En la provincia de Buenos Aires, la dificultad de separar administración y justicia se hacía visible en los jueces de paz de los partidos, cuyo nombramiento tenía estrecha relación con la burocracia local, una forma de estructuración social que ritualizaba conductas y comportamientos de acuerdo a códigos compartidos a los que la sociedad debía adecuarse en relación con la propiedad de la tierra, la consolidación de los pueblos y la expansión de la frontera. (Garavaglia, 2007: 228- 230) Por esto, es importante reconstruir el perfil de los sujetos que ejercieron el cargo de jueces de paz, para entender las lógicas que guiaron su designación y observar la dinámica y funcionamiento de la institución. Establecidas esas lógicas de designación, ha podido dilucidarse que fueron mudando en función al contexto y la situación de la ocupación del territorio (Di Gresia, 2010: 1-3). Pero tan importante como saber quiénes eran y cómo actuaban, es saber quién y cómo los elegía y los nombraba. La Constitución de 1873 buscaba la descentralización, separando las funciones judiciales y administrativas, logrando que la división de poderes republicana superara la teoría y se concretara a nivel local con municipalidades y una organización judicial cercana y accesible, para que el litigio se resolviera allí donde se producía. El juez de paz debía convertirse en la base del sistema judicial provincial y para ello era indispensable organizar un sistema municipal a cargo de jurisdicciones locales. Pensado así, el texto constitucional estableció que los jueces de paz fueran funcionarios exclusivamente judiciales y agentes de los tribunales de justicia - es decir que ya no eran presidentes de las municipalidades de la campaña - siendo electos directamente por electores calificados. La forma y tiempo de elección, así como la duración en funciones, debía ser establecida por una ley que fue promulgada el 23 de mayo de 1878, pero cuyos efectos fueron suspendidos -junto con los de la ley de Municipalidades- el 4 de septiembre, así como las elecciones de municipales y jueces de paz programadas. Es nuestro objetivo conocer el contenido de esa ley de organización de la Justicia de Paz, en especial en lo referente a la elección popular, para luego analizar el conflicto de poderes que se produjo en relación a su concreción y el papel que la Suprema Corte de Justicia jugó en su resolución. Como paso previo, realizaremos una pesquisa en la legislación anterior (incluida la Constitución del Estado de Buenos Aires de 1854) sobre las funciones y mecanismos de nombramiento de los jueces de paz, desde su creación en 1821. Para toda esta tarea recurrimos a la Convención Constituyente de 1870-1873, a los Registros Oficiales provinciales, a las notas del juzgado de paz de Exaltación de la Cruz (partido de la provincia) y cada poder y contiene como antecedentes los debates legislativos relacionados con la ley de elección de los jueces de paz. ; Facultad de Ciencias Jurídicas y Sociales
Resumen: En la segunda mitad del XIX la aceptación de la división de poderes, la separación de la moral y de la religión del derecho y el absolutismo de la ley, respondían a un proyecto donde lo justo estaba siendo definido por la legislación y la administración de justicia buscaba concebirse como poder independiente. En este contexto, la facultad de perdonar, heredada de la monarquía hispana como atribución del rey, pasó al pueblo, soberano en el sistema democrático, que lo delegó en sus representantes. Pero se generó entonces un conflicto entre la necesidad de modernizar el sistema penal, la abolición de la pena de muerte y la relación entre los poderes del Estado. El objetivo de este artículo es comprender y dimensionar el significado de esta facultad de perdonar que se concedió al gobernador de la provincia de Buenos Aires en 1877, año en que se sancionó la ley reglamentando la atribución del poder ejecutivo de conmutar penas. ; Abstract: In the second half of the 19th century the acceptance of the division of powers, separation of morality and religion of the law and the absolutism of the law, they were answering to a project where the just thing was being defined by the legislation and the administration of justice was seeking to be conceived as independent power. In this context, the power to forgive, inherited from the Spanish monarchy as the king attribution, went to the people, sovereign in the democratic system, which delegated it in its representatives. But a conflict was generated then between the need to modernize the criminal justice system, the abolition of the death penalty and the relationship between the branches of government. The aim of this article is to understand and measure the meaning of this power to forgive that it was granted to the governor of the province of Buenos Aires in 1877, when the law was passed regulating the allocation of executive power to commute sentences.
