This book reveals little-known facets on the history of homosexuality in Switzerland. It
is based on a detailed analysis of the revision of criminal law in sexual matters, the
discourse of groups of key actors (lawyers, police officers, psychiatrists, theologians,
homosexuals), as well as the influences of debates in the United States, Germany
and France between the end of the Second World War and the 1990s.
Cet ouvrage lève le voile sur plusieurs facettes méconnues de l'histoire des homosexualités en Suisse. À partir d'une série de recherches historiques sur les années du "placard", puis sur la révision du droit pénal en matière sexuelle, il décortique un ensemble de discours et d'actions de différents groupes d'acteurs-clé (juristes, policiers/ères, psychiatres, théologien/nes, homosexuel/les), les influences transnationales, ainsi que les politisations de concerné-es sur un référentiel différent de celui du VIH/sida et qui aboutissent en 1992 sur la totale dépénalisation de la "débauche contre nature".

This research project addresses the arguments of the supporters and opponents of Mathias Reynard's parliamentary initiative, entitled "Combating discrimination based on sexual orientation", submitted to popular vote on February 9, 2020. The initiative, accepted by the Swiss population aimed to complete article 261bis of the Swiss Criminal Code, which punishes certain forms of discrimination, by adding discrimination based on sexual orientation. The arguments of the supporters and opponents of the initiative were coded from the debates that took place in the National Council and the Council of States, as well as from the debates that took place on the airwaves of the radio program Forum, broadcast by Radio Télévision Suisse. The arguments of the opponents were then linked to the different forms of homophobia as theorized by Borrillo in particular.

À partir d'un examen sur l'évolution de la définition du viol dans le Code pénal suisse (CPS), cet article met en lumière la « circulation » des normes juridiques entre les droits pénaux et civils. Les auteur-e-s effectuent une généalogie de la catégorie juridique du « viol d'une femme hors mariage » formulée dans le CPS entré en vigueur en 1942. En 1992, le CPS reconnaît un viol conjugal. En prenant appui sur des moments clés du processus de construction de l'article pénal sur le viol (premier Code pénal unifié ; travaux d'experts, projet de loi et débats parlementaires portant sur la révision du CPS), cet article montre comment un référentiel de droit civil définissant le mariage influence, de manière différenciée, un article pénal sur le viol.
