plurality of actors and interest groups. With so many players involved, health care reforms necessarily are the outcome of a quest for influence reflecting the relative power of interest groups. However, in much of the health economics literature, this fact is neglected, with the consequence that public regulation fails to have the intended effect. The treatment of social (interest) groups is central to understand political economic processes. Basic models in this area are the models of Olson (1965), Peltzman (1976) and Becker (1983). The objective of such model considerations in the health care market is to maximize efficiency and quality of care and thereby reduce expenditures. The section "The German health care market and its players: An overview from an economic perspective" analyses the structure of the health care market in Germany together with selected health challenges of the last decade. It questions to which extent the new political economy in contrast to welfare economy is able to explain health economic aspects. The section "Drug Prices and Pressure Group Activities in the German Health Care Market: An Application of the Becker Model" analyses the shift of power and influence among the pharmaceutical industry, the pharmacies and the social health insurers (SHI). Since the health care reform in 2004, these interest groups have been negotiating the structure of surcharges and discounts among each other without any intervention from the government. This reflects the assumption of a passive government in the Becker (1983) model and makes this model to a good choice for application. The negotiations and the resulting amendments of this ordinance express the shift of power and influence among the involved interest groups in the German health care market after 2004. The first assumption is a closed system based on the theoretical work by Becker. The amount of total budget and the amount of total influence is constant and defined as 10. In such a standardized system, the influence by producers and pharmacies decreases about 0.007 units of political pressure to the value 9.989, whereas the influence by SHI increases about 0.007 units to the value 0.011 between 2008 and 2010. More realistic is the second assumption, the assumption of an open system where the amount of total budget and the amount of total influence can change over the years. With this assumption a trend becomes apparent which shows an increase in political pressure by SHI about 0.015 units to the value 0.036 and a decrease of political pressure by pharmacies and producers about 18.326 units to the value 34.022 between 2008 and 2010. This reflects the cost control trend in combination with the empowerment incentives for SHI. Noteworthy is the high pressure level of producers compared to the other interest groups. As a conclusion one can say that the last years show a movement to more competition between the interest groups. This leads to more balanced power relations. But nevertheless, the most powerful group is still the producer group and the influence of the SHI is still very low. However, the government does not always behave passively. On sensitive issues for voters such as co-payments, the government tries to maximize votes. Reflecting different power structures leads to drug prices ranging from 5 to 50 Euros, associated with a co-payment of 5 Euros. Prices between 50 and 100 Euros are possible as well, reflecting a balance of power facing the pharmaceutical industry. These prices are associated with a co-payment of 10% of the selling price. Concerning the transition from 1989 reference price regime to the 2004 reform one can say that producers who had accepted the reference price had an incentive to increase their price while lowering their sales volume. ; Eine Besonderheit des deutschen Gesundheitsmarktes ist die hohe Komplexität, unter anderem bedingt durch die Vielzahl von Akteuren und Interessengruppen. Gesundheitsreformen sind daher zwangsläufig das Ergebnis einer Reihe von Interessenseinflüssen, welche die relative Macht unterschiedlicher Interessengruppen widerspiegeln. In weiten Teilen der gesundheitsökonomischen Literatur wird diese Tatsache allerdings vernachlässigt. Für das Verständnis von politökonomischen Prozessen ist hierbei die Betrachtung von Interessengruppenmodellen unerlässlich. Mithilfe solcher Modellierungen ist es möglich, das Verhalten von Akteuren zu analysieren und zu optimieren. Basismodelle in diesem Bereich sind die Modelle von Olson (1965), Peltzman (1976) und Becker (1983). Bezogen auf den Gesundheitsmarkt sollen Effizienz und Qualität der Versorgung maximiert und dadurch Gesundheitsausgaben reduziert werden. Im Kapitel ´Der deutsche Gesundheitsmarkt und seine Akteure: Ein