La transformación del Orden jurídico-político ecuatoriano expresada en la Constitución ecuatoriana de 2008 exige volver a estudiar el Derecho desde nuevas bases hermenéuticas y técnicas que superen los métodos de la Escuela Histórica y del Positivismo clásico que han servido de base paralos estudios del derecho. Se requiere de nuevos jueces, nuevos operadores de justicia y de ciudadanos activos que pongan en funcionamiento los mecanismos garantistas de derechos. En este contexto, para la constitución ecuatoriana, la formación de los jueces tiene una triple dimensión: reconoce el derecho de lasy los servidores públicos a formarse y capacitarse para el ingreso, la permanencia y promoción dentro del servicio público; es un mecanismo de optimización de los servicios públicos; y, funciona como estrategia del cambio político y social. ; The transformation of the legal and political Ecuadorian order expressed in Constitution of Ecuador of 2008 demands to reassess the analysis of Law parting form new hermeneutical and technicalbasis that go beyond the methods of the Historical School and those of Classic Legal Positivism, whichhave served for the study of Law. New judges, new operators of justice and active citizens are required in order to deploy the garantist mechanisms of rights. In this context, for the Ecuadorian Constitution,the training of judges has a triple dimension: the recognition of public servant's right to training andcapactitation for their enrolment, permanence and promotion within public service; as a mechanism ofoptimization of public service; and, it works as a strategy of political and social change.

Los Estados son multiculturales. A lo largo de la historia, las respectivas estructuras jurídicopolíticashan debido adaptar diferentes mecanismos para manejar la convivencia entre grupos culturalmentedistintos al interior de sus fronteras. Sin embargo, en la modernidad asistimos al surgimiento deparadigmas unificadores de la diversidad política, en los que, por la dinámica del poder, tambiénquedó atrapada la diversidad cultural en medio de Estados unitarios, necesitados de centralismo estataly manejo hegemónico del poder. La construcción de Estados nacionales significó entronizar la ficcióndel estado monocultural, el mismo que se concreta en diversas políticas internas, y de la comunidadinternacional, encaminadas a fortalecer la unicidad estatal y con ello, la cultura nacional. En las cuatroúltimas décadas, las políticas estatales multiculturales han debido modificarse a causa de la emergencia dedemandas y conflictividades de origen étnico-cultural, lo que justifica una revisión de la gama de medidasque se adoptan para combatirlas, domesticarlas o convivir con ellas, con el ánimo de identificar aquellas conmayor vocación democrática. ; National States are multicultural. Throughout history, the particular political and legal structureshave been forced to adapt different mechanisms in order to manage the coexistence of culturallydistinct groups, within the State's borders. Nevertheless, in the modern age we are witnesses of the emergenceof unifying paradigms of political diversity, in which, due to the dynamic of power, cultural diversitygot trapped within unitary States, which needed centralization and the hegemonic exercise ofpower. The construction of National States meant the reification of mono-cultural State fiction, the sameState that can only concrete itself in the midst of internal political diversity; it also meant the reificationof an international community, which, together with the mono-cultural state fiction, headed towards thefortifying the national states' unity and, with this, a monolithic national culture. In the last four decades, the governmentalmulticultural policies have been forcibly modified, due to the emergence of demands and conflictswith ethnic and cultural origins. This justifies a review of the array of measures adopted to counter,domesticate or co-exist with these ethnically produced conflicts, with the intention of identifying thosemeasures that have a more ample democratic vocation

La justiciabilidad de los derechos económicos, sociales, culturales y de la naturaleza representa el reto principal de la teoría y de las prácticas en torno a los derechos humanos en Latinoamérica, sobre todo en estos tiempos de crisis, restauración conservadora y regreso de la agenda neo liberal en la región. Sin embargo, en la última década el nuevo constitucionalismo latinoamericano ha experimentado un cambio radical respecto a la tradicional infravaloración de los derechos sociales y su exclusión como derechos subjetivos. El propósito del presente trabajo es analizar los procesos de justiciabilidad y las dimensiones de la exigibilidad del derecho al hábitat y a la vivienda en Ecuador (2007-2017), poniendo de relieve los limites históricos y las potencialidades políticas que el nuevo constitucionalismo latinoamericano ha representado en términos de justicia social. ; The justiciability of the Economic, Social, Cultural and Nature Rights represent the main theoretical and practical challenge in the human rights field in Latin America, specially in the actual time of crisis, conservative restoriation and return of the neoliberal agenda in the region. However, in the last decade, the Latinamerican New Constitutionalism has undergone a drastic shift in relation to the traditional social rights understimation and their exclusion as subjetive rights. The present work purpose is analysis of the justiciability procedures and enforceability dimensions of the the habitat and housing rights in Ecuador (2007-2017), emphasizing the historic constrains and political potencialities that the Latinamerican New Constitutionalism has represented from a social justice perspective.
