Welcherart Normen sind Menschenrechte? Wie unterscheiden sich Menschenrechte von individuellen Rechten und von allgemeinen Forderungen der politischen Gerechtigkeit? Gibt es transnationale Menschenrechte? In ihrer Antrittsvorlesung diskutiert Christine Chwaszcza grundlegende Fragen einer philosophischen Theorie der Menschenrechte. In kritischer Auseinandersetzung mit individualrechtlichen und interventionistischen Auffassungen von Menschenrechten entwickelt sie eine institutionell-politische Interpretation, die die spezifische Funktion von Menschenrechten im Kontext nationalstaatlicher Institutionen und im Kontext des Völkerrechts sowie der Praxis der internationalen Beziehungen miteinander verbindet, ohne normativ relevante Unterschiede der institutionellen Struktur der beiden Ebenen zu verwischen. Eingehend diskutiert werden dabei der Zusammenhang von Menschenrechten und Rechtsstaatlichkeit, Menschenrechten und Demokratie sowie Menschenrechten und transnationaler Intervention.

Majority rule is an essential element of the institution of democratic government. In three steps, I will explore the conditions of its acceptance as a mechanism of pure procedural legitimacy. Starting from H.L.A. Hart's analysis of the concept 'rule', I will argue that the validating conditions of rules are not normativ beliefs or reasons, but essentially social patterns of conduct and reasoning that manifest themselves in political agency and discourse. Secondly, I will outline a normative rationale that defends majority rule as a source of genuinely 'political' legitimacy under conditions of social pluralism. Finally, I will explain why majority rule's legitimating potential requires that political agency and discourse accept the separation of the political sphere from private spheres.

Economic migration is on the rise. It generates forms of temporary migration, which differ from both traditional settler migration and the status and needs of refugees. How should liberal-democratic societies respond to those new demands on immigration? Christine Chwaszcza develops an innovative transnational normative framework that integrates debates on citizenship, democracy and post-national justice, in order to address questions concerning access to host societies, democratic inclusion, and family migration. She proposes a liberal-democratic approach that steers a middle course between cosmopolitanism and national closure. The book adresses readers from Political and Legal Philosophy, Social and Political Theory.

The concept of citizenship is ambiguous. It is sometimes understood as nationalitè (state citizenship), and sometimes as democratic citizenship. The two concepts obviously do not coincide, but the difference has rarely been explicated. As I will argue, the two concepts follow a different normative logic because they are embedded in different normative background systems, i.e. the international system of statehood as concerns state citizenship, and the liberal background rules of the principle of popular sovereignty as concerns democratic citizenship. Having separated the two concepts, I will explore some of the implications that the background rules of liberal democratic self-government have for the democratic inclusion of immigrants.

There is little agreement in contemporary political philosophy about how to conceive of human rights, except for a shared concern for freeing the concept of human rights from the legacy of traditional natural law theories. Even so, there is no place for anything like a reconciliation of Kelsen's political-legal theory and contemporary concepts of human rights. The reason is not that Kelsen's well-known and notorious criticism of various natural law traditions applies equally to contemporary philosophy of human rights, but that Kelsen's account of democracy is incompatible with the idea of human rights.

Die zweite These kritisiert je ein Argument von J. Carens und R. Goodin, die für uneingeschränkt "offene" Grenzen plädieren, und verteidigt demgegenüber die Auffassung, dass Inklusions- und Exklusionsstandards für citizenship normativen Restriktionen unterliegen, dass aber die zulässigen Kombinationen verschiedener Kriterien normativ unterbestimmt sind. Die dritte These stellt zwei Immigrationsbedingungen zur Diskussion, die sich aus einer normativen Auffassung der Demokratie ergeben, und argumentiert, dass die Respektierung des Prinzips der Volkssouveränität die Entscheidung, welche der gerechtfertigten Kombinationen im Einzelnen gewählt werden soll, über ein demokratisches Verfahren getroffen werden sollte.

(2) If the answer to that question is yes, then which normative standards and restricts should the law follow? Following a human rights perspective, the first thesis of this essay gives a positive answer to question (1). The second thesis on the one hand criticises an argument of J. Carens and R. Goodin, who plead in favour of unrestricted "open" borders, and on the other hand defends the view that inclusion and exclusion standards for citizenship are governed by normative restrictions, while the legitimate combinations of different criteria are normatively determined. The third thesis discusses two requirements for immigrations, which follow from a normative perspective on democracy. It further argues that in respecting the principle of popular sovereignty, the decision which one of the legitimate combinations should be chosen in particular cases, should be chosen by the a democratic process.

Der Aufsatz verteidigt die These, dass rein prozedurale Verfahren kollektiver Entscheidungsfindung eine eigenständige Quelle von Legitimität in liberalen Konzeptionen demokratischer Selbstherrschaft bezeichnen.

Der Begriff der Menschenrechte ist eng verbunden mit der Entwicklung der Institution von Staatlichkeit und das liberal Idel eines demokratisch verfassten Rechtsstaats. Der Essay zeigt die Verbindung auf und kritisiert Versuche, Menschenrechte als vor- oder ausser-politische Rechte zu konstruieren.
