El documento electrónico, como medio de prueba, cobra vital importancia en los últimos años, porque cada vez es más frecuente el uso de medios tecnológicos para la comunicación y celebración de negocios jurídicos. Este trabajo realiza una aproximación conceptual al mensaje de datos y su desarrollo en la legislación colombiana, así mismo, se hace una diferenciación entre el mensaje de datos y el documento electrónico, pues es este último en el cual se centra el artículo y a la vez comporta el carácter de convertirse en prueba y para ello también se hace referencia el principio de equivalencia funcional. De igual manera se estudia el valor probatorio que se le otorga al documento electrónico, indicando algunas herramientas que este le puede aportar al proceso judicial. ; The electronic document, as a means of proof, has become vitally important in recent years, because the use of technological means for communication and holding of legal business is increasingly frequent. This work makes a conceptual approach to the data message and its development in colombian legislation, likewise, a differentiation is made between the data message and the electronic document, since it is the latter on which the article focuses and at the same time it involves the character of becoming a test and due to this, the principle of functional equivalence is also referred to. In the same way, the probative value granted to the electronic document is studied, indicating some tools that it can contribute to the judicial process. ; Magister en Derecho Privado ; Maestría

Sex and sexuality have always had a place at the heart of the development agenda - from concerns regarding population and environment, to practices in education and efforts for protecting reproductive health and rights. Yet this agenda has largely focused on negative dimensions of sexuality - disease, risk, violation - rather than positive aspects, including rights to sexual fulfillment, wellbeing and pleasure. The shift towards a rights-based approach to development has brought the human rights dimensions of sexuality into clearer view, and consequently the need to address discriminatory laws and violations of the human rights of those whose sexual identity and practices diverge from dominant sexual orders/norms. This book offers compelling insights into contemporary challenges and transformative possibilities of the struggle for sexual rights. It combines the conceptual with the political, and offering inspiring examples of practical interventions and campaigns that emphasize the positive dimensions of sexuality. It brings together reflections and experiences of researchers, activists and practitioners from Brazil, India, Nigeria, Peru, Serbia, South Africa, Turkey, the UK and Zambia. From political discourse on sex and masculinity to sex work and trafficking, from HIV and sexuality to struggles for legal reform and citizenship, the authors explore the gains of creating stronger linkages between sexuality, human rights and development.
In October 2012, a new law was approved in Uruguay that allows abortion on demand during the first 12 weeks of pregnancy, 14 weeks in the case of rape, and without a time limit when the woman's health is at risk or in the case of foetal anomalies. This paper analyses this legal reform. It is based on 27 individual and group interviews with key informants, and on review of primary documents and the literature. The factors explaining the reform include: secular values in society, favourable public opinion, a persistent feminist movement, effective coalition building, particular party politics, and a vocal public health sector. The content of the new law reflects the tensions between a feminist perspective of women's rights and public health arguments that stop short of fully recognizing women's autonomy. The Uruguayan reform shows that, even in Latin America, abortion can be addressed politically without electoral cost to the parties that promote it. On the other hand, the prevailing public health rationale and conditionalities built into the law during the negotiation process resulted in a law that cannot be interpreted as a full recognition of women's rights, but rather as a modified protectionist approach that circumscribes women's autonomy. ; Fil: Wood, Susan. O artigo foi escrito entre 2009 e 2010 a partir de um convite feito pelas feministas indianas Meena Seshu e Laxmi Murthy para compor o livro Business of Sex (O Negócio do Sexo) de que eram editoras. O artigo está organizado em cinco blocos. O primeiro oferece um breve panorama do debate histórico sobre prostituição no Brasil. O segundo analisa tendências contemporâneas entre os anos 1970 e 1990. O terceiro aborda as relações entre feminismos e prostituição. O quarto analisa a expansão e legitimação de visões abolicionistas no país e o último bloco oferece uma seleção de visões de trabalhadoras sexuais, feministas e ativistas lésbicas sobre o problema da prostituição.
