Six months later, the new Ministry of Higher Education and Research rolled back the reform and abolished the newly created section of criminology. Because French university governance remains centralized and corporatist, any project that transforms an interdisciplinary field of research into a fully-fledged academic discipline is difficult to carry out, all the more when the latter bears a political and utilitarian dimension as criminology does. It comes then as no surprise that in the hyper-disciplined French university, the disciplinary enterprise of institutionalising criminology is fraught with difficulties, not the least being the existence of an undisciplined academia.

Conceptualisée par les philosophes existentialistes, la notion d'engagement désigne le mode d'existence de celui qui choisit de s'impliquer activement dans le cours du monde et de se mettre au service d'une cause pour transformer la réalité. Associé notamment à la figure de Jean-Paul Sartre, l'intellectuel engagé renonce à sa position de spectateur pour prendre part aux conflits de son temps et défendre les sans-voix. Dans cette perspective, « l'engagement de la doctrine » sonne comme un oxymore, rapprochement improbable de termes aux définitions contradictoires. En effet, la doctrine, définie comme « littérature du droit », et par extension comme collectivité des auteurs d'ouvrages juridiques, ne semble pas pouvoir être sujet d'engagement. En tant que corps social, elle ne présente pas une cohésion suffisante pour engager collectivement ses membres, et si certains, professeurs, avocats ou juges, n'hésitent pas individuellement à s'aventurer en politique, c'est comme simples citoyens. Quant à la doctrine entendue comme discipline scientifique, elle consiste essentiellement en une description systématique du droit positif. Le corpus doctrinal, somme d'opinions juridiques émises par les auteurs, est un espace de controverses techniques et théoriques, mais il n'autorise que marginalement l'expression ouverte de convictions politiques. Pourtant, à y regarder attentivement, il n'est pas certain que la science du droit, telle qu'elle s'élabore dans nos facultés, puisse se concevoir sans une certaine forme d'engagement. La doctrine juridique présente en effet, de manière discrète mais certaine, tous les traits d'une « pensée engagée » défendant des valeurs et agissant sur le monde. La démonstration de cette hypothèse, qui peut être apportée par l'analyse de contenu de n'importe quel champ du corpus doctrinal, le sera ici à partir d'extraits de manuels, articles et fascicules d'encyclopédies juridiques, relatifs au droit de la drogue, et plus précisément aux normes applicables au consommateur de stupéfiants.

EU Criminal Justice and the Challenges of Diversity examines how questions of cultural difference between Member States' legal traditions are being constructed, addressed, and resolved in the development of the European Area of Freedom, Security, and Justice. The volume brings together leading socio-legal scholars and criminal justice professors from eight European countries and combines analytical approaches rooted in the social sciences with more normative approaches based on legal doctrine. It examines the construction of a common European criminal policy, explores some of the paths that may be followed by the EU in seeking to cope with national diversity in the field of criminal justice, and finally provides some insights into various forms of legal and cultural resistance offered by Member States to the European harmonisation process. In so doing, it bridges disciplinary boundaries between law and social sciences, and draws in a range of perspectives from around Europe.
