This paper examines the history of European legal integration through the lens of the Eliasian concept of "(de-)civilizing process" that is, a reversible process of social pacification and of extension of the sense of belonging to the same community. Today, the European union (EU) is generally regarded as the most advanced attempt at establishing a supranational "rule of law," i.e., a set of general and predictable rules enforced homogeneously across a large territory, granting rights to its inhabitants, and fostering a slow extension of the "imagined community" of citizens. The construction of this European "rule of law" is, therefore, often interpreted as a crucial element of a "European civilizing process" unfolding beyond the nation-states. Critically departing from this narrative, this paper invites to reconceptualise European legal integration as a "civilizing offensive" through law. In this light, EU law can be analysed as a more ambivalent and ambiguous project than suggested by the narrative of a necessarily unfolding "rule of law." To that aim, this paper will concentrate on an issue of particular prominence in the recent debates about EU law: The "rule of law crisis" in Hungary. Since 2010, it has brought together several important features of the many recent crises of European integration. On the basis of legal EU and Hungarian documents, I will argue that, in spite of repeated clashes with EU institutions, part of these challenges were made possible by the ambiguous historical construction of the EU and its legal order: They also emerge from within - as will be illustrated through the concept of "constitutional identity" and its uses.

Comment les savants contribuent-ils à la production de l'action publique ? Pour répondre à cette question, cet article propose d'analyser le rôle politique des savants – universitaires, experts ou praticiens revendiquant la maîtrise d'une connaissance spécialisée – à l'aune du concept de « coproduction » , qui vise à prendre au sérieux l'imbrication du travail savant et du travail politique. À partir du cas de la construction européenne, il vise d'abord à clarifier ce concept en distinguant trois approches de la coproduction : événementielle, généalogique et archéologique. Nous soulignerons en particulier les questions, objets, processus et types d'enquêtes privilégiés dans chaque cas. Ce faisant, il ne s'agit pas tant de les opposer que de montrer comment on peut les combiner pour esquisser un modèle socio-historique de la contribution des savants à la production d'une politique publique. On entend par là inviter à un dialogue accru entre approches socio-historiques et analyses de l'action publique autour de la question du travail savant. Les différentes approches présentées seront illustrées par l'exemple de la construction de la politique de la concurrence européenne.

This article contributes to the debate about the history of the political economy of the European Economic Community (EEC). It retraces the efforts during the early years of the EEC to implement a form of 'European economic programming', that is, a more 'dirigiste' type of economic governance than is usually associated with European integration. Based on a variety of archives, it offers a new account of the making and failure of this project. It argues that, at the time, the idea of economic programming found many supporters, but its implementation largely failed for political as well as practical reasons. In so doing, it also brings to light the role of economists during the early years of European integration.

Cette contribution étudie la genèse des premières revues d'études européennes en France, en République Fédérale d'Allemagne (RFA) et au Royaume-Uni, des années 1950 à 1993. Il s'agit d'explorer l'hypothèse comparative que le savoir sur l'Europe s'est construit dans une plus grande proximité au politique au Royaume-Uni que sur le continent. Cela aurait, à long terme, contribué à y maintenir l'Europe communautaire dans l'espace du discours politique. Nous montrons ici que les trois revues étudiées ont été construites comme des lieux hybrides entre science, pratique et politique. À cet égard, l'hypothèse d'une spécificité britannique ne se vérifie que partiellement. Plus qu'une opposition tranchée entre science, pratique et politique, ce sont donc les diverses modalités de leur articulation que l'étude des débuts des revues invite à saisir.

This paper reconstructs the political thought of the Scottish legal philosopher, and eventually MEP, Sir Neil MacCormick (1941–2009), the founder of "constitutional pluralism," one of the most influential legal theories of the European union today. It argues that his legal theory is underpinned by a coherent and original political theory of post-sovereignty. But, contrary to many current interpretations, this article argues that normatively, constitutional pluralism is not a purely liberal theory. Neither is it inherently illiberal, as has been contended. Instead, this article spells out the hybrid institutional design imagined by N. MacCormick and inspired by the thought of D. Hume, as well as the lineaments of an ethical theory of post-sovereignty he developed. So doing, while I will argue that it ultimately leads to a kind of republican cosmopolitanism, the political theory of constitutional pluralism is shown to open up an important, if not fully developed, avenue to escape some shortcoming commonly associated with post-sovereignty.

Cet article interroge la façon dont le concept de solidarité était, dans les mouvements liés au solidarisme du début du siècle dernier, associé à l'idée de la construction d'une Europe unie. Il analyse le concept de solidarité dans la pensée d'un auteur qui se situe à l'articulation des mouvements solidaristes et des premiers pas de l'Europe d'après-guerre : le juriste français Georges Scelle (1878-1961). Ce faisant, il s'agit de mettre en évidence les passages possibles – et parfois les impasses – entre un concept de solidarité forgé dans le cadre français et l'idée d'une Europe sociale, dont l'avènement demeure une promesse lointaine de la construction européenne. Nous montrerons que la conceptualisation d'une solidarité européenne est étonnamment limitée dans l'œuvre de G. Scelle. Nous nous interrogerons alors sur les raisons de cette sous-conceptualisation de l'Europe sociale dans la pensée de G. Scelle.
