"Since its inception in 2001, the International Criminal Court (ICC) has been met with resistance by various African states and their leaders, who see the court as a new iteration of colonial violence and control. In Affective Justice Kamari Maxine Clarke explores the African Union's pushback against the ICC in order to theorize affect's role in shaping forms of justice in the contemporary period. Drawing on fieldwork in The Hague, the African Union in Addis Ababa, sites of post-election Violence in Kenya, and in Boko Haram's circuits in Northern Nigeria, Clarke formulates the concept of affective justice--an emotional response to competing interpretations of justice--to trace how affect becomes manifest in judicial practices. By detailing the effects of the ICC's all African-indictments, she outlines how affective responses to this call into question the 'objectivity' of ICC's mission to protect those victimized by violence and prosecute perpetrators of those crimes. By taking up the challenge of documenting how human rights values are embedded in rule of law movements to produce a new language of international justice that competes with a range of other formations, this book explores how notions of justice are negotiated through everyday micropractices and grassroots contestations of those practices. These micropractices include speech acts that revere the protection of international rights, citation references to treaty documents, the brokering of human rights agendas, the rewriting of national constitutions, demonstrations of religiosity that make explicit the piety of religious subjects, and ritual practices of forgiveness that involve the invocation of ancestral religious cosmologies - all practices that detail the ways that justice is made real

AbstractContemporary justice‐making processes often focus on reconciliation or legal retribution, but not on the complexity of victimhood beyond individual subjectivity or refusals of state propositions for social repair. In Colombia, where drug cartels and state‐sponsored violence had terrorized the population for over fifty years, it was not forgiveness and acceptance that punctuated the turn of the twenty‐first century, but the refusal to reconcile with the state's duplicity regarding the disappearance and death of thousands. This essay illustrates how irreconciliation as an affective sentiment is taking shape in Colombia through forms of reattribution that take the form of victim visibilizations. In analysing the strategic use of victim visibilizations as a refusal of state accountability, their expansion of the notion of victimhood, and their politics of irreconciliation, I show how even with the state's remorse‐driven discourses, the public's understanding that political, judicial, and social accountability was not possible and pushed them to chart new strategies for disclosure and healing.

AbstractThis article contributes to contemporary debates in the anthropology of international justice by exploring how narratives about the International Criminal Court have been applied, understood, and contested. It traces the way that justice is materialized and made legible as a domain of practice that is predicated on deeply embedded racialized logics, which are themselves obscured in the process. The article focuses on how bodies, psychologies, and social imaginaries come together to produce the terms on which justice is materialized, disaggregated, ruptured, and made legible again. This is demonstrated through the introduction of "affective justice" as a framework for understanding justice as a social practice. Through several ethnographic examples, this article illuminates how embodied affects at the micro level underpin emotional regimes that are expressed in a diversity of social practices, which then have a collective capacity to influence notions of justice at the macro level. The examples illuminate how international justice assemblages interact to constitute affective justice in three interrelated domains: technocratic practices, psycho‐social embodied performances, and emotional regimes. When examined through anthropology of international justice lenses, each of these domains offers insights into how people draw upon racial imaginaries to produce and refashion justice through practice.

This essay explores Siba Grovogui's publication of Beyond Eurocentrism and Anarchy: Memories of International Order and Institutions as a way to ponder how histories of international relations are told. Clarke considers Grovogui's central point concerning the relationship between Western intellectual anxieties and postcolonial methods and modes of thought. One domain for interrogating the contemporary significance of the work is the call for new ontologies and interpretive humility. This commentary examines these new ontologies through the rethinking of ways that agents engage in particular political projects through an examination of the way that particular forms of meaning production are invigorated through communicative forms that can involve critical shifts to the moral order. Finally, the essay examines the shifts related to the formation of the "Responsibility to Protect" doctrine and the related aesthetic modalities that are changing the way mainstream adherents understand new democratic forms of participation. This example represents an attempt to consider what this means for the way we understand the transformation of contemporary democracy and how Grovogui's work has set the stage for these transformations.
