This book examines how the EU can be a more proactive actor in the promotion of the principles of sustainability and fairness from a legal environmental perspective. The book is one of the results of the research activity of the Jean Monnet Chair in EU Environmental Law (2017-2020) funded by the European Commission under the Erasmus+ programme. The European Union and Global Environmental Protection: Transforming Influence into Actionbegins with an introduction of the key EU competences, instruments and mechanisms, as well as the current international challenges at the EU level. It then explores case study examples from four regulated fields: climate change, biodiversity, multilateral trade, unregulated fishing, and access to justice; and four unregulated areas: mainstreaming of the Sustainable Development Goals in EU policies,and environmental justice, highlighting the extent to which the EU might align with international environmental regimes or extend its normative power. This volume will be of great relevance to students, scholars, and EU policy makers with an interest in international environmental law and policy.
La evolución de la biotecnología moderna en los últimos decenios ha comportado avances sorprendentes que van más allá de la ingeniería genética y se abren actualmente a nuevos desarrollos en el campo de la biología sintética. Sin embargo, la rápida expansión de estas tecnologías no coincide con el marco jurídico internacional existente, muy fragmentado e incompleto. En la Unión Europea (UE), especialmente, el uso de estas tecnologías ha planteado reservas importantes, que se reflejan en el desarrollo de un marco regulatorio particularmente restrictivo. Este trabajo presenta algunas de las características más significativas del procedimiento de autorización en la UE para la liberación de OMG, un procedimiento centralizado y anclado en el principio de precaución, a la vez que aborda el margen de discrecionalidad de los Estados miembros con respecto a este tipo de cultivos. A partir de ahí se pretende identificar algunas de las cuestiones que suscita el encaje de los nuevos desarrollos biotecnológicos, en particular, de la biología sintética, en el actual marco normativo de la UE. ; The evolution of modern biotechnology in recent decades has led to surprising advances that go beyond genetic engineering and are currently opening up to new developments in the field of synthetic biology. However, the rapid expansion of these technologies does not match with the incomplete international legal framework. In the European Union (EU), especially, the use of these technologies has raised important reservations, which are reflected in the development of a particularly restrictive regulatory framework. This paper presents some of the most significant characteristics of the authorization procedure in the EU for the release of GMOs, a centralized procedure anchored in the precautionary principle, while addressing the margin of discretion of the Member States with respect to this crops. From there, the paper intends to identify some issues raised by the fit of new biotechnological developments, in particular, synthetic biology, in the current EU regulatory framework. This paper draws from the situation of imbalance in the use of water resources among the Central Asian States, in a context marked by a deep dichotomy between two competing uses of water -irrigation and the production of hydroelectric energy. From the perspective of water resources management, the hydrographic and geopolitical complexity of the region is unquestionable and has been found in the cause of several interstate conflicts, which are frequently aggravated by important environmental challenges. From there, this paper discusses the adequacy of the international regulatory framework to guarantee the sustainable governance of water resources in the region. The impact of multilateral conventions in the region is analysed, as well as the development of a series of bilateral agreements that have actually maintained the status quo. This situation has worsened due to the low consistency and effectiveness of the regional institutions created by these same agreements. From a regional perspective, the situation in the countries of Central Asia offers an exceptional case for analysis. It is an area with significant security risks due to the widespread lack of governance over the use of water resources, which are unevenly distributed between the Central Asian States, and have undergone alarming environmental degradation in recent years. Although this situation could represent a major opportunity for the development of interstate cooperation, the upshot will depend to a large extent on the capacity of political institutions in the region to manage these resources in a way that is both environmentally and politically sustainable.

