Abstract:The Spanish Constitution of 1978 opt for a participatory model, which is reflected in articles 7 and 9, in title VII (Economy and Finance) and, in particular, article 129 which seems to contain a revolutionary programme for the Economy and the companies, and the workers access to the property. However, there has been no political will to develop the full potential of the Constitution. Even declined the participatory trend, especially in the social and economic field. ; Resumen:En el texto de la Constitución española de 1978, se opta por un modelo participativo, que se refleja en los artículos 7 y 9, en el título VII (Economía y Hacienda) y, en particular, el artículo 129 que parece contener un programa revolucionario en relación con la economía y la empresa y el acceso de los trabajadores a la propiedad. Sin embargo, no ha existido la voluntad política de desarrollar toda la potencialidad de la Constitución. Las tendencias del constitucionalismo en el siglo xxi están sometidas a innovaciones y cuestionamientos tanto por la crisis de conceptos antaño fundamentales —soberanía, ley, representación— cuanto por la valoración creciente de la democracia y los derechos y libertades, identificados con el modelo constitucional. Otra corriente pretende centrarse en los mecanismos de control y límites al poder. La descentralización territorial y la integración supranacional influyen en este constitucionalismo que debe abordar la pugna entre religión y laicismo, a la vez definir nuevos conceptos para sustituir a otros, ya obsoletos.Trends in the xxi century constitutionalism are subject to innovations and thus questioning the fundamental concepts crisis once — sovereignty, law, representation — as by the growing appreciation of democracy and human rights and freedoms, identified with the constitutional model. Another common aims to focus on control mechanisms and limits to power. The territorial decentralization and the supranational integration influence this constitutionalism must address the conflict between religion and secularism, while defining new concepts to replace other, obsolete.

At the present times there is some kind of fatalism about the difficulties to approach the crisis in the European Union, about the possibility to approach the difficult environment with a single voice. Not strangers to these difficulties are external speculative practices that hover over the Union, increasing the fear of a kidnapping serving foreign interest. To intensify European citizens participation and to increase their sense of identity seem to be the most suitable reactions to serve, not only to the European interests but, specially, to the values of democracy and human dignity as well as to guarantee the rights and freedoms that are fudamental to European construction. ; En la hora presente existe un cierto fatalismo sobre los problemas para abordar la crisis en la Unión Europea y sobre la estrategia para crecer en la integración de la Unión y abordar con una voz común las dificultades del entorno. No es ajena a esta dificultad las prácticas especulativas externas que se ciernen sobre la Unión que acrecientan el temor de un rapto al servicio de intereses foráneos. El intensificar la participación de la ciudadanía europea e incrementar su sentido de identidad pareciera la reacción más adecuada que sirva no sólo a los intereses europeos sino especialmente a los valores de democracia, dignidad de la persona y garantías de sus derechos y libertades que son fundamentales en la construcción europea.At the present times there is some kind of fatalism about the difficulties to approach the crisis in the European Union, about the possibility to approach the difficult environment with a single voice. The State has became one of the most complex political organization in the political story and an important instrument for social and regional integration in to safeguard fundamental rights, in addition to a legal restriction of power according to the rule of law. National State is in crisis as a result of globalization, the problems scale and the new leading rule of international organizations. At the same time supranational organizations in this new international juridical order, will have to face up to principles, warranties and values of a democracy under the rule of law. This is the point in which we consider why this debate about European and Latin America is so important. ; El Estado ha supuesto una de las organizaciones políticas más complejas de la historia política y en su dimensión constitucional un instrumento eficaz para la garantía de los derechos y la limitación jurídica del poder en la forma de Estado de Derecho. Viene, hace tiempo, considerándose que el Estado nacional se encuentra en crisis y un factor de aceleración de esta crisis ha sido el fenómeno de la globalización y la dimensión planetaria de los problemas y el protagonismo de nuevas organizaciones internacionales. Al mismo tiempo las organizaciones supranacionales de integración de Estados han sido un instrumento para la mejor inserción en el nuevo orden jurídico internacional y posiblemente desde ellas se tendrán que realizar los principios, valores y garantías del Estado de Derecho y su proyección social y democrática. Las garantías de independencia de la institución del Defensor del Pueblo son fundamentales para la autonomía de su funcionamiento y el prestigio ante los ciudadanos. Su estatuto legal así lo reconoce y se refuerza por las mayorías cualificadas, para su nombramiento. Ahora bien, siempre han existido algunas tentativas de interferencias por los partidos políticos, puestas en evidencia por una última crisis en esta relación. Todo ello nos lleva a señalar la necesidad de reforzar la independencia de esta magistratura, sostenida, en buena medida, en su autoritas moral.
