AbstractMany proponents of behavioural public policy work within a broadly consequentialist framework. From this perspective, the ultimate aim of public policy is to maximise utility, happiness, welfare, the satisfaction of preferences, or similar; and the behavioural aspect of public policy aims to harness a knowledge of human psychology to make this maximisation more effective. In particular, behavioural insights may be crucial to help policy-makers 'save us from ourselves' by helping citizens avoid falling into non-rational choices, for example, through framing effects, failures of will-power, and so on. But an alternative reading of the psychological literature is that human thoughts and actions are not biased from a rational standard, but are simply systematically inconsistent. If so, then utility and similar notions are not well defined either for individuals or as an objective of public policy. I argue that a different, contractarian viewpoint is required: that the determination of public policy is continuous with the formation of agreements we make with each other at all scales, from momentary social interactions, to linguistic and social conventions, to collective decisions by groups and organisations. Behavioural factors do not over-ride, but can (among many other factors) inform, our collective decision-making process. The point of behavioural insights in public policy is primarily to inform and enrich public debate when deciding the rules by which we should like to live.

AbstractFrijters et al. make a powerful and lucid case for a top-down approach to government, in which the maximization of wellbeing should be the ultimate goal. I argue, by contrast, for a bottom-up approach: that the variety of goals, plans, norms and rules that govern our lives should be the starting point for political discussion. From this standpoint, the goal of individual and collective decision-making of all kinds is the reconciliation of conflicting objectives and priorities on a piecemeal basis. The distinction between top-down and bottom-up approaches in political decision-making parallels debates between 'foundationalists' and 'coherentists' in epistemology.

AbstractConventional economic policy focuses on 'economic' solutions (e.g. taxes, incentives, regulation) to problems caused by market-level factors such as externalities, misaligned incentives and information asymmetries. By contrast, 'nudges' provide behavioural solutions to problems that have generally been assumed to originate from limitations in human decision making, such as present bias. While policy-makers have good reason for exploiting the power of nudges, we argue that these extremes leave open a large space of policy options that have received less attention in the academic literature. First, there is no reason that solution and problem need have the same theoretical basis: there are promising behavioural solutions to problems that have causes that are well explained by traditional economics, and conventional economic solutions often offer the best line of attack on problems of behavioural origin. Second, there is a wide range of hybrid policy actions with both economic and behavioural components (e.g. framing a tax or incentive in a specific way), and there exist many societal problems – perhaps the majority – that arise from both economic and behavioural factors (e.g. firms' exploitation of consumers' behavioural biases). This paper aims to remind policy-makers that behavioural economics can influence policy in a variety of ways, of which nudges are the most prominent but not necessarily the most powerful.