Überblick aus volkswirtschaftlicher Sicht´ wird zunächst die Struktur des Gesundheitsmarktes analysiert sowie an ausgewählten gesundheitspolitischen Herausforderungen der letzten Dekade untersucht, inwieweit die neue politische Ökonomie im Gegensatz zur Wohlfahrtsökonomie in der Lage ist, gesundheitsökonomische Aspekte zu erklären. Im Kapitel ´Drug Prices and Pressure Group Activities in the German Health Care Market: An Application of the Becker Model´ wird die Verschiebung von Macht und Einfluss zwischen Pharmaindustrie, Apotheken und gesetzlicher Krankenversicherung (GKV) untersucht. Seit der Gesundheitsreform im Jahr 2004 verhandeln diese Interessengruppen die Zu- und Abschläge bezogen auf Arzneimittelpreise ohne Intervention der Regierung. Dies entspricht der Annahme einer passiven Regierung des Modells von Becker (1983). Die Verhandlungen und die daraus resultierenden Änderungen spiegeln die Verschiebung von Macht und Einfluss zwischen den beteiligten Interessengruppen im deutschen Gesundheitsmarkt nach 2004 wider. In einer ersten Untersuchung wird von einem geschlossenen System ausgegangen. Die Höhe des Gesamtbudgets und des Gesamteinflusses sind konstant und genormt auf den Wert 10. In einem solchen System sinkt der Einfluss von Pharmaherstellern und Apotheken um 0,007 Einheiten politischen Druckes auf den Wert 9,989, während der Einfluss der gesetzlichen Krankenversicherung zwischen 2008 und 2010 um 0,007 Einheiten auf den Wert 0,011 steigt. Realistischer ist jedoch die zweite Untersuchung unter der Annahme eines offenen Systems, in welchem sich die Höhe des Gesamtbudgets und des gesamten Einflusses im Laufe der Jahre ändern können. Der politische Druck der GKV erhöht sich nun um 0,015 Einheiten auf den Wert 0,036 und derjenige von Apotheken und Herstellern reduziert sich zwischen 2008 und 2010 um 18,326 Einheiten auf den Wert 34,022. Dies zeigt zwar eine Bewegung hin zu mehr Wettbewerb zwischen den Interessengruppen und zu ausgewogeneren Machtverhältnissen, aber die mächtigste Gruppe ist die der Pharmahersteller und der Einfluss der GKV ist immer noch sehr gering. Doch die Regierung verhält sich nicht immer passiv. Bei für Wähler sensiblen Themen wie Zuzahlungen versucht die Regierung, Wählerstimmen zu maximieren. In dem Kapitel ´Drug Prices, Rents, and Votes in the German Health Care Market: An Application of the Peltzman Model´ wird daher die Reaktion der Versicherten und der Pharmaindustrie bezogen auf Wählerstimmen im Zusammenhang mit Zuzahlungen für Arzneimittel analysiert. Bezug genommen wird auf die Gesundheitsreform 2004, da sich mit dieser die Arzneimittelpreise sowie die Zuzahlungen grundlegend geändert haben. Für die Analyse wird das Interessengruppenmodell von Peltzman (1976) auf den deutschen Gesundheitsmarkt angewendet. Die wählerstimmenmaximierende Regierung muss die optimale Kombination aus Gewinn- und Preisregulierung finden. Für die optimale Lösung muss die Variation der Stimmen seitens der pharmazeutischen Industrie der Variation der Stimmen auf Seiten der Versicherten entsprechen. Diese Untersuchung führt zu regulierten Arzneimittelpreisen zwischen 5 bis 50 Euro, verbunden mit einer Zuzahlung für Versicherte von 5 Euro. Arzneimittelpreise zwischen 50 und 100 Euro sind ebenso möglich und spiegeln ein Machtgleichgewicht wieder, in welchem die Pharmaindustrie gegenüber den Versicherten bevorzugt ist. Diese Preise sind mit einer Zuzahlung für Versicherte von 10 % des Verkaufspreises verbunden. Bezüglich der Referenzpreisregelung von 1989 im Zusammenhang mit der Reform von 2004 kann gezeigt werden, dass die Hersteller, die den Referenzpreis akzeptiert haben, nun einen Anreiz haben, ihre Preise zu erhöhen und gleichzeitig das Umsatzvolumen zu senken.
This article analyzes the shifts of power relation and influence between pharmaceutical industry (producers), pharmacies, and social health insurers (SHI) in Germany based on drug prices. Since the health care reform of 2004, these interest groups have negotiated fees and discounts among each other without any intervention from the government. These negotiations and resulting amendments to the original law express the shift of power of the involved groups, which can be explained with the Becker (1983) model. As a result, a trend becomes apparent, which shows a slight increase in political pressure on the part of SHI and a big decrease of political pressure on the part of pharmacies and producers. This reflects the cost control trend in combination with the empowerment incentives for SHI. The last years have shown increased competition between the interest groups, resulting in more balanced power relations. Nevertheless, the most powerful group is still the producer group and the influence of SHI is still very low.
