The article analyzes the Italian experience about the TAP gas pipeline, in the framework of Odum's theory of the "tyranny of small decisions" and the climate challenges, inaugurated by the Paris Agreement of 2015. The actions of the Italian Government narrate a national "strategy", which does not fully correspond to the European objectives of legitimizing energy decisions, based on deliberative democracy, and with the new climatic constraints to be achieved. On the contrary, the State has bound itself to TAP with a Treaty, explicitly inspired by the logic of the "capture" of the regulation. This situation has fueled social conflict in opposition to the project. ; L'articolo analizza l'esperienza italiana in merito al gasdotto TAP, nel quadro della teoria di Odum della "tirannia delle piccole decisioni" e rispetto alle sfide sul clima, inaugurate dall'Accordo di Parigi del 2015. I provvedimenti del governo italiano narrano di una "strategia" nazionale, che non trova piena corrispondenza con gli obiettivi europei di legittimazione delle decisioni energetiche, fondati sulla democrazia deliberativa, e con i nuovi vincoli climatici da realizzare. Al contrario, lo Stato si è vincolato a TAP con un Trattato, esplicitamente ispirato alla logica della "cattura" del regolatore. Questa situazione ha alimentato la conflittualità sociale nei confronti del progetto.

Is it (im)possible the Republic of Commons? From Kouroukanfouga to local self-government and return. The article discusses the issue of the Commons government. After analyzing the divergence of perspectives between Private Law and Constitutional Law Scholars, the author focuses on the transition of constitutionalism from the "biochemistry Era" to the "fossil Era" in order to investigate the consequences of this evolution in local democracy experiences. Only in this perspective, it is possible to identify differences and limitations of both theories (like those proposed by Ostrom and Wilson) and of the historical experiences (from the Kouroukanfouga Charter to the Constitution of Ecuador) of the Commons government.

El constitucionalismo moderno, como cultura política, y el derecho constitucional, como un conjunto de reglas y doctrinas de estudio de las Constituciones, nacen y evolucionan hacia una dimensión androcéntrica que ha condicionado la elaboración del derecho constitucional comparado y su enseñanza como forma de conocimiento de la realidad. El origen de esta característica se encuentra en los llamados "catecismos" y en las propuestas de reforma del sistema de educación pública, con dos excepciones importantes: Condorcet, en Francia, y Cuoco, en Italia. ; Modern constitutionalism, as a political culture, and constitutional law, as a set of rules and doctrines of study of the Constitutions, are born and evolve towards an androcentric dimension that has conditioned the elaboration of the comparative constitutional law and its teaching as a form of knowledge of reality. The article analyzes the proposal to institutionalize an International Constitutional Court, de-veloped by the African Union Heads of State Summit and introduced to the General Assembly of the United Nations. The initiative is based on two very important elements for the future of constitutionalism: the recognition of a human right to democracy as a right for participation and social inclusion; the judicial review on the basis of international standards and constitutional changes within the States. In this perspective, the existence of an International Constitutional Court should also avoid the interference of any State in the domestic affairs of another State, justified by abstract democratic values
