Insights into the Vatican Trial against Cardinal Becciu and Others
ABSTRACT: This paper examines various aspects of the trial recently concluded before the Vatican Court, primarily focusing on the determination of criminal liability related to the acquisition of the London Palace on Sloane Avenue with funds from the Secretariat of State. Specifically, the analysis focuses on some key principles stemming from the international commitments made by the Holy See on behalf of the Vatican State, highlighting the resulting constraints on the Pope's authority as the temporal sovereign of the State. It explores the application of these principles within the trial proceedings and the impact of multiple pontifical rescripta issued during the case, which expanded the powers of the Promoter of Justice in relation to the accused and were justified by the Vatican Court. Additionally, it addresses the potential consequences stemming from these developments, both in terms of the credibility of the Vatican jurisdiction in the international context and in its relations with Italian authorities.

The extraterritorial areas envisaged by the Lateran Treaty between the Holy See, Italy, and the Vatican City State
ABSTRACT: This paper examines the legal regime of the extraterritorial areas envisaged by the Lateran Treaty stipulated between the Holy See and Italy in 1929. These are buildings and functional areas for the best exercise of the Holy See's own functions, forming part of the territory of the Italian State but enjoying the immunities proper to diplomatic headquarters. In recent decades, an expansive trend has been observed in Vatican legislation and jurisdiction concerning these areas, which the author highlights by emphasizing the discontinuity with respect to the past.

The Supervision of the economic administration of the Roman Curia
ABSTRACT: This paper analyses the new system of supervision of the economic administration of the Roman Curia introduced by the Apostolic Constitution Praedicate Evangelium. Then, it focuses on the role that has been recently assigned in this area to the 'Istituto per le Opere di Religione' (IOR) and on that of the Vatican penal jurisdiction, both of which constitute highly innovative elements.

The art treasures of the Vatican in the Lateran Treaty
ABSTRACT: Drawing inspiration from a recent initiative by the Pontiff, the contribution focuses on the peculiar juridical condition of the art treasures kept in the Vatican City, resulting from a series of provisions of the Lateran Treaty, other international conventions and recent Vatican legislation on the protection of cultural heritage. The result is a complex and articulated regulatory framework that underlines the role of the Holy See as a custodian and guarantor of one of the greatest historical and artistic heritages of humanity.

The ministers of religion in Italian law
ABSTRACT: This contribution analyses the status of ministers of religion in the Italian legal system. It starts from a description of the historical foundations, which lies in Nineteenth-century liberal legislation, and arrives at a synthetic representation of the regulations currently in force in the unilateral State law and in the Concordat and Treaty legislation. The regulatory evolution, which is still in progress, describes the transition from a uniform and homogeneous concept of minister of religion, inspired by the Catholic priest and placed at the basis of a mostly restrictive legislation, to a more articulate and comprehensive one, reflecting the growing confessional pluralism of Italian society and the assertion of the right to religious freedom. This new approach represents the premise for a legislation that increasingly aims at protecting and promoting the status and the manifold activities of ministers of religion, particularly in the context of the strong enhancement of the Welfare State and of the Third sector. Finally, the article focuses on some problematic issues of the current legislation and on the apparent paradox that, in the face of a more favorable State legislation, nowadays the status of the minister of religion, and in particular that of the Catholic priest - who still represents the main reference for Italy's legislation - is undergoing a strong identity crisis in the ecclesial order, thus posing a series of problems also for society at large.

Ecclesiastical bodies between special rules and general law
ABSTRACT: This contribution examines the relationship between special law rules of a treaty nature and general law in the Italian discipline of civilly recognized ecclesiastical bodies, in particular those of the Catholic Church, which still represents most part of these entities. This aspect is examined with respect to the latest regulatory evolution, in particular the reform of the Third sector, which tends to confirm the duplicity of regime of ecclesiastical bodies. It also highlights the growing attention and protection of the normative peculiarities of this category of legal entities by the State legislator.

The Supreme Court's United Sections on the Crucifix controversy in schools: searching for a difficult balance between laicism and European case-law
ABSTRACT: This paper examines critically, in the light of the Italian and European case-law, the contents and the juridical arguments of a recent decision issued by the United Sections of the Italian Court of Cassation concerning the Crucifix controversy arisen in a State school. The judges established, on one hand, that the crucifix may be hung in a classroom upon demand of the students as it does not infringe the dissenting teacher's freedom of conscience or of teaching, according to Lautsi ECHR decision (2011); on the other hand, the clash of values involved would need a reasonable accommodation which could require other religious symbols alongside the crucifix or its removal during the lessons of the dissenting teacher. Such a decision, according to the author, appears to be somewhat contradictory and ambiguous, and it does not resolve the case in a well-balanced way.