The historical documentary of the judiciary of the province of Buenos Aires, from the creation of power in 1821 to the present, is dispersed in different judicial, municipal and private archives throughout the province. To facilitate access and maximize utilization, we propose to build a virtual map of its location. For this we consider necessary a theoretical discussion about the role of the historian facing the archives, to meaning and guide our work. Focusing our attention on the second half of the nineteenth century, years of establishment of the provincial government and the formation of the judiciary, try to locate all documents preserved by the Historical Archive of the Province of Buenos Aires, related in some way or another with theadministration of justice, distinguishing what belongs to the background judiciary and that relates but belongs to other funds. ; El fondo documental histórico del Poder Judicial de la provincia de Buenos Aires, desde la creación del poder en 1821 hasta la actualidad, se encuentra disperso en distintos archivos judiciales, municipales y privados a lo largo del territorio provincial. A fin de facilitar su acceso y maximizar su utilización, proponemos conformar un mapa virtual de su ubicación. Para esto consideramos necesario partir de una discusión teórica en torno al rol del historiador frente al archivo, que de significado y oriente nuestra tarea. Centrando nuestra mirada en la segunda mitad del siglo XIX, años de constitución del Estado provincial y de la conformación del poder judicial, intentamos ubicar todos los documentos preservados por el Archivo Histórico de la Provincia de Buenos Aires, relacionados de alguna u otra forma con la administración de justicia, distinguiendo lo que pertenece al fondo Poder Judicial y lo que se relaciona pero pertenece a otros fondos.
La supresión de los Cabildos en 1821 llevó a la reorganización judicial a través de un esfuerzo pendular por resolver desde la legislación problemas coyunturales y formar un poder del Estado de la provincia de Buenos Aires. Este estudio tiene por objetivo aportar al conocimiento de la administración de justicia, estudiando los documentos que la afectaron entre 1810 y 1821, para rastrear las ideas que los motivaron y los cambios que aportaron. Para esto, plantearemos en primer lugar en qué consistió la ley de 1821; luego analizaremos cada documento desde 1810, para finalmente recuperar todos los aportes teóricos y de organización a la justicia provincial. Consideramos que en esta primera década se inició un proceso en que se buscaban superar las funciones establecidas por la Real Ordenanza de Intendentes y llegar así a la división de poderes, para lo cual era indispensable quitarle al Cabildo la función de Justicia, organizar la primera instancia letrada y la justicia de paz lega, sin necesidad de crear una Alta Corte como la de la Constitución de 1819, esperando a incorporarse en algún momento a un Estado Nación. ; The suppression of the town council in 1821 led to the judicial reorganization across a pendulous effort for solving from the legislation relating to the moment problems and forming a power of the State of the province of Buenos Aires. This study has for aim reach to the knowledge of the administration of justice, studying the documents that affected her between 1810 and 1821, to trace the ideas that motivated them and the changes that reached. For this, we will raise first of that the law of 1821 consisted; then we will analyze every document from 1810, finally to recover all the theoretical contributions and of organization to the provincial justice. Esta ponencia es la presentación del proyecto de tesis, que tiene por objetivo estudiar el proceso de constitución y consolidación del poder judicial, responsable de la administración de justicia, como integrante del Estado provincial, legitimador de su accionar político y mediador con la sociedad civil. La investigación se ubica en la provincia de Buenos Aires, entre 1853 y 1881, que sancionó su propia Constitución en 1854, en la que declaraba en su artículo 118 que el poder judicial sería independiente de todo otro en el ejercicio de sus funciones. Es decir que en esta provincia la consagración de la teoría de los poderes del Estado y la ley como definidora de lo que era justo, requirieron de la organización del poder judicial. El sistema judicial de la provincia de Buenos Aires comenzó su formación como poder del Estado a partir de la reforma rivadaviana y el proceso alcanzó su madurez entre 1853 y 1881, como parte fundamental del proyecto liberal, asentado sobre la autoridad de la ley. El poder judicial garantizaba la legitimidad del sistema político republicano de matriz liberal, pero la dependencia con el poder ejecutivo se mantuvo en parte, representada en el presupuesto, los nombramientos y los jurys. La organización judicial en formación incluyó al ámbito rural con una fisonomía institucional que tendía a consolidar la relación entre Estado y sociedad civil; ésta manifestaba sus necesidades a través de la opinión pública y el poder las interpretaba con el fin de legitimar su acción política. En este proceso de legitimación, el poder judicial era funcional al Estado, lo que se consolidó con el tiempo. La Constitución de 1873, a pesar de ser ideal en algunas de sus propuestas, dio protagonismo y efectividad a las instituciones judiciales que se formaron y pusieron en funcionamiento con una nueva concepción de justicia, que sin dejar de lado el derecho natural se consolidaba en una función más positiva, atenta a los derechos individuales y de propiedad. Para comprender el rol que jugó el sistema de justicia en la formación del Estado es necesario desenmarañar la compleja trama de relaciones entre el poder político y los magistrados, y a su vez entre ellos y la sociedad. Pero esto no se puede realizar sin conocer y comprender que entendían por justicia, y definir de qué forma organizaron su administración. En la realización de esta investigación atenderé a las soluciones que el ordenamiento jurídico debía brindar a una determinada sociedad, las instituciones que lo formaron y las ideas de quienes lo gestaron. El uso de la fuente judicial será fundamental para observar si la letra de la ley fue cumplida en la administración de justicia y de qué manera. Pero esa fuente judicial confirmará o no la aplicación de las leyes dictadas por el poder legislativo y los decretos emanados del ejecutivo, por ello será necesario reconstruir los organigramas del Poder Judicial a partir del estudio de los Registros Oficiales y los