The prospect of integrating the different legal systems for protecting fundamental rights in Europe calls for the European Union to adhere to the European Convention on Human Rights with the aim of mitigating the divergences and tensions between the European Courts, as well as those arising between the European and national courts. In addition, by doing so a minimum standard for protecting fundamental rights in Europe is defined, to which not only constitutional law but also, with equal standing, European Union law must be subject. ; La perspectiva de integración de los diferentes ordenamientos jurídicos en la protección de los derechos fundamentales en Europa exige que la Unión Europea se adhiera el CEDH con el fin de paliar las divergencias y tensiones entre tribunales europeos, así como de éstos con los nacionales. Asimismo quedará con ello definido el estándar mínimo de protección de los derechos fundamentales en el ámbito europeo, al que deberán someterse, de forma necesaria, no solamente los ordenamientos constitucionales sino, igualmente, el ordenamiento de la Unión Europea.

Thomas More's antityrannical and anti-absolutist thinking was professed with consistency and in his eminently legal education was influenced by Henri of Bracton and John Fortescue, who laid the foundation for his principal legal/political theses. Thomas More not only can be considered a precursor of the principle of religious tolerance and conscientious objection but also a man convinced of the need for natural justice. Here we will not only sketch the figure of Thomas More but also give an overview of his principal works to demonstrate how the duality of politics and religion cannot be explained without reference to the concept of natural-rational justice in his thinking. ; El pensamiento antitiránico y antiabsolutista fue defendido por Tomás Moro con gran coherencia, influido en su formación eminentemente jurídica por Henri de Bracton y John Fortescue, quienes le hacen vertebrar sus principales tesis jurídico-políticas. En este artículo, la autora debate sobre el derecho a decidir y más concretamente sobre si el referéndum en torno al futuro de Cataluña está prohibido en la Constitución española (CE). Se mantiene que sí que lo está en virtud del principio de indisolubilidad (art. 2.1. CE) y el de la soberanía nacional (art. 1.2. CE), sin olvidar los principios que caracterizan la democracia liberal española (arts. 1.1., 23.1, 9 y 10 CE). El artículo de Josep M. Vilajosana, titulado Democracia y derecho a decidir (2020) es tomado como base para el debate sobre esta cuestión. Se argumenta aquí cómo la interpretación evolutiva de los derechos democráticos vinculados a una concepción densa de la democracia no justifica la posibilidad de realizar un referéndum sobre la independencia de Cataluña, y todavía menos que puedan decidir unilateralmente los catalanes. Se destaca cómo la conciencia racial catalana ha servido de motor para el aumento del fervor secesionista, llegando a provocar, además de una contienda jurídica, una guerra de sentimientos y emociones. ; In this paper, the author engages the debate concerning the right to decide, specifically concerning whether the referendum on the future of Catalonia can be prohibited within the Spanish Constitution. It is maintained that the answer is yes, given the principle of indissolubility (art. 2.1 of the Spanish Constitution) and of national sovereignty (art. 1.2. of the Spanish Constitution), while still affirming the principles that characterize Spain as a liberal democracy (arts. 1.1, 23.1, 9, and 10 of the Spanish Constitution). La mutilación genital femenina (MGF) abarca todas aquellas actuaciones que alteren o causen lesiones intencionadamente a los órganos genitales femeninos sin que existan razones médicas que las justifiquen. En la actualidad la mutilación genital es una realidad que afecta a más de 140 millones de mujeres en todo el mundo, siendo sometidas en torno a 2 millones de niñas y adolescentes cada año. La práctica de la MGF está tipificada como delito en todos los Estados miembros de la Unión Europea. La actuación del poder legislativo español para dar respuesta a la MGF, en el contexto más amplio de la eliminación de las diferentes formas de discriminación contra la mujer a que le obligan los distintos compromisos internacionales contraídos por España, se ha plasmado en la aprobación de dos leyes. La primera de ellas, la L. O. 11/2003, de 29 septiembre, que modifica el Código penal, y en la cual tiene lugar la tipificación de un nuevo delito de mutilación genital mediante la nueva redacción dada al art. 149 del Código Penal. La segunda, la L. O. 3/2005, de 8 de julio, de modificación de la Ley Orgánica del Poder Judicial, para perseguir extraterritorialmente la práctica de la MGF. ABSTRACT: Many different versions of equality have been proposed and defended, but they can be organized around the emphasis that they give to three different perspectives: historical, economic, and remedial. The remedial perspectives expands on the historical perspective to consider the continuing effects of past discrimination. This perspective is most frequently invoked to justify programs of affirmative action. Here we focus on the programs of affirmative action in Spain in the last years within the legal framework of the European Union. I examine wether affirmative action measures, particularly quotas, violate the principle of equality.
