Résumé L'Esprit des lois a immédiatement intéressé les Anglais, qui ont très vite traduit l'ouvrage. En entier par T. Nugent ; mais auparavant, les chapitres concernant l'Angleterre ont connu une version distincte, par un auteur qui, certainement, n'est pas Nugent ; E. C. Mossner suggère que Hume a pu jouer un rôle actif dans sa publication. Sans affirmer que Hume soit l'auteur de la traduction, on peut être saisi par des concepts communs avec ceux de Hume et des traits voisins de ceux des Essais moraux, politiques et littéraires concernant l'Angleterre et la France.

Résumé Curieusement, les thèses juridiques et politiques de Montesquieu, que Bentham pouvait s'imaginer avoir vaincues sur les fronts différents mais cohérents des passions, de la preuve en droit, de la liberté individuelle et de la division des pouvoirs, l'utilitarisme les retrouvera en face de lui, quand Stuart Mill, quelques décennies plus tard, s'avisera d'en tenter une synthèse avec le libéralisme qui invoque comme valeur irréductible, quoiqu'elle soit très vague, la liberté individuelle.
