The paper aims at reflecting on the judicial control of the discretionary measures in banking and financial fields exercised by the EU Courts, as well as the 'quasi-judicial' control, in the same fields, exercised by the Boards of Appeal. Therefore, the present article firstly discusses the EU Courts' general approach over discretionary acts, assessing the peculiarities of the cases related to decisions taken by banking authorities. Secondly, the papers assessesthe 'new' means of quasi-judicial accountability, i.e. SRB Appeal Panel and the ESAs JBoA, their jurisprudence vis-à-vis discretionary choices of EU banking authorities and whether and how their role could be enhanced for improving a greater accountability. Finally, the article discusses
the possible evolution of EU Courts in reviewing banking law, particularly after the 2015-2019 Reforms of CJEU Statute (and those currently ongoing).

Il contributo rappresenta una rielaborazione del progetto "Dove va l'Europa? Percorsi e prospettive del federalizing process europeo" con cui il Gruppo di ricerca composto dalla Sapienza –Università di Roma, l'Università degli Studi di Milano, l'Università degli Studi di Torino e l'Alma Mater Studiorum–Università di Bologna ha partecipato con esito positivo al Bando PRIN 2017. Lo scopo di tale progetto è quello di comprendere le prospettive reali del processo di integrazione attraverso un'analisi scientifica di quelli che sono allo stesso tempo i suoi aspetti fondanti e problematici e a cui fanno capo i profili di ricerca che sono stati individuati in vista del conseguimento degli obiettivi del progetto.

Gli autori offrono una lettura critica della sentenza del Tribunale costituzionale federale tedesco del 5 maggio 2020, a tenor della quale la Banca centrale europea (BCE) dei tempi di Draghi avrebbe operato al di là delle sue competenze, confondendo la "politica monetaria" (che fa parte delle competenze esclusive dell'Unione) con la "politica economica" (di cui l'Unione al più assicura il coordinamento dettandone gli indirizzi di massima.
