PurposeThe 50th anniversary of Fox's Beyond Contract and Man Mismanagement coincides with another vital contribution to the sociology of work from 1974: Braverman's Labor and Monopoly Capital. This article analyses these two scholars' complementary approaches to job design and the extent to which Fox's ideas influenced subsequent labour process thought.Design/methodology/approachThe article's methodological approach is a historiographical reading of Fox and Braverman's thought in the context of their times and later scholarship.FindingsThe article demonstrates that despite some noteworthy overlap with Braverman concerning scientific management, Fox's insights were marginal to later iterations of labour process analysis. It delves into the reasons for this relative neglect, providing an understanding of the dynamics at play.Originality/valueThis paper's value lies in its combined industrial relations and labour process historiography. It offers a fresh perspective on Alan Fox's relationship to the latter field of study.

Competitiveness agreements in France became a much discussed feature of company-level responses to the 2008 crisis and aftermath. Such innovations raise several issues in a context of multi-unionism, in terms of how different workplace unions of varying organisational cultures respond, but also the consequences for inter-union relations. It is observed that such dynamics are complicated by the representative reforms of 2008 which link local bargaining power to performance in workplace elections. Based on case study analysis of the crisis-ridden automotive industry, this article therefore examines how union responses to competitiveness bargaining are proceeding in light of the revised representative rules.

Ireland is rare among advanced economies in not having statutory trade union recognition legislation for collective bargaining purposes. The matter has been a source of policy contention over the years with attempts to resolve it encapsulated in the so-called 'Right to Bargain' legislation, introduced in 2001. This legislation has sought to circumvent statutory recognition in Ireland by putting in place an alternative mechanism for unions to represent members in non-union firms where collective bargaining is not practiced. This review, based on a mixture of empirical and documentary evidence, demonstrates that this legislation was moderately successful for a short period in generating pay rises, improved employment conditions and better access to procedures for union members in non-unionised firms. Indeed, in some respects, it was a superior institutional mechanism to a statutory recognition regime.

PurposeThis paper aims to examine the antecedent influences and merits of workplace occupations as a tactical response to employer redundancy initiatives.Design/methodology/approachThe data are based on analysis of secondary documentary material reporting on three workplace occupations in the Republic of Ireland during 2009.FindingsPerceptions of both procedural (e.g. employer unilateral action) and substantive (e.g. pay and entitlements) justice appear pivotal influences. Spillover effects from other known occupations may also be influential. Workplace occupations were found to produce some modest substantive gains, such as enhancing redundancy payments. The tactic of workplace occupation was also found to transform unilateral employer action into scenarios based upon negotiated settlement supported by third‐party mediation. However the tactic of workplace occupation in response to redundancy runs the risks of potential judicial injunction and sanction.Research limitations/implicationsAlthough operationally difficult, future studies should strive to collect primary data workplace occupations as they occur.Originality/valueThe paper identifies conditions conducive to the genesis of workplace occupations and the extent to which the tactic may be of benefit in particular circumstances to workers facing redundancy. It also contextualises the tactic in relation to both collective mobilisation and bargaining theories in employment relations.

This article shows how both employers and the state have influenced macro-level processes and structures concerning the content and transposition of the European Union (EU) Employee Information and Consultation (I&C) Directive. It argues that the processes of regulation occupied by employers reinforce a voluntarism which marginalizes rather than shares decision-making power with workers. The contribution advances the conceptual lens of 'regulatory space' by building on Lukes' multiple faces of power to better understand how employment regulation is determined across transnational, national and enterprise levels. The research proposes an integrated analytical framework on which 'occupancy' of regulatory space can be evaluated in comparative national contexts.

Non-union employee representation is an area which has attracted much interest in the voice literature. Much of the literature has been shaped by a dialogue which considers NERs as a means of union avoidance. More recently however scholars have suggested that for NERs to work in such contexts, they may need to be imbued with a higher set of functionalities to remain viable entities. Using a critical case study of a union recognition drive and managerial response in the form of an NER, this article contributes to a more nuanced interpretation of the literature dialogue than hitherto exists. A core component of the findings directly challenge existing interpretations within the field; namely that NERs are shaped by a paradox of managerial action. It is argued that the NER failed to satisfy for employees because of a structural remit, rather than through any paradox in managerial intent.

A growing literature has emerged on employee silence, located within the field of organisational behaviour. Scholars have investigated when and how employees articulate voice and when and how they will opt for silence. While offering many insights, this analysis is inherently one-sided in its interpretation of silence as a product of employee motivations. An alternative reading of silence is offered which focuses on the role of management. Using the non-union employee representation literature for illustrative purposes, the significance of management in structuring employee silence is considered. Highlighted are the ways in which management, through agenda-setting and institutional structures, can perpetuate silence over a range of issues, thereby organising employees out of the voice process. These considerations are redeployed to offer a dialectical interpretation of employee silence in a conceptual framework to assist further research and analysis.

peer-reviewed ; This article, drawing on the latest insights into organisational silence, considers how employers seek to withhold information and circumvent meaningful workplace voice when confronted with regulatory requirements. It offers novel theoretical insights by redefining employer silencing as characterised by the withholding of information and the restriction of workplace dialogue. In outlining three principal routes of non-compliance— avoidance, suppression, and neglect—we empirically illustrate the path to silence in the regulatory context of the European Union Directive establishing a general framework for informing and consulting employees. Rather than considering how employers utilised the regulations, as existing research considers, we look at how employers circumvented the regulatory space in three case studies in the United Kingdom and Ireland and the significant role of employer silencing as a tool for explaining this dynamic.
