The paper examines the amendment to the Organic Constitutional Law of Political Parties regarding the inclusion of freedom of information as a right of which party members are entitled. As it is a matter reserved for the internal regulation of political parties, all legally constituted parties are researched so as to determine whether or not they have rules that enable exercising of the right. The research shows that only a minority of political parties have regulations that go beyond the law. However, important omissions are observed at the level of parties' regulations. The paper concludes that the absence of adequate internal regulation for the exercise of the right may hinder access to party information by its members. ; El artículo analiza la reforma a la Ley Orgánica Constitucional de los Partidos Políticos en materia de derecho de acceso a la información partidaria, dando cuenta de la incorporación de este derecho como un derecho de titularidad de los afiliados a un partido. Al constituir una materia reservada a la regulación interna de los partidos políticos, se investigan todos los partidos legalmente constituidos para determinar si cuentan o no con reglas que habiliten el ejercicio del derecho. La investigación constata que solamente una minoría de partidos cuentan con normativas que van más allá de la regulación legal. Sin embargo, se observan importantes omisiones a nivel de la regulación partidaria. El texto concluye que la ausencia de una regulación interna adecuada para el ejercicio del derecho puede obstaculizar el acceso a la información de los partidos por parte de sus afiliados.

The paper examines the inclusion of legitimate interest in the reform of personal data protection legislation in Chile. First, it describes the basic elements of legitimate interest as a basis for lawful processing of personal data. Next, it reviews how the bill amending Law 19,628, On the Protection of Privacy, seeks to include legitimate interest. Based on this, four relevant factors that must be considered in the reform of the law are analyzed to converge with international standards in matters of legitimate interest. The text concludes with recommendations for the regulation of legitimate interest in the legislative reform to Law 19,628. ; El texto examina la inclusión del interés legítimo en la reforma a la legislación sobre protección de datos personales en Chile. Primero, describe los elementos básicos del interés legítimo como base de licitud para el tratamiento de datos personales. Luego, revisa cómo el proyecto de ley que reforma la Ley 19.628, Sobre Protección de la Vida Privada, busca incluir el interés legítimo. A partir de ello, se analizan cuatros factores relevantes que deben ser atendidos en la reforma de la ley, con el objeto de converger con los estándares internacionales en materia de interés legítimo. El texto concluye con recomendaciones para la regulación del interés legítimo en la tramitación legislativa de la reforma a la Ley 19.628.

The article examines the concept of legitimate interest as a lawful basis for processing personal data. First, the concept of legitimate interest and its connection with the principle of lawfulness of processing personal data is developed. Second, the text examines the European and Spanish sources of the concept of legitimate interest. Finally, it analyzes the status of legitimate interest in Chilean legislation, both under Law 19.628, On the Protection of Privacy, and in banking legislation. The paper concludes that the concept of legitimate interest has been adequately developed in comparative law and that, in the event of amending Law 19.628, such standards should be considered in their general reception under Chilean law. ; El texto examina el concepto de interés legítimo como fuente de licitud para el tratamiento de datos personales. Primero, se desarrolla el concepto de interés legítimo y su conexión con el principio de licitud del tratamiento de datos personales. The text analyses the main factors, both legal and institutional, that have enhanced the autonomy of Carabineros. The origin of the normative framework that regulates the armed institution will be examined, considering its historical evolution since the period of the Chilean civic-military dictatorship, and taking into account the constitutional, organic constitutional laws, legal and administrative regulations. Although the constitutional reforms of 2005 modified a large part of the political-institutional autonomy of the Carabineros, the paper concludes that the infra-constitutional regulation preserves important spheres of operational-functional autonomy of this branch of the Chilean police. ; El texto analiza los principales factores, tanto legales como institucionales, que han potenciado la autonomía de Carabineros. Se examina el origen del marco normativo que regula la institución armada, considerando su evolución histórica desde el período de la dictadura cívico-militar chilena, y atendiendo a la regulación constitucional, orgánico constitucional, legal y reglamentaria. Si bien las reformas constitucionales del año 2005 modificaron gran parte de la autonomía política-institucional de Carabineros, el trabajo concluye que la regulación infraconstitucional preserva importantes espacios de autonomía operativa-funcional de esta rama de la policía chilena.

This work analyzes the itinerary for constitutional change that President Michelle Bachelet recently announced. Along with a presentation of the process, this work critically assesses some of its stages. It mainly contends that the set of institutional regulations it assumedregulations that were taken from current constitutional rulesmakes it impossible to talk, at least from a theoretical perspective, of a genuine constituent process. This work also offers a democratically adequate reading for the process, so that it will make possible a dialogue between the current institutions sought to be replaced and the mechanism for constitutional change, without subjecting the latter to the former. ; El presente trabajo analiza el itinerario de cambio constitucional propuesto por la Presidenta Michelle Bachelet. Junto con una descripción del mismo, se discuten, críticamente, varias de sus etapas. En lo principal, se objeta el conjunto de cerrojos institucionalmente vigentes que harían imposible, al menos desde una perspectiva teórica, hablar de un proceso genuinamente constituyente. El trabajo ofrece, al mismo tiempo, una lectura democráticamente adecuada para que el proceso permita un diálogo entre la institucionalidad que se pretende abandonar y el mecanismo con el que se busca el cambio constitucional, sin que las primeras limiten al segundo.
