Margaret Gilbert's approach to human rights asserts that these are demand-rights that may be moral or legal. As legal rights, human rights result exclusively from an international practice in which States hold a leading position. This paper offers a critique of Gilbert's prominent approach to conceptualising human rights as legal demand-rights. I hold here that her state-centric approach does not correctly represent the international practice of human rights and may reinforce the dominant role of States vis-à-vis the individual, which contradicts our contemporary understanding of human rights. If Gilbert's approach is followed in the way she has proposed, the realisation of these rights could be even more difficult. Such outcome can be avoided by accepting the dual (legal and moral) nature of human rights.
Sowohl aus juristischem als auch moralischem Blickwinkel sind Menschenrechte ein unerlässliches Element der aktuellen normativen Realität. Im Bereich der moralischen Philosophie gibt es die deutliche Tendenz, Menschen als Individuen für die einzigen Träger von Menschenrechten zu halten. Die Erfahrung zeigt uns dennoch, dass das Menschenleben sich in das Kollektive widerspiegelt und dass es Kollektive wie Staaten, indigene Völker usw. gibt, deren Existenz lebenswichtig für ihre Mitglieder ist. In Anbetracht der Wichtigkeit bestimmter Kollektive im Menschenleben befasst sich diese Arbeit mit der Frage, wie es möglich ist, kollektive Menschenrechte moralisch zu begründen. Die Arbeit besteht aus drei Teilen, die begrifflich miteinander zusammenhängen. Der erste Teil konzentriert sich auf die Festlegung eines Begriffs von Menschenrechten und die Hauptthese ist, dass Menschenrechte als moralische Rechte, als nicht-juristische Rechte vor allem verstanden werden sollten. Der zweite Teil legt die wichtigsten Argumente gegen die Idee kollektiver Menschenrechte dar und es wird ebenfalls erklärt, warum diese Argumente unzulänglich sind. Es handelt sich denn um eine indirekte Argumentation für kollektive Menschenrechte. Der dritte Teil bringt Argumente vor, die die Idee kollektiver Menschenrechte direkt unterstützen. In diesem Sinne wird hier eine direkte Argumentation für diese Rechte vorgelegt. ; Both from a legal and a moral perspective, human rights are an essential component of the current normative reality. In the field of moral philosophy there is a marked tendency to consider that human beings as individuals are the exclusive holders of human rights. Nevertheless, experience shows us that human life is also reflected in collectiveness and that there are collectives such as states, indigenous peoples and so forth, whose existence is vital for its members. Given the importance of certain collectives in human life, this dissertation deals with the question of how it is possible to morally ground the existence of collective human rights. The dissertation consists of three parts which are conceptually connected with each other. The first part focuses on establishing a concept of human rights and the basic thesis is that human rights must be understood primarily as moral rights, and not as legal rights. The second part presents the major arguments against the idea of collective human rights, while explaining why these arguments are inadequate. Thus, it is an indirect argumentation in favor of collective human rights. The third part sets out arguments that directly support the idea of collective human rights. In this sense, it presents a direct argumentation in favor of collective human rights.
Las sociedades más avanzadas de la actualidad se estructuran en torno a tres elementos normativos: el Estado de derecho, la satisfacción de las necesidades humanas básicas y la limitación de las desigualdades. Estos elementos están profundamente arraigados en la cultura, hasta el punto de que se espera que los ciudadanos subordinen plenamente sus diversos intereses y valores personales a un compromiso con el funcionamiento justo y equitativo de su sociedad. Esta arraigada expectativa normativa de imparcialidad es sorprendente: una madre que hace un favor a su propio hijo es ampliamente denunciada si lo hace en el desempeño de un cargo público. Por dura que pueda parecer esta condena del nepotismo, es una condición previa clave para las sociedades más exitosas que han existido hasta la fecha. Podría decirse que la supervivencia a largo plazo de la humanidad requiere un logro civilizatorio análogo en el plano global. Allí también, las normas y los acuerdos institucionales justos y equitativos pueden persistir solo si se espera que quienes se encargan de su diseño y funcionamiento sean estrictamente imparciales en la ejecución de sus funciones públicas y, por tanto, ampliamente denunciados por cualquier favoritismo hacia su país de origen. Como un mero reflejo de modus vivendi, el estado actual de las relaciones internacionales implica la expectativa contraria: que los agentes que operan a nivel supranacional actúen para promover los intereses y valores concretos de su Estado de origen.