A partir de ahí, el trabajo analiza la idoneidad del marco jurídico internacional para garantizar la gobernanza sostenible de los recursos hídricos en la región. Se analiza el impacto de los convenios multilaterales en la región, así como el desarrollo de una serie de acuerdos bilaterales que, en esencia, se han limitado a mantener el status quo. Esta situación se agudiza debido a la poca consolidación y efectividad de las instituciones regionales creadas por estos mismos acuerdos. Du point de vue de la gestion des ressources en eau, la complexité hydrographique et géopolitique de la région est indiscutable et s'est révélée être à l'origine de plusieurs conflits entre États, souvent aggravés par d'importants défis environnementaux. À partir de là, ce travail examine l'adéquation du cadre juridique international pour garantir la gouvernance durable des ressources en eau dans la région. Il analyse l'impact des accords multilatéraux dans la région, ainsi que l'élaboration d'une série d'accords bilatéraux qui ont en réalité maintenu le statu quo. Cette situation s'est aggravée en raison de la faible cohérence et efficacité des institutions régionales créées par ces mêmes accords. D'un point de vue régional, la situation dans les pays d'Asie centrale offre un cas d'analyse exceptionnel. C'est un domaine qui présente des risques importants pour la sécurité en raison de la faiblesse généralisée des mécanismes de gouvernance en ce qui concerne l'utilisation des ressources en eau, inégalement réparties entre les États de la région et qui ont subi une dégradation environnementale alarmante ces dernières années. Même si cette situation pourrait représenter une opportunité majeure pour le développement de la coopération entre États, le résultat dépendra dans une large mesure de la capacité des institutions politiques à gérer ces ressources de manière durable tant sur le plan environnemental que politique. [spa] Mientras que en Europa la interdependencia y la dimensión transfronteriza de las cuestiones ligadas al cambio climático ha facilitado una cierta"continentalización" de la gestión de este fenómeno, favorecida por el carácter intergubernamental de las medidas que se adoptan en el marco de la Unión Europea, al otro lado del Atlántico la transversalidad de este mismo fenómeno explica la necesidad de que, ante las limitaciones del marco regional, se pongan en marcha mecanismos que faciliten la intervención no sólo estatal sino también de las entidades sub-nacionales. En este sentido, la ausencia de la acción federal tanto en Estados Unidos como en Canadá ha comportado un mayor desarrollo de la acción de las entidades sub-nacionales, que han tomado el liderazgo en la lucha contra el cambio climático. Son estas medidas las que se han visualizado en el escenario internacional. Ello ha favorecido el establecimiento de mecanismos de coordinación de la acción de estas entidades sub-nacionales en el seno de redes transnacionales, que han ido adquiriendo una mayor relevancia en la implementación del Convenio Marco sobre el Cambio Climático y del Protocolo de Kyoto, particularmente en relación a uno de sus instrumentos, el comercio de los derechos de emisión de gases de efecto invernadero. En este contexto, la futura vinculación de los sistemas de comercio de derechos de emisión de gases de efecto invernadero en Norteamérica con el sistema de la Unión Europea presenta diversos retos de carácter material y formal. ; [eng] In Europe, the interdependence and cross-border dimension of climate change's issues as well as the intergovernmental nature of the European Union measures, have favored certain "continentalization" of its management. In North America, the transversal character of these same issues and the limitations of regional framework have favored the intervention of the States as well as the sub-national bodies. The lack of federal action in United States and Canada implies a further development of sub-national's action. Sub-national bodies have taken the lead fighting the climate change and they have acquired a relevant presence at international level, too. This has encouraged the establishment of sub-national bodies' coordination within transnational networks, which have gained a larger role in the implementation of the Framework Convention on Climate Change and the Kyoto Protocol, especially in what concerns the greenhouse gases emission trading. In this context, the future linking of these emission trading systems with European Union emission trading system presents several challenges from the material and formal perspectives.
La integración de una politica de protección del medio ambiente en las CE, si bien incorporada al Tratado por el Acta Única Europea, es aún objeto de multiples debates jurídicos y políticos. Ello no obstante, aún antes de la inclusión en el Tratado de un Título relativo a esta materia, la CEE ya había adoptado numerosos actos relativos a la protección del medio ambiente, que configuran actualmente esta política comunitaria. En este contexto, el trabajo se centra en el estudio de la reglamentación comunitaria de las diversas operaciones de gestión de los residuos peligrosos, cuestión que ha motivado posicionamientos diversos y a veces contradictorios en el seno de la sociedad, por sus múltiples connotaciones económicas y medioambientales. De este modo, el análisis de este tema se ha estructurado en la triple óptica de su regulación comunitaria, la aplicación de dicha normativa, y las cuestiones que se suscitan en torno a la responsabilidad por los daños causados por estos subproductos. Concretamente, se examina la tarea de armonización llevada a cabo por las instituciones comunitarias a partir de las Directivas adoptadas por el Consejo de las Comunidades Europeas relativas a esta cuestión. En particular, el examen de la Directiva Marco relativa a los residuos, la Directiva relativa a los residuos tóxicos y peligrosos, las Directivas relativas a los traslados transfronterizos de residuos peligrosos, así como las Directivas que las complementan (aceites usados, PCBS y PCTS, dióxido de titanio).
