"Es ist umstritten, was man vom Begriff der Menschenwürde in verschiedenen normativen Diskursen erwarten kann. Der vorliegende Beitrag versucht daher zunächst zu inventarisieren, welche Fragen an ein gehaltvolles Konzept von Menschenwürde gerichtet werden müssen: So wird der Zusammenhang zwischen Menschenwürde und Menschenrechten, die Frage nach dem Träger der Menschenwürde, nach dem normativen Gehalt der Menschenwürde sowie nach den institutionellen und gesellschaftstheoretischen Aspekten der Menschenwürde thematisiert. Ob 'Menschenwürde' ein leerer oder gehaltvoller Begriff ist, hängt davon ab, inwiefern es gelingt, diese Fragen philosophisch verbindlich zu beantworten. Ferner geht es darum, eine Übersicht über die möglichen Interpretationen des Verhältnisses von Menschenwürde und Menschenrechten zu gewinnen. Abschließend wird in groben Zügen ein eigener konstruktiver Vorschlag skizziert, der den Kern der Menschenwürde im Schutz der Ermöglichung zu einer autonomen Lebensführung für alle handlungsfähigen Wesen sieht. "The history of human rights suggests that individuals should be empowered in their natural, political, political, social and economic vulnerabilities. States within the international arena hold each other responsible for doing just that and support or interfere where necessary. States are to protect these essential human vulnerabilities, even when this is not a matter of self-interest. This function of human rights is recognized in contexts of intervention, genocide, humanitarian aid and development. This book develops the idea of environmental obligations as long-term responsibilities in the context of human rights. It proposes that human rights require recognition that, in the face of unsustainable conduct, future human persons are exposed and vulnerable. It explores the obstacles for long-term responsibilities that human rights law provides at the level of international and national law and challenges the question of whether lifestyle restrictions are enforceable in view of liberties and levels of wellbeing typically seen as protected by human rights. The notion of radical passivity undoubtedly constitutes the burning question in the thought of French philosopher, Emmanuel Levinas. Committed to the claim that egoism and freedom cannot give birth to generosity, Levinas presents radical passivity as a necessary condition for ethical action understood as taking responsibility for the other. In approaching another, Levinas argues, 'something' has overflowed my freely taken decisions, has slipped into me unbeknownst to me (CPP, 145). This something, this 'other-within-the-self' makes the self vulnerable to the call of the other and therefore capable of taking the other's place, of substitution and sacrifice. Generosity and human fellowship, therefore, does not follow from a free rational consciousness capable of sympathy and compassion, but from a passivity 'inflicted' by an alterity at the heart of subjectivity. Levinas is not hereby saying that one should sacrifice oneself for others. He merely wants to account for its possibility. This multiperspectical volume brings together a host of renowned Levinas scholars in an attempt to critically reflect upon the ethical significance of radical passivity. Contributions cover the entire scope of this notion's evolution within Levinas's thought from its phenomenological roots to its culmination in what is often referred to as his confessional writings, the Talmudic Readings. In addition, this volume offers us a much needed critical revaluation of key issues in Levinas's thought which are, more often than not, uncritically assimilated or taken as matter of fact.
