La Ley 2/2022, de Memoria Democrática constituye un reto para el Estado que permite acrecentar su calidad democrática. En este artículo se abordan algunas cuestiones de relevancia jurídica de su extenso texto. El punto de partida de las políticas públicas de memoria se ha de fundamentar en la necesidad de afrontar el pasado traumático derivado de la Guerra Civil y la Dictadura no solo desde la reparación a las víctimas, sino también mediante el fomento de la investigación histórica, para evitar la mitificación del pasado. Para ello, es imprescindible la colaboración entre el Estado y las comunidades autónomas en el marco de sus respectivas competencias determinadas por la Constitución y los estatutos de autonomía.
Por otra parte, a fin de que los efectos jurídicos de esta ley sobre la Ley de Amnistía de 1977 alcance su plenitud será preciso que el Estado concrete su compromiso con el Derecho internacional sobre la imprescriptibilidad de los crímenes de guerra y de lesa humanidad. Finalmente, la disolución de una fundación por apología de la dictadura franquista exige, además, que su actividad se identifique con la provocación del odio o la violencia

Abstract:The provision of constitutional jurisdiction in the 1978 Constitution has been an instrument that has reinforced its status as a legal norm. The undoubted institutional prestige of the Constitutional Court acquired in the first years has been subsequently reduced by political influence on its composition and functioning. The constitutional interpretation forms part of the Theory of the Constitution and the hermeneutical criteria of the employees by the Court have had a notable influence in the ordinary jurisdiction. On the other hand, the objective meaning and the new rules on admission of the appeal for Constitutional rigth's legal protection (amparo), has allowed the Court to exercise more effectively the judgment on the law of Parliament. On the other hand, its function of guaranteeing fundamental rights can not be conceived outside the European system of multilevel jurisdiction. ; Resumen:La previsión de la jurisdicción constitucional en la Constitución de 1978 ha sido un instrumento que ha reforzado su condición de norma jurídica. El indudable prestigio institucional del Tribunal Constitucional adquirido en los primeros años se ha visto reducido posteriormente por la influencia política en su composición y funcionamiento. La interpretación constitucional forma parte de la Teoría de la Constitución y los criterios hermenéuticos del empleados por el Tribunal han tenido una notable influencia en la jurisdicción ordinaria. Por otra parte, el sentido objetivo y las nuevas reglas sobre admisión del recurso individual (amparo), han permitido que el Tribunal pueda ejercer con mayor eficacia el juicio sobre la ley del Parlamento. Por otra parte, su función de garantía de losderechos fundamentales no puede ser concebida al margen del sistemaeuropeo de jurisdicción multinivel. La cuestión prejudicial se ha convertido en un instrumento para la participación de los jueces nacionales en la interpretación del Derecho de la Unión Europea. Por su parte, el Tribunal de Justicia de la Unión ha extendido su poder jurisdiccional sobre la tutela derechos fundamentales y, en cierto modo, ha desplazado a los tribunales constitucionales.The question referred for a preliminary ruling has become an instrument for the participation of national judges in the interpretation of European Union law. This article seeks to highlight the scene of Spanish constitutional law. Therefore, the first part presented wants to show the Spain's new democratic period with the constitutional recognition, of a wide range of rights and freedoms. And a gifted legal system Safeguards guaranteeing the protection of the rights persons before the courts, giving it as a result in the first sign of the new democratic political regime, after the same rights and guarantees were continually violated by the Franco dictatorship. Then, it was displaying the existing judicial pluralism, understanding thus: i). The conditions for the application of the rights and freedoms contained in the catalog ii). The key competence between different jurisdictions, judges and bodies to protect fundamental rights, which is achieved to conclude that all rights are not subject to the same level of legal requirement, although there are two general clauses division and they are a tool for the interpretation of these, human dignity and the free development of personality. ; El presente artículo pretende dar a conocer el panorama del derecho constitucional español, por ello, en primer lugar presenta lo que fue para España el nuevo período democrático con el reconocimiento constitucional de una amplia gama de derechos y libertades y de un sistema judicial dotado de las salvaguardias que garantizan la protección de los derechos de las personas ante los tribunales, lo que se traduce en la primera señal del nuevo régimen político democrático, luego de que los mismos derechos y garantías fueran violadas continuamente por la dictadura franquista. Seguidamente, exhibe el pluralismo jurisdiccional existente, entendiendo con ello: i). Las condiciones para la aplicación de los derechos y libertades contenidas en dicho catálogo, y; ii).