debates legislativos de la provincia. ; This paper is the presentation of the thesis project aims to study the process of establishing and strengthening the judiciary, responsible for the administration of justice, as a member of the provincial state, legitimizing their political action and mediator with civil society. The Judiciary in the rural area included training with the institutional features that tended to strengthen the relationship between state and civil society, stating its needs through the view to the public and interpreted in order to legitimize their political action. In this process of legitimation, the judiciary was functional to the State, which was consolidated over time. The Constitution of 1873, despite being ideal in some of its proposals, gave prominence and effectiveness of judicial institutions that were formed and put into operation with a new conception of justice, without ignoring the natural law was consolidated in a more positive role, listening to the individual and property rights. To understand the role played by the justice system in the formation of the state is necessary to unravel the complex web of relationships between political power and judges, and in turn between them and society . But this is not possible without knowing and understanding what they meant by justice, and to define how they organized their management. In conducting this research is to address the solutions to the legal system should provide to a particular society, the institutions that shaped him and the ideas of those who gave birth. The use of judicial power will be crucial to see if the letter of the law was fulfilled in the administration of justice and how. Es decir que en esta provincia la consagración de la teoría de los poderes del Estado y la ley como definidora de lo que era justo, requirieron de la organización del poder judicial. El sistema judicial de la provincia de Buenos Aires comenzó su formación como poder del Estado a partir de la reforma rivadaviana y el proceso alcanzó su madurez entre 1853 y 1881, como parte fundamental del proyecto liberal, asentado sobre la autoridad de la ley. El poder judicial garantizaba la legitimidad del sistema político republicano de matriz liberal, pero la dependencia con el poder ejecutivo se mantuvo en parte, representada en el presupuesto, los nombramientos y los jurys. La organización judicial en formación incluyó al ámbito rural con una fisonomía institucional que tendía a consolidar la relación entre Estado y sociedad civil; ésta manifestaba sus necesidades a través de la opinión pública y el poder las interpretaba con el fin de legitimar su acción política. En este proceso de legitimación, el poder judicial era funcional al Estado, lo que se consolidó con el tiempo. La Constitución de 1873, a pesar de ser ideal en algunas de sus propuestas, dio protagonismo y efectividad a las instituciones judiciales que se formaron y pusieron en funcionamiento con una nueva concepción de justicia, que sin dejar de lado el derecho natural se consolidaba en una función más positiva, atenta a los derechos individuales y de propiedad. Para comprender el rol que jugó el sistema de justicia en la formación del Estado es necesario desenmarañar la compleja trama de relaciones entre el poder político y los magistrados, y a su vez entre ellos y la sociedad. Pero esto no se puede realizar sin conocer y comprender que entendían por justicia, y definir de qué forma organizaron su administración. En la realización de esta investigación atenderé a las soluciones que el ordenamiento jurídico debía brindar a una determinada sociedad, las instituciones que lo formaron y las ideas de quienes lo gestaron. El uso de la fuente judicial será fundamental para observar si la letra de la ley fue cumplida en la administración de justicia y de qué manera. Pero esa fuente judicial confirmará o no la aplicación de las leyes dictadas por el poder legislativo y los decretos emanados del ejecutivo, por ello será necesario reconstruir los organigramas del Poder Judicial a partir del estudio de los Registros Oficiales y los debates legislativos de la provincia. ; This paper is the presentation of the thesis project aims to study the process of establishing and strengthening the judiciary, responsible for the administration of justice, as a member of the provincial state, legitimizing their political action and mediator with civil society. The research is located in the province of Buenos Aires, between 1853 and 1881, because despite having sworn not to the Constitution until 1860, passed its own constitution in 1854, which stated in Article 118 that the judiciary would be independent of any other in the exercise of their functions. This means that in this province the consecration of the theory of the branches of government and law as defining what was just, required the organization of the judiciary. The judicial system of the Province of Buenos Aires began his training as a power State from Rivadavia reform and the process reached maturity between 1853 and 1881, as a fundamental part of the liberal project, which sits on the authority of the law. The judiciary ensured the legitimacy of the political system matrix liberal Republican, but the dependence on the power axis remained in part, represented in the budget, appointments and jurys. The Judiciary in the rural area included training with the institutional features that tended to strengthen the relationship between state and civil society, stating its needs through the view to the public and interpreted in order to legitimize their political action. In this process of legitimation, the judiciary was functional to the State, which was consolidated over time. The Constitution of 1873, despite being ideal in some of its proposals, gave prominence and effectiveness of judicial institutions that were formed and put into operation with a new conception of justice, without ignoring the natural law was consolidated in a more positive role, listening to the individual and property rights. To understand the role played by the justice system in the formation of the state is necessary to unravel the complex web of relationships between political power and judges, and in turn between them and society . But this is not possible without knowing and understanding what they meant by justice, and to define how they organized their management. In conducting this research is to address the solutions to the legal system should provide to a particular society, the institutions that shaped him and the ideas of those who gave birth.
