This article presents some preliminary findings of a recent survey of employee representatives on company boards in nine EU Member States. The research examines: the personal characteristics of board-level employee representatives; the companies and boards involved; the representatives' relationships with employees, trade unions, works councils, other board members and management; the resources and facilities provided to the representatives; the issues they deal with; their impact on decision-making; the perceptions of their role; and their views on how their work could be improved.

This article, based largely on research carried out for the European Foundation for the Improvement of Living and Working Conditions, examines the extent to which European Works Councils have concluded joint texts with management, and the content and context of such texts. The practice of negotiating joint texts appears to be very limited, but growing, with some more substantive texts starting to appear. Most joint texts are frameworks for lower-level action, and the key themes dealt with are company restructuring and social rights. It seems that the dynamics within each company that lead to the conclusion of a joint text are complex, and involve the interplay of different factors of differing strengths.

This article examines briefly the nature of employee representation on company boards, its extent in western Europe and the revival of the European Company Statute which has once again brought this form of indirect worker participation to the fore. The article goes on to outline some of the main findings of recent research by the author into board-level representation in five countries (Finland, Germany, Greece, Ireland and the Netherlands), highlighting areas of diversity and of convergence.

Thema dieses Beitrags ist die Arbeitnehmerbeteiligung in Aufsichtsräten, ihre verschiedenen Erscheinungsformen in Westeuropa und die Europäische Aktiengesellschaft, durch die diese indirekte Form der Arbeitnehmerbeteiligung erneut in den Blickpunkt des Interesses gerückt wurde. Im Mittelpunkt stehen dabei die Erfahrungen in fünf Ländern (Finnland, Deutschland, Griechenland, Irland und den Niederlanden) und die dort existierenden Gemeinsamkeiten und Unterschiede. "Atypische Beschäftigungsverhältnisse haben seit den späten 70er Jahren schnell zugenommen. Nicht-Normalarbeitsverhältnisse umfassen inzwischen über ein Drittel der britischen Arbeitnehmerschaft. Die Autoren analysieren in ihrem Beitrag die Gründe für dieses Wachstum. Dabei berücksichtigen sie die Strategien der 'flexiblen Firma', welche die Arbeitgeber im Kontext zunehmenden Wettbewerbs und ökonomischer Unsicherheit sowie längerfirstiger sozialer und demographischer Trends verfolgen. Der Artikel gibt außerdem einen Überblick über die Hauptformen nicht-standardisierter Beschäftigung und betont den Mangel an rechtlicher Regulierung, dem sie in doppelter Hinsicht unterworfen sind, nämlich sowohl durch das relative Fehlen gesetzlicher Beschränkungen in bezug auf ihren Gebrauch als auch durch den Ausschluß atypisch Beschäftigter von vielen Arbeitnehmerrechten."
