This book provides an analysis of how penal discourses are used to legitimate post-Cold War military interventions through three main case studies: Kosovo, Iraq and Libya. These cases reveal the operation of diverse modalities of punishment in extending the ambit of international liberal governance. The argument starts from an analysis of these discourses to trace the historical arc in which military interventions have increasingly been launched through reference to both the human rights discourse and humanitarian sentiments, and a desire to punish the perpetrators. The book continues with the analysis of practices involved in the post-intervention phase, looking at the ways in which states have been established as modes of governance (Kosovo), how punitive atmospheres have animated soldiers' violence in the conduct of war (Iraq), and finally how interventions can expand moral control and a system of devolved surveillance in conjunction with both border control and the engagement of the International Criminal Court (Libya). In all these case, tensions and ambiguities emerge. These practices underscore how punitive intents were also present in the expansion of liberal governance, demonstrating how the rhetoric of punishment was useful in legitimating Western state powers and recomposing the borders of the liberal world at the periphery. War as Protection and Punishment ends with a number of critical comments on the diffusion of punitive discourse in the international arena, considering how issues of crime and justice have also animated, at least in part, the current engagement with the Russian invasion of Ukraine.

This article examines the case of Kosovo as an important precedent in the development of practices of policing beyond borders–whereby military and policing practices are extended beyond borders with the aim of producing security at a distance. It examines how these practices, led by the global north, implemented as a result of humanitarian military interventions actually worked locally inKosovo, placing it in the wider theoretical context of Foucault's work on the continuum between war and law, and critically challenging the representation of the international as a space of law and justice(MacMillan, 2016). It argues that even if the representations of crime and justice have a crucial function in expanding practices of policing beyond borders, contributing to exporting liberal forms of criminaljustice to foreign countries to build peace and a liberal society, and support for international criminaljustice, the results are far from straightforward. It suggests that these practices of policing beyondborders may be contributing to the production of hybrid forms of policing in which violent contestationsto policing and criminalization are prevalent, rather than integration of different forms of justice. Thisaspect be the re-emergence of war within legal processes but may also be seen as attempts to void theestablishment of the liberal peace and of law.

It suggests that although the coupling of war with crime and justice is not a new phenomenon, its present manifestations invite careful consideration of the connection between crime and political theory. It starts by reviewing the notion of sovereignty to look then at the history of the criminalisation of war and the emergence of new norms to constrain sovereign states. In this context, it examines the three ways in which military force has recently been authorised: in Iraq, in Libya and through drones in Yemen, Pakistan and Somalia. It argues the contemporary coupling of military technology with notions of crime and justice allows the reiteration of the perpetration of crimes by the powerful and the representation of violence as pertaining to specific dangerous populations in the space of the international. It further suggests that this authorises new architectures of authority, fundamentally based on military power as a source of social power.
