Best interest of the child has been the prevailing principle of the custody legislations of most nations in the world. The tremendous shift from parental rights to parental responsibilities throughout the centuries had made the principle of best interests of the child as the utmost matter which parents must uphold in child upbringing. Despite the commitment to this principle is significantly enshrined in the United Nation Convention on Rights of the Child, the content and application of the principle differs across borders. Differences persist notwithstanding many countries have experienced a substantial shift over the last several decades in the types of custodial arrangements that are thought to best serve children's interests. The laws in Malaysia similarly uphold this principle but do not provide further deliberation on the principle itself. The principle is entirely developed by the courts through decided cases. Thus, this paper seeks to discuss the extent of the application of best interest of the child principle in custody disputes. In doing so, it attempts to provide an overview of the current laws and the approach of the Civil and the Shariah courts in Malaysia in applying the principle in determining custody disputes. For purposes of comparison, it briefly examines the legislations and the courts practices in Australia and England on this matter. The purpose is to determine the best standard to be adopted by Malaysia and to propose improvement to the laws whenever appropriate.

This paper addresses the situation and issues regarding indigenous knowledge among the Malay community at the Eastern Coast of the Peninsular Malaysia. The tacit knowledge of this community and knowledge sharing potentials the indigenous population is explored. The paper examines the opportunities of the members of the community to ascend into the economic mainstream and improve their quality of lives through participation in the industry based on their indigenous knowledge. Some suggestions are incorporated in the paper to yield a conceptual framework of tools for the agencies as support system to build a sustainable livelihood and heritage preservation of the rural community.

Purpose– The purpose of this paper is to empirically explore issues in humanitarian aid and disaster relief (HADR) missions and examine the effects of selected factors on mission success. The paper focusses on organisational perspectives of the Malaysian army due to their extensive experience in HADR operations.Design/methodology/approach– Interactions among three broad factors namely human resource, logistics and coordination, as well as their effects on mission performance, were examined. A qualitative approach was chosen because it allowed for an exploratory yet a more in-depth analysis of the issues.Findings– Results suggest that while the effects of logistics and coordination on mission success appear to be direct, human resource influences it in a more indirect manner. Additionally, from a military viewpoint, HADR teams are also challenged by factors which are less controllable such as public support and local infrastructure.Research limitations/implications– The study has contributed to knowledge by proposing a more refined model of HADR operations performance which highlights relationships not adequately studied before. Based on the model, a quantitative study can be undertaken in the future to determine the relative effect of each factor.Practical implications– Among the areas of HADR operations that will benefit from the study are human resource and cross-cultural management, communication and interpersonal relations and information technology.Originality/value– Military perspectives of HADR missions are shared in the paper, which enrich current understanding of issues faced in such operations. The paper should also serve as an impetus for greater empirical research among scholars concerned with organisational perspectives in HADR operations performance.

This study aims to 1) identify and describe agencies' role in helping psychiatric patients and 2) evaluate whether there is a synergy in building a concrete framework for the patients. Semi-structured interviews were conducted with eight mental health experts. The data were transcribed, and thematic analysis was performed using NVivo software. Findings revealed that empowering the patients was one of the strategies to assist them. Nevertheless, the multisectoral collaboration did not translate well within the aid networks despite the efforts by the government agencies to bridge their services to the patients.
