The commitment of the courts to the essentials of the Seeger-Welsh formulation will serve to protect individuals and communities of faith in the emerging postmodern world from unwarranted regulation of religion at the hands of government. The same formulation may also protect the rights of atheists if an atheist can demonsrate that his or her beliefs constitute the most comprehsenive framwork by which s/he lives and guides and fundamentally directs her/his life. If this be so, then atheism should probably qualify as tantamant to or equivalent to religion for constitutional purposes. However, the Supreme Court should still take up this matter for clarification. D. Knaff

Der Beitrag beschreibt das Wechselspiel von Religion und Staat in den USA. Dabei gliedern sich die Ausführungen zur Religion im öffentlichen Leben in die Betrachtung von drei zu unterscheidenden, aber dennoch miteinander verbundenen Gesetzmäßigkeiten, die das Gefüge des amerikanischen Systems umfassen: So wird im ersten Schritt die institutionelle Trennung von Kirche und Staat dargestellt. So fordert die Verfassung, dass die Institutionen von Kirche und Staat nicht miteinander verbunden sind, voneinander abhängen oder funktional aufeinander bezogen sind. Der zweite Schritt veranschaulicht die Integration von Religion und Politik. Dies zeigt sich an der Tatsache, dass das amerikanische System die Teilhabe religiöser Stimmen am politischen Diskurs anregt. Der dritte Schritt beleuchtet abschließend die Akkommodation der Zivilreligion. Bei Zivilreligion handelt es sich um öffentliche Rituale, welche die Anknüpfung der politischen Ordnung an die göttliche Realität zum Ausdruck bringt. Alle Regeln, Gewohnheiten und Praktiken, die das einzigartige Verhältnis von Religion und Staat in den USA konturieren, können vorrangig, wenn auch nicht immer ausschließlich, einer dieser drei Kategorien zugeordnet werden.
