Implementing EU environmental law in Italy
"For many years Italy has been the worst in the class of European countries failing to apply European environmental law regularly and promptly. In severe cases, this produced serious financial consequences for the Italian state. The articles gathered in this book report the result of a field research conducted over two years on the problems of implementation of European environmental law in Italy. Each examines this phenomenon by focusing on the causes and forms of non-implementation to EU environmental law. In the first part, the book explains the complexity of the implementation process particularly with regard to the transposition of directives into national law. In the second part, the book analyzes the most important infringement cases in Italy, e.g. the problem of waste in Naples, the question of hunting and the air quality monitoring requirements. It contains also suggestions on how to improve knowledge on implementation and to find appropriate mechanism to solve the problems of implementation"--Back cover

Innovation and Transition in Law: Experiences and Theoretical Settings
This book features a discussion on the modernisation of law and legal change, focusing on the key concepts of "innovation" and "transition". These concepts both appear to be relevant and poorly defined in contemporary legal science. A critical reflection on the heuristic value of these categories seems appropriate, particularly considering their dyadic value. While innovation is increasingly appearing in the present day as being the category in which one looks at the modernisation of law, the concept of transition also seems to be the privileged place of occurrence for such dynamics. This group of Italian and Brazilian scholars contributing to this volume intends to investigate such problems through an interdisciplinary prism.
